Today was Student Government Day, and each Commissioner had a student Commissioner with him. Chairman Shepard introduced Chris Wiley, Alma Everett, and Sue Hill. First item on the agenda was the Order for Amending Fees in the Planning Department. The order was signed by Chairman Shepard and Commissioner Paulson. Commissioner Young did not sign the order. Next was discussion on Commissioner Paulson's proposed Bend Urban Area Boundary Planning Commission. John Hossick was first to speak and said that he was in favor of the concept with the exception of the appeals aspect. Commissioner Paulson said he would like to see the Board of Commissioners come up with a position of our own that they can go to the city with and, if possible, get a document to the city before a joint meeting. Gordon Randall, M.R.S. Co., was next. He felt that all we would be doing is creating one more regulatory body. All you would be doing is creating more bureaucracy, which slows the decision-making process down. Mr. Randall said he did not see what was wrong with the way things are done now. Folmer Bodtker, Planning Commission member, asked if this would create another hearings officer and Bob said it could go either way. Folmer said he felt we dial not need another position of that type, and he was concerned about any group besides the Planning Commission having veto power. Polly Spofford, League of Women Voters, said she was worried about being able to appeal staff decisions, and Commissioner Paulson said that the two staffs couldn't agree then it would go to the Hearings Officer. Bob Mayfield brought up the fact that government is supposed to be set up with a set of checks and balances. By implementing this plan, you will alleviate this balance. Bob went on to say that the Commission is not supposed to influence the Hearings Officer or Planning Department, but you still have the power to wield over them by inuendo or memo on any decision that the Planning Commission has made. This is a very dangerous thing when it is put into politics. Commissioner Paulson said that he would be interested in a truly joint effort, and perhaps the word "veto" could be changed to "appeal." Commissioner Paulson asked how the Planning Commission could get the work done that they are involved in and have time to listen to all the appeals that come before them. He hoped that perhaps some things could be turned over to some other body to allow the Planning Commission more time. Folmer commented that he felt it is the public right to appeal and it would be hard to cut that out. He said you cannot set a time limit to hear some of these things, but did think that eliminating site plans from the Planning Commission could help the time element. BOARD OF COMMISSIONERS March 28, 1979 - DAILY MINUTES Page 2 "Commissioner" Wiley asked how the group would feel about a planning commission operating under two different planning departments. Commissioner Young took over and explained that he understood that the city planning had already expresses reservations about this. John Hossick, City Planner, said that the process would call for much cooperation, coordination, and would be a timely process. Commissioner Young asked him if he wouldn't be concerned that the report given by the city planning commission might conflict with the report given by the county planning commission. John said that the city would still be able to put in a report and have it considered, and it might bring things out in the open that need to be settled. Commissioner Paulson made the comment that he was in favor of his proposal for the reason it would be a means to have one body planning the destiny of the area. He said that he would rework his draft and present it at a later time for more discussion. Next on the agenda was Ken Paul of the Oregon Sailplane Association. Mr. Paul asked if Mr. Shepard had talked with Mr. Mellin and he said he had. Mr. Mellin wouldn't give specifics other than the fact that he might build a motel later and was worried about customers being bothered. Mr. Paul and Mr. Reid said they had tried to settle this with him, and since he was not receptive to any of their ideas, they were asking the Commissioners to allow them to go ahead and change the runway at Millican so that they would not be taking off over Mr. Mellin's store. The Commissioners all agreed that they could draft a proposal with a map showing exactly what they want and all the boundaries. Ken and Bill thanked the Commissioners and said they would draft a proposal to bring back to the Commissioners. Next was a final plat for signature. Commissioner Young made a motion to approve final plat for Hawthorne Town Homes, Phase I within the City. Chairman Shepard seconded it. Commissioner Young voted aye, Commissioner Paulson voted aye, and Chairman Shepard voted aye. Commissioner Paulson mentioned that Genn Venn was sending a letter to Representative Throop relevant to the Attorney Generals decision on public facilities and presented it to the Commissioners before sending it.
