Chairman Montgomery called the meeting to order at 10:00. First order of business was
the bid openings for Terrebonne Street Paving and Culvert Purchase 1977. Bids were as
follows:

Babler Bros., Inc. 16,700.00
Central Oregon Pavers 12,364.50
Engineers Estimate 13,773.00
Apparent low bidder was Central Oregon Pavers of Redmond. After extensions are checked,
the official successful bidder will be announced.

Purchase 1977: Beall Pipe & Tank, Corp. $17,587.90
Oregon Culvert Co., Inc. 17,866.45
Pacific Corrigated Pipe 19,885.98
Engineers Estimate 16,708.03
Apparent low bidder was Beall Pipe & Tank, Corp. of Portland. After extensions are
checked, the official successful bidder will be announced.
Chairman Montgomery opened the hearing for Establishment of Vandevert Acres Sanitary
District, located as a tract of land lying in the SW-14, NE-I4, and the NW4, SE4, Section
20, T.20S., R.11 E.W.M., Deschutes County, Oregon. Testimony was called for, there
being none, Chairman Montgomery read the Order of Establishment. Abe Young moved that
they approve the establishment of Vandevert Acres Sanitary District, Don Grubb seconded.
Vote was unanimous.
Next, Chairman Montgomery opened the second hearing for Deer Trail Road - Assessment
District #11. Mrs. Pollen representing her sister Mrs. Suliman, a property owner on
Deer Trail Road asked the Commission how her sister could be sent a bill for over
$1400. for assessment without a vote from the people concerned. Dave Hoerning said
that this has been going on for over a year and at that time a vote had been received
from property owners, with the majority for the improvement. Apparently the seller had
voted negative and was aware of the situation but failed to tell Mrs. Suliman at the
time of her purchase. Dave Hoerning suggested that Mrs. Suliman fight this out with
the person who sold her the property as that was her only recourse. Chairman Montgomery
closed the hearing and read the order. Don Grubb moved they approve the Assessment of
Deer Trail Road, Local Improvement District #11. Abe Young seconded and the Commission
voted unanimously.

There was no discussion of Road Dept. of General Fund bills.
Next on the Agenda was the vacation of a portion of Hamby Road described as lying
easterly of a line commencing at the SW corner of Lot 1 of Block 1 in the plat of
Vista Del Sol as recorded in the Office of the Deschutes County Clerk. Dave Hoerning
explained that this was to straighten out a 'hook' in the road. Chairman
Montgomery read the order. There being no objections, Abe Young moved they approve
the order of vacation. Don Grubb seconded and the vote was unanimous.
Appointments to the Central Oregon Housing Authority Board Members was next. Commissioner
Grubb read the resolution setting up the commission of four members: Claybourne J.
Edwards of Lapine, four year term; Grace Elder of Bend, three year term; Sandra
Hopkins of Bend, two year term; Charles Chester of Redmond, one year term. Abe Young
said he wanted to clear the term of Housing Authority as being a rent subsidy program
only. Bob Montgomery moved they approve the appointments and Abe Young seconded. Vote
was unanimous.
Scheduled next on the Agenda was appointments to the Alcohol and Other Drug Planning
Committee. Members of the Committee include Paul Speck, Larry Arbir, Bart Ferrar,
Don McNab, Richard Branaugh and Kent Case. Term for this committee will be until
June 30, 1978. This program will be funded through the state. Abe Young read the
letter of appointments and moved they approve the committee as selected. Don Grubb
seconded with a unanimous vote from the Commission.
A Resolution establishing priorities for the Federal Aid Urban System was next.
Chairman Montgomery read the Resolution which states that Deschutes County Commission
concurs with the City of Bend in their establishment of the following priorities:
Priority No. 1: Construction of traffic signals at the intersection of Division Street
and Greenwood Ave. Priority No. 2: Construction of a Division Street bridge over
Century Drive Highway (Franklin Ave.). Priority No. 3: Construction of S.E. Ninth
Street from Wilson Ave. to Alden Ave. Don Grubb moved they approve the resolution and
Abe Young seconded. Vote was unanimous.
Next was a resolution for a hearing on Annexation to Rural Fire Protection District
No. 2. Chairman Montgomery read the resolution. The proposed annexation will contribute
to the orderly growth and development of both the district and the territory proposed
to be annexed. Dave Hoerning gave the general location of being down in the Tekampe area.
More described as the E2 NE 4, and that portion of the W2 of NE, lying North of the main
Arnold Irrigation Canal, of S.28, and the N2 of S.27, all in T18S., R12 E.W.M. This
action has the approval of the Board of Directors of Rural Fire Protection District No.2.
Don Grubb moved they approve the resolution and set a hearing for September 7, 1977 at
10:00 a.m. Abe Young seconded and vote was unanimous.
A Resolution on an Interagency Agreement between Deschutes County and the City of Bend
was next. Bill Licky was present to answer any questions, there were none. Abe Young
read the resolution. The City of Bend is undertaking a Master Plan of Bend Municipal
Airport and has requested that Deschutes County actively participate in this planning
program and provide assistance to the vicinity planning around the airport. Abe Young
moved they approve the resolution and Don Grubb seconded. The Commission voted
unanimously.
Next was an appointment to the Board of Equalization. Chairman Montgomery said that
the appointment was made in August of every year and nominated Abe Young as Chairman.
Don Grubb seconded. Vote: Chairman Montgomery, aye; Commissioner Grubb, aye;
Commissioner Young, abstained.

said that these roads had been built last year and have been and will continue to be
maintained to County standards. Chairman Montgomery read a resolution covering all

unanimous vote from the Commission.

Next from the Planning Department was the first of three zone change requests. First,
by Lucille Townsend from R-2, Urban Residential to C-2, General Commercial, described
as follows: T22S, R10E, Section 15AD, tax lot 3800 and 3700 on Morson Street behind
the LaPine Hwy Center. Lorin Morgan read the order and said the Planning Dept. recommends
this zone change as it conforms with the Comprehensive Plan. Chairman Montgomery
asked for discussion. Clay Edwards asked if this would interfere with the final opening
of 6th Street. Dave Hoerning said, no. Don Grubb then moved that they adopt the
zone change from Lucille Townsend and Abe Young seconded. Vote was unanimous.
The second zone change request was by Sun Country Land and Cattle Corp. from A-1-T,
Exclusive Agricultural with T Standards to C-2, General Commercial, located 4 mile
North of Wickiup Junction, T21S, R10E, Section 36C, a portion of tax lot 100. Lorin
Morgan read the order. Don Grubb moved they adopt the zone change by Sun Country Land
& Cattle Corp. Abe Young seconded with a unanimous vote from the Commission.
Third request is by Ross Mather from A-1, Exclusive Agricultural to PD, Planned Unit
Development, located in T18S, R11E, Section 12 and 13, tax lot 700 bordered on the
North by Century Drive. Lorin Morgan read the order stating that this is consistent
with the Bend Urban Area Comprehensive Plan. Gary DeBernardi asked Lorin how many
acres this was for. Lorin asnwered approximately five. Don Grubb moved they adopt
the zone change request by Ross Mather and Abe Young seconded. Vote was unanimous.
Mayor, Clay Shepard asked about a deed for property near the airport. Dave Hoerning
said that the deed was in error and was returned to the City for correction and at this
time the quitclaim deed had not been returned to the County.
There being no further business or discussion, meeting was recessed' at 11:02.
