BOARD OF COUNTY COMMISSIONERS
NOVEMBER 1, 1979 - DAILY MINUTES
Chairman Shepard called the meeting to order at 10:03 a.m. with all three
Commissioners present. THe first itme on the agenda was consideration of
adoption of the Deschutes County Comprehensive Plan. Chairman Shepard asked
Commissioner Young if he had any comments to make. Commissioner Young read
from a pamphlet to the audience regarding "land grab", giving the audience
a brief history of the situation. Commissioner Young stated that under ORS
197.135 he would present a resolution for approval by the Board of County
Commissioners.
MOTION: COMMISSIONER YOUNG moved that the resolution he read
into the record be adopted by the Deschutes Board of
County Commissioners.
The motion died for lack of a second.
Commissioner Paulson stated that page 131 of the plan referred to just such
a situation as Commission Young suggested.
Commissioner Paulson then had some statements to make referring to the comp-
rehensive plan. He summed up his time in office and some of the accomplishments
that had been made while he was here. He stated that he felt that the Commission
had accomplished a very worthwhile project and felt that all involved could
be proud of the outcome.
Chairman Shepard joined his colleagues in making comment. Chairman Shepard
stated that the comprehensive plan had been an every present issue and had
affected everyone's lives in some way or another. Chairman Shepard said that
he believed that the people in Deschutes County needed and wanted a comprehensive
plan to live by and that is what is to be adopted today. Chairman Shepard
read into the record by title only--Deschutes County Subdivision Ordinance
of 1979, PL-14; Deschutes County Zoning ORdinance of 1979, PL-15. He then
read Ordinance Establishing a Comprehensive Plan for Deschutes County, PL-20
in its entirety. ON October 24, 1979, there was a change to Section 2.010
of the subdivision partition ordinance PL-14 was distributed which exempted
application of the ordinance that the land divisions creating parcels in excess
of 160 acres. This was done in the belief that the State law so required; it
has since been discovered that such a change is not required and in many instances
not allowed by Chapter 92, therefore the change has been deleted from the ordinance.
Final Deschutes County Goal Exceptions Statement and the Comprehensive Plan 2000.
MOTION: COMMISSIONER PAULSON moved that the Board adopt and sign
the following documents:
Ordinance PL-20;
2000-year Deschutes County Comprehensive Plan
(including the associated Plan Map and Goals
Exception Statement and Map);
Deschutes County Subdivision Partition Ordinance
of 1979, Ordinance PL-14;
Deschutes County Zoining Ordinance of 1979, PL-15
and Associated Zoning Maps.
CHAIRMAN SHEPARD: Second.
VOTE: COMMISSIONER PAULSON: Aye.
COMMISSIONER YOUNG: No.

Next on the agenda was a hearing for Mountain High, Appeal made by J.L. Ward.
Present were the following people:
Craig Smith--Planning Department Bob Paulson--Commissioner
Gary Judd--Road Department Clay Shepard--Chairman
Lynn McKibben--Road Department
Bob Lovlien--Attorney for J.L. Ward
J.L. Ward--Applicant
Lou Dvorak--County Counsel
Chairman Shepard turned the meeting over to Lou Dvorak as County Counsel to give
the Board some history of the case and let them know what is to be decided
today. Lou stated that this is an appeal from J.L. Ward from the Planning
Commission's denial of his application because condition 9 was not met. He would
like the Board to give him preliminary approval of the project that he is
doing. After discussion, it was decided that what was needed was for the Board
and Mr. Ward to come to a compromise concerning this project. Maps were shown
to the Board regarding the project. It wascdecided that J.L. Ward, Bob
Lovlien and Craig Smith and Lynn McKibben from the Road Department are to get
together and come up with a compromise and come back before the Board with it
for a final decision.
There being no further business, the meeting was adjourned.
