JANUARY 2, 1980 - DAILY MINUTES
Chairman Shepard called the meeting.,of. January 2, 1980 to order at 10:00
a.m. with all three commissioners present.
The first item on the agenda was the State of the County Address by Chairman
Shepard. Chairman'Shepard noted that some of the affairs of the county were
"overshadowed" and some were made more important than they are. He touched
on highlights of 1979 and past achievements and disappointments.
The next item on the agenda was the election of a new chairman for 1980.
Commissioner Paulson nominated Commissioner Young for this position. Chairman
Shepard moved that nominations be closed and a unanimous ballot be cast for
Commissioner Young for chairman. Chairman Shepard seconded the nomination.
Commissioner Paulson--aye. Commissioner Young--aye. Chairman Shepard--aye.
Chairman Young stated that he was for the people of Deschutes County and would
work hard doing what they ask him to do.
The next item on the agenda was the final hearing for annexation to Sisters
R.F.P.D. Chairman Young read the order into the record before opening
the hearing. Chairman Young asked they was any discussion for or against this
annexation.
MOTION: COMMISSIONER PAULSON moved to approve the annexation to
Sisters Fire Protection District R.F.P.D.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
The next item on the agenda was an order in the matter of Statutory Way of
Necessity Lester C. Davis and Joyce Davis,Petitioners and Dellon K. Massman
and Nellie B. Massman, Respondents. Chairman Young read the order into
the record.
MOTION: COMMISSIONER PAULSON moved to approve the order as read
into the record.
CHAIRMAN YOUNG: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: No.
CHAIRMAN YOUNG: Aye.
Next on the agenda was the second reading of Ordinance No. 203.11--An ordinance
for the Control of Noise. Chairman Young requested a motion that this
ordinance be read by title only.
MOTION: COMMISSIONER PAULSON moved that Ordinance No. 203.11
be read by title only.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.

MOTION: COMMISSIONER SHEPARD moved to adopt the ordinance as
read into the record.
COMMISSIONER PAULSON: Second.
There was some discussion from Lt. George Morton, Mr. Ray Hatton, Mr. Gary
DeBernardi and Mr. Foster Rucker. It was discussed that maybe this ordinance
should have an emergency clause on it and not wait ninety days to put it into

effect. Commissioner Paulson suggested that the previous motion be withdrawn
and a motion be made that the Board would adopt this ordinance subject to
the addition of the emergency clause which puts the ordinance into effect upon
passage. Commissioner Shepard withdrew his motion and the seconder withdrew
his second.
MOTION: COMMISSIONER PAULSON moved that the ordinance be

Next on the agenda was the first reading of Ordinance No. 203.13. Chairman
Young read the ordinance in full for the first reading. The second reading
will be on January 16, 1980.
Next on the agenda was an order in the matter of sale of county land regarding
Ken Roth. Chairman Young read the order into the record.
MOTION: COMMISSIONER SHEPARD moved to adopt the order putting
this described county land up for bid on February 19,
1980., contingent upon the addition of the clause that
this lot is landlocked.

COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Next on the agenda was an order on the non-conforming use permit NCU 77-4,
Robert Schouten, applicant. Lou Dvorak went over the history of this matter
for the Board's benefit. Chairman Young read the order into the record.
MOTION: COMMISSIONER PAULSON moved to approve the order and
non-conforming use permit NCU 77-4.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
The last item on the agenda was a discussion from Bill Monroe, Planning
Director regarding fees for single wide mobile homes. Mr. Monroe feels
that the fees for a single wide mobile home considerations should be re-
duced so that it conforms with the fee for double wide. After discussion
Mr.. Monroe was asked to come up with a cost estimate of time and labor
of how long it takes and how much it costs to process a permit of this type.
Mr. Monroe will come back before the Board with this information Tuesday,
January 8, 1980.

Commissioner Paulson had a matter to bring up regarding the Eastern Oregon Health
Services Association. Commissioner Paulson asked who wanted to be appointed
to this cause. Commissioner Shepard and Chairman Young told Commissioner Paulson
that the member appointed for this committee does not have to be a Board member.
It was left that the Board will wait until they hear from the Association.
