Chairman Montgomery read the order of vacation. Dave Hoerning described the location of the unnamed public road. Described as follows: Commencing at the center West One Sixteenth corner of Section 16, Township 17 South, Range 12 E.W.M.; thence South 000 11' 14" West 481.09 feet along the Easterly line of the Plat of Norwood, Section No. 2 to the point of beginning; thence continuing South 000 11' 14" West 492.81 feet; thence North 890 48' 46" West 30.00 feet; thence North 000 11' 14" East 488.49 feet; thence along the arc of a 420.00 foot radius curve to the right 30.32 feet, the long chord of which bears North 810 59' 30" East 30.31 feet to the point of beginning. Abe Young mentioned that he had seen someone camping next to this road. Dave Hoerning told him that there was a KOA Kampground near there. Abe Young then moved that they approve the vacation of an Unnamed Public Road in the Plat of Norwood. Don Grubb seconded with a unanimous vote from the Commission. Next on the Agenda was a hearing on the land transfer to Bend Metro Parks and Recreation District. The land consists of 120 acres located in the W2 of Section 25, Township 17, Range 12 E.W.M. and the NE, SW, of Section 25, Township 17, Range 12 E.W.M., with the specific reservation that if this real property ceases to be used for a public use, it shall revert to the grantor. Chairman Montgomery read the order of transfer and asked for discussion. Abe Young said that he was disappointed that no one from the parks district was present. Don Gurbb moved that they approve the land transfer to Bend Metro Parks and Recreation District. Abe Young seconded. Vote was unanimous. There was no discussion of Road Department or General Fund bills. Scheduled next was a Resolution for vacation of a portion of 17th Street from the North line of "G" Street to the South line of "H" Street and 17th Street from the North line of "H" Street to the North line of the plat of Hillman, being 60 feet in width as platted on the official plat of Hillman as recorded in the office of the County Clerk, Deschutes County, Oregon. Chairman Montgomery asked for discussion. Dave Hoerning told Chairman Montgomery that any discussion on this vacation would be brought up at the set hearing. Charlie Plummer said that there will be a lot of discussion protesting this vacation at the set hearing. Chairman Montgomery then read the resolution and said he felt that they should add a sentence that this vacation should also be posted in Terrebonne. Don Grubb moved that they add the sentence to be posted in Terrebonne and set the hearing for September 7, 1977 at 10:00 a.m. Abe Young seconded and the Commission voted unanimously. July 20, 1977 Court Day Minutes Page Two The resolution for vacation of portions of Center Street and Caledonia Street in Centralo was scheduled next. Charlie Plummer gave the description of road location, more described as the alley and those portions of Center Street and Caledonia Street adjoining Block Nine of Centralo, Deschutes County, Oregon in the SE-1, Section 26, T16S, R12 E.W.M. Mr. Plummer said that part of the road was vacated over a year ago and now they want to vacate another portion. Chairman Montgomery read the resolution and Abe Young moved to adopt the resolution and set the hearing for September 7, 1977 at 10:00 a.m. Don Grubb seconded with a unanimous vote from the Commission. Scheduled next was an order for hearing on proposed formation of Vandevert Acres Sanitary District. Dave Hoerning gave the location of the district lying in the Southwest 4 Northeast 4 and the Northwest 4 Southeast 4 Section 20, T20S, Rll E.W.M., Deschutes County, Oregon. Dave Hoerning mentioned that there was 100% participation of the land owners in this proposed district. Chairman Montgomery read the resolution. Abe Young moved they adopt the resolution and set the hearing for August 17, 1977 at 10:00 a.m. and Don Grubb seconded. Vote was unanimous. Art Johnson brought up a problem of some land around Railroad Street that was previously transferred to the City from the County and since sold to a developer. In the process of subdivision by the developer a title search was made producing a reversionary clause set up by the County requiring the land be used for public purposes only. Art Johnson asked if it was possible for the County to lift this clause without a hearing. Chairman Montgomery told Mr. Johnson that he felt the land had belonged to the citizens of the County and they should be reimbursed somehow. He asked Mr. Johnson how much the land sold for. Art Johnson wasn't sure, but he said somewhere around $500 per lot. Abe Young said that he felt that the legality of the release of this condition should be definitely determined. Don Grubb then moved that the release of condition will be allowed with the contingency that the City of Bend refund to Deschutes County, the total receipts derived from the sale of the named property with the money to then be credited to the Land Sale Fund for disbursement under the current year tax distribution percentage. Abe Young seconded and the Commission voted unanimously. Chairman Montgomery announced that the meeting set up for the Sunriver Land Sale to the U.S. Forest Service had been moved to the Bend Senior High Auditorium, Thursday, July 21, at 7:30 p.m. He then read a letter regarding this land sale, signed by the Commissioners, stating that they will oppose any further action on the land sale until a public hearing is held. Copies of this letter are available in the Commissioners office. Don Grubb moved to adopt the report and Abe Young seconded. Vote was unanimous. Don Grubb announced that a job description for a Hearings Officer was now available and will be publicly advertised. He said that at this time they would not determine wages but will call for resumes with desired wages included. In this way they could get some idea of a wage scale. Chairman Montgomery said he felt that the Planning Department could supply what secretarial services a hearings officer might need and suggested that they contact other counties as to their wage scales on hearings officers for comparison. July 20, 1977 Court Day Minutes Page Three Commissioner Grubb reported on a meeting held July 19 on HUD (Housing and Urban Development). He said that there was only one representative from the media present and that the program was set up as a two county regional housing authority. Chairman Montgomery said that Crook County had decided not to participate, Gary DeBernardi. asked whether this program covered senior citizens and incapacitated people only. Chairman Montgomery replied, no, unfortunately. Don Grubb said that this was the First Step in setting up the housing authority and the next step was for the City to adopt the resolution, He also informed the press that if they knew of anyone interested in appointment to the HUD Board to let the Commission know. Chairman Montgomery stated that there were 36 counties in Oregon and all but Crook County participating in this program.. Marla Rae asked about representation. Chairman Montgomery told her that there would be four from Deschutes County, four from Jefferson County and one to be decided on jointly by both counties. Abe Young wanted to clear a rumur that Deschutes County had decided to go on its own program. Regardless of how many counties participate there is only one program which is what Deschutes and Jefferson Counties are following. Chairman Montgomery said that they would now begin accepting and considering names for appointment to the board of HUD.
