Bell Lucia Venator, Secretary Chairman Montgomery called the meeting to order at 10:00 a.m. First scheduled business was the bid opening on the excavation for the new Justice Building construction. Gary DeBernardi and Dave Hoerning opened and read the bids. They were: Hap Taylor Jr. Unclassified excavation: Select fill: Building demolition - lump: TOTAL BID Jack Robinson & Sons, Inc. Unclassified excavation: Select fill: Building demolition - lump $ 96,900.00 600.00 10,000.00 $ 107,500.00 $ 91,800.00 600.00 4,000.00 TOTAL BID $ 96,400.00 The engineers estimate (per Century West Engineering Corp.) was: $ 156,000.00 Jack Robinson & Sons were the apparent low bidders. After extensions are checked, the official bidder will be notified. At this time the Commission recognized Ike Donat, County Assessor, who announced his resignation as Assessor to become effective March 15, 1977. He cited poor health and age as his reasons. Chairman Montgomery thanked Ike and called for a motion. Commissioner Grubb moved that the county accept Mr. Donat's resignation and appoint a new Assessor at a forthcoming meeting. Commissioner Young seconded the motion with the following vote: Don Grubb, aye; Abe Young, aye; and Bob Montgomery, aye; motion carried. The hearing on the proposed establishment of Pinebrook Blvd. as a county road was held next. Commissioner Grubb moved that they dispense with reading the lenghty legal. Com- missioner Young seconded the motion with the following vote: Don Grubb, aye; Abe Young, aye; and Bob Montgomery, aye; motion carried. There were no objections to said road establishment. Chairman Montgomery read the order. Commissioner Grubb moved that the Commission establish Pinebrook Blvd. as a county road. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Don Grubb, aye; and Bob Montgomery, aye; motion carried. There was no discussion on Road Dept. or General Fund bills. Court Day Minutes March 2, 1977 Page 2 At this time, Commissioner Young moved that Harvey Watt be reappointed to a three year term on the Road Advisory Board. Commissioner Grubb seconded the motion with the following vote: Don Grubb, aye; Abe Young, aye; and Bob Montgomery, aye; motion carried. Commissioner Grubb moved that Robert Herwick be reappointed to a three year term on the Budget Advisory Board. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Don Grubb, aye; and Bob Montgomery, aye; motion carried. Dave Hoerning told the audience that the county had been turned down by HUD for a second grant for water systems for Tumalo and LaPine. The county was going to pursue this matter by forming water districts in the respective towns and using HUD grants for the major part of the financing. With their second request turned down, the communities would have to come up with a large balance to finish the water systems. Before the county starts any formal action on the water districts, Dave would like to go into the communities of Tumalo and LaPine and get a reaction from the residents on their feelings toward starting a project that would probable require a bond election to complete. Based on this, Com- missioner Young moved that the Commission table this matter until March 16, 1977. Com- missioner Grubb seconded the motion with the following vote: Don Grubb, aye; Abe Young, aye; and Bob Montgomery, aye; motion carried. Scheduled next was the adoption of Deschutes County Road Standards. Commissioner Grubb and Dave Hoerning said they did not have proper time to review the new standards. Com- missioner Grubb moved that they table this matter until March 16, 1977 to enable the Commissioners and Dave to review the standards and make necessary changes before formal adoption by the Commission. Commissioner Young seconded the motion with the following vote: Abe Young, aye; Don Grubb, aye; and Bob Montgomery, aye; motion carried. This year like the past three years, the Commission received a request by the Redmond French Club for permission to use county roads to conduct a bike race. Commissioner Young moved and Commissioner Grubb seconded the motion that the Commission grant Redmond Highschool permission to use county roads for their LeTour Bike race, May 14, 1977. Vote was: Don Grubb, aye; Abe Young, aye; and Bob Montgomery, aye; motion carried. As in the past, the Sheriff's Department and the Road Department will coordinate safety measures. Lorin Morgan, Planning Director presented the Commission with three zone change requests. The first was by Houston Porter from A-1-40 to A-1-10 for property described per order. This request has the approval of the Planning Commission who held a hearing on the issue February 9, 1977. Commissioner Young moved and Commissioner Grubb seconded that the Commission grant the zone change to Houston Porter. Vote was: Abe Young, aye; Don Grubb, aye; and Bob Montgomery, aye; motion carried. Second request was by Jan Ward from A-1, Exclusive Agricultural to PD, Planned Development for property off Sipchen Road. This request has the unanimous approval of the Planning Commission who held a public hearing February 9, 1977 on the matter. Commissioner Young moved and Commissioner Grubb seconded that this zone change for Jan Ward be granted. Vote was: Don Grubb, aye; Abe Young, aye; and Bob Montgomery, aye; motion carried. 1 r Court Day Minutes March 2, 1977 Page 3 Third request was by Wayne Roan from A-1, Exclusive Agricultural to RR-1, Rural Recreation Residential for property approximately 12 miles East of Wickiup Junction. This request has the unanimous approval of the Planning Commission who held a public hearing February 9, 1977 on the matter. This request would allow for one acre losts, exclusive of roads. Commissioner Grubb asked for the definition of Rural Recreation Residential and Lorin told him this was a combination of residential and recreation zoning. Commissioner Young moved and Chairman Montgomery seconded that this zone change be granted. Vote was: Abe Young, aye; Bob Montgomery, aye; and Don Grubb, no. Motion carried. Under open discussion, Commissioner Young brought up the Shevlin Park Road project. He said the county had let bids for the work and now R. A. Hatch, contractor, had sent the county an additional bill for $558.00 per day for a flagman. Commissioner Grubb said that R. L. Coats'.was the apparent low bidder, but because of error in one of the exten- sions of the unit prices, R. A. Hatch got the bid for the earthwork. The Commission has received numerous complaints about the traffic being stalled for long periods of time on Shevlin Park Road. According to the contract they cannot stall traffic for over 30 minutes and they must have a flagman on duty at all times. Commissioner Young moved that the county deny R. A. Hatch his request for the additional money to pay a flagman. Com- missioner Grubb seconded the motion with the following vote: Don Grubb, aye; Abe Young, aye; and Bob Montgomery, aye; motion carried. Dave Hoerning announced that there is a vacancy on the Solid Waste Advisory Committee and he would appreciate any volunteers who might like to serve in this capacity. Theo Herwick asked the Commission what zone the Negus Sanitary Landfill site would be when it no longer is used for solid waste. They told her it was zoned industrial. Commissioner Grubb moved that the Commission hold a special meeting on March 4, 1977 at 10:00 a.m. for the purpose of appointing an Assessor to replace Mr. Donat. Commissioner Young seconded the motion with the following vote: Don Grubb, aye; Abe Young, aye; and Bob Montgomery, aye; motion carried.
