First item on the agenda was the resolution and map for the Bend Urban Area Growth Boundary. Chairman Shepard read the resolution through complete for the record. Commissioner Young made a motion to adopt the resolution setting the hearing for June 18, 1979, at 10:00 a.m. in Room A. Commissioner Paulson seconded it. Commissioner Young voted aye, Commissioner Paulson voted aye, and Chairman Shepard voted aye. Next was Dave Hoerning with a major partition. Commissioner Young moved to approve MJP-79-29. Commissioner Paulson seconded it. Commissioner Young voted aye, Commissioner Pauslon voted aye, and Chairman Shepard voted aye. Next item on the agenda was Starwood. Commissioner Young moved to discontinue the review of Starwood and uphold the decision of the Planning Commission. There was no second to the motion. First to speak was Brad Fancher for Tom Pickett. He said he had examined the files marked by the Planning staff with the documents they felt should be exhibits in this matter, and he said he had no objections. He said he had written a letter to Mr. Dvorak asking that the remaining documents in the files also be marked since some weren't. He also requested that minutes of the meeting of the Planning Commission of May 10, 1978 be included in the file and marked, and there is also a newspaper article, all of which should be made a part of the record. There was a letter of April 17, 1978 to William McCann with an accompanying transcript and the December 6, 1977 Hearings Officer decision should also be included. He asked that two other documents be included (1) a map of the area that was prepared by the developer and used in the presentation before the Planning Commission, and (2) a copy of the letter from Mr. Dvorak to Mr. Brenner of the 1,000 Friends of Oregon, dated May 29, 1979. Craig Smith, Planning Dept., said that the minutes of May.10, 1978 have not yet been approved by the Planning Commission. Chairman Shepard and Commissioner Paulson agreed that these minutes will be included with all reservations duly noted, and if approved by the Planning Commission. Louis Dvorak, County Counsel, suggested that the newspaper article should not be considered as a part of the record for review since it could be biased one way or the other. Commissioner Paulson made a motion that the articles from the newspaper including the one in the file not be a part of this review. Chairman Shepard seconded it. Commissioner Paulson voted aye, Chairman Shepard voted aye, and Commissioner Young voted NO. Motion was carried. Next the letter from William McCann of April 17, 1978 was considered, and it was decided to include the letter in the record. The transcript of the December 6, 1977 Hearings Officer meeting was considered next. Brad Fancher said that his secretary had made this transcript within 10 days of the meeting because they had appealed the case. The Commissioners agreed to approve the transcript into the record subject to verification (someone from Planning listening to the tape) of the tape. Commissioner Young said that he was agreeing to these inclusions but still maintained that he was opposed to the whole proceeding.
