Howells Robert Lovlien Roger Mach Nora Bell Mary Jane Newton Jeff Smith Marla Rae John Stenkamp Louis Selken Jack Thornton Lucia Venator, Secretary Chairman Grubb called the meeting to order at 10:00 a.m. First order of business was the 10:00 a.m. hearing on the establishment of Wilson Road as a county road. There were no objections to said establishment. Commissioner Young moved and Commissioner Montgomery seconded that Wilson Road be established as a county road. Vote was: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Second hearing was on the proposed formation of Black Butte Ranch Rural Fire Protection District. Dick Howells representing Black Butte Ranch and Robert Lovlien attorney for the district spoke in favor of the proposed formation. There were no objections to said proposed formation. Dave Hoerning read the Notice of Final Hearing. Commissioner Montgomery moved that December 15, 1978 be set as the final hearing date. Commissioner Young seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Bob Lovlien told the Commission they were hoping for an earlier hearing so that the district could organize and elect officers by the January 11, 1977 election date. Based on this Commissioner Montgomery amended the earlier motion to set the final hearing on the formation of Black Butte Ranch Rural Fire Protection District to Monday, December 6, 1976 at 10:00 a.m. Commissioner Young seconded the amended motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. There was no discussion on Road Dept. or General Fund bills. Dave Hoerning presented the Commission with Resolutions to establish Dorrance Meadow Road and Sixth Street in Lapine as county roads. Commissioner Young moved that December 15, 1976 be set as the hearing of objections if any to establishing Dorrance Meadow Road and Sixth Street in Lapine as county roads. Commissioner Montgomery seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Court Day Minutes November 16, 1976 Page 2 Next item on the agenda was the appointment of a Taylor Grazing Advisory Board of advise the Commission on the expenditure of monies received each year from Taylor Grazing Funds for range improvement on BLM lands. Commissioner Montgomery moved that Phil Chase, J.A. Moberly and Omer Moffitt be appointed to serve on the board. Commissioner Young seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Next on the agenda was the matter of regulating the parking of the county parking lots. The new regulations will monitor the usage of the four parking lots surrounding the courthouse and annex. Commissioner Montgomery moved and Commissioner Young seconded that they dispense with the reading of the order in its entirety. Vote was: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Commissioner Young moved that the Commission adopt the order regulating the usage of the county parking lots. Commissioner Montgomery seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. At this time the 10:30 a.m. Hearing on the land transfer to Bend Metro- politan Parks and Recreation District was held. Mary Jane Newton on behalf of the park board thanked the Commission for their cooperation in this matter and told them the city had also donated 40 acres of land in this area to them. The schools are considering the possibility of building a new school on the 40 acre parcel donated by the city. Roger Mach on behalf of Vince Genna also expressed his thanks to the county. Mr. Gray, chairman of the board called Mr. Montgomery on this matter. There were no objections to said land transfer. Commissioner Young moved that the transfer be granted with a reversionary clause that the land be developed as a free public park and if at any time it is not used as a free public park the land will revert back to the county. Also a clause that Deschutes County reserves the rights to all marketable timber and that any other timber to be cut will be cut only by permission of the Board of Commissioners. Commissioner Montgomery seconded the motion. Vote on the motion was: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Hearing was closed at 10:40 a.m. Next item on the agenda was the first reading of an amendment to County Ordinance No. 203-5, Discharge of Firearms Ordinance. This amendment is to Section IV (2) "A description of the boundaries of the proposed restricted area, which shall be a platted subdivision or a recognized community." This amendment will be read for a second time, December 1, 1976 and if there are no objections, passed by the Board of Commissioners. Court Day Minutes November 16, 1976 Page 3 Dave Hoerning read a Resolution for the proposed annexation to Rural Fire Protection District No. 1. The property petitioned for annexation contains approximately 4.37 acres and belongs to Frank and Victoria Burton. This annexation has the approval of the board of directors of the fire protection district. Commissioner Montgomery moved that December 1, 1976 be set as the hearing on said annexation. Commissioner Young seconded the motion with the following vote: Bob Montgomery, aye; Abe Young, aye; and Don Grubb, aye; motion carried. Under open discussion, the Commission told the audience that no county tax dollars were being spent on digging up the mail that was buried in Knott Pit. The federal government is paying the expenses of the county crews working on this matter. Clay Edwards from Lapine took the floor and asked the Commission about the proposed water district that is being formed in Lapine. They told him there is possibly going to be a HUD Grant available to the residents in Lapine for the improvement of their water system if they so desire. However, the residents of Lapine are responsible to find out if the residents want the water system and the possibilities of forming such a district. The county is not forcing this matter on them, interested citizens from Lapine approached the Commission.
