The first item on the agenda was Joseph Yazbeck on behalf of Mid-Oregon Crushing re Boones BoroughI Subdivision. Mr. Yazbeck stated that the reason he was present today was because the road constructed by Mid-Oregon Crushing was not being accepted by the County Engineer and Mid-Oregon Crushing and the developer Floyd Haring felt that the Engineer was asking for unreasonable acceptance standards, a three-year warranty period plus a $15,000 bond. There was further discussion and many questions were asked of Mr. McKibben, County Engineer by both Lou Dvorak County Counsel and Mr. Yazbeck, attorney for Mid-Oregon. Mr. Bob Johnnie of Mid-Oregon Crushing who did a lot of the paving of the road in question was also present and also asked questions of Mr. McKibben as well as adding to the conversation. Mr. McKibben asked Bob Kirk regarding the project stating that there wasn't any oil put down as a sealer on the road. Mr. Ron Benson who was the superintendent of the job added that there had been some problems in the construction of the road but they had been smoothed out and he felt that the road had been completed in a workmanlike manner. MOTION: COMMISSIONER YOUNG moved that Mid-Oregon Crushing and Mr. Haring be advised by the County that the Boones Borough road was,,done according to county specifications and therefore is subject to one year waiting period at which time they could apply for acceptance into the county road system. COMMISSIONER PAULSON: Second. After further discussion, Commissioner Paulson proposed an amendment to the motion just made changing the one year waiting period to three years. There was discussion about this proposed amendment. Commissioner Young stated that he would allow no amendment that would in any way jeopardize his motion. Commissioner Young moved for the previous question. The commissioners voted to cut off discussion: Commissioner Young: Aye; Commissioner Paulson: Aye; Chairman Shepard: Aye. VOTE: COMMISSIONER PAULSON: Aye. COMMISSIONER YOUNG: Aye. CHAIRMAN SHEPARD: Aye. Commissioner Paulson proposed a motion: He moved that the three year agreement referred to be drawn upedirected towards the county. The motion died for lack of a second. For signature: MP 79-150, Hanley MOTION: COMMISSIONER SHEPARD moved to approve MP 79-150. COMMISSIONER YOUNG: Second. VOTE: COMMISSIONER PAULSON: Aye. COMMISSIONER YOUNG: Aye. COMMISSIONER SHEPARD: Aye. MP 79-197, Hamrick: MOTION: COMMISSIONER PAULSON moved to approve MP 79-197. COMMISSIONER YOUNG: Second. VOTE: COMMISSIONER PAULSON: Aye. COMMISSIONER YOUNG: Aye. CHAIRMAN SHEPARD: Aye. Next on the agenda was the first reading of ordinance number 203.7, Deschtues County Road Utility Permit Ordinance, amendment. Lou Dvorak summarized the ordinance for the commissioners. MOTION: COMMISSIONER YOUNG moved that the reading in full be dis- 1 BOARD OF COUNTY COMMISSIONERS pensed with and the ordinance be read by title only. COMMISSIONER PAULSON: Second. VOTE: COMMISSIONER PAULSON: Aye. COMMISSIONER YOUNG: Aye. CHAIRMAN SHEPARD: Aye. The next reading of this ordinance will be on December 19, 1979. For signature: Appropriation Transfer order. After reading of the order MOTION: COMMISSIONER YOUNG moved to approve the transfer order. COMMISSIONER PAULSON: Second. VOTE: COMMISSIONER PAULSON: Aye. COMMISSIONER YOUNG: Aye. CHAIRMAN SHEPARD: Aye. Butler, Mr. Harold Baughman and Mr. Frank Loggan. MOTION: COMMISSIONER PAULSON moved that these three men be reappointed to serve on the Council. COMMISSIONER YOUNG: Second. VOTE: COMMISSIONER PAULSON: Aye. COMMISSIONER YOUNG: Aye. CHAIRMAN SHEPARD: Aye. These three men will be sent "congratulation" letters. Chairman Shepard had a matter that he felt could be taken care of in this meeting. It concerned the appointment of three gentlement to the Central Oregon Intergovernmental Council.
