BOARD OF COUNTY COMMISSIONERS
JANUARY 16, 1980 - COURTDAY MINUTES
Chairman Young called the meeting of January 16, 1980 to order at 10:01
a.m. with all three Commissioners present. Also present from various
departments were the following:

Chairman Young had a presentation to make before he got started with the
agenda for today. He stated that he did not feel that anyone who had served
as Chairman for the Board of Commissioners would ever forget that year but
just to make sure that Commissioner Shepard never forget his year, Chairman
Young presented him with a plaque.
The first item on the agenda was the establishment of a portion of 8 roads in
Romaine Village, Unit 9. Chairman Young read one order in full and then read
the names of the roads to which it applied.
MOTION: COMMISSIONER PAULSON moved to establish the roads
indicated.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Next on the agenda was the establishment of some more roads. These roads are
located in Brightenwood Estates, Phase III. Chairman Young read an order for
all roads and then named all the roads.
MOTION: COMMISSIONER SHEPARD moved to establish the roads as read
by Chairman Young.
COMMISSIONER PAULSON: Second.
VOTE COMMISSIONER SHEPARD: Aye.
COMMISSIONER PAULSON: Aye.
CHAIRMAN YOUNG: Aye.
Next on the agenda were some streets in Tumalo. Chairman Young read the
resolution in this matter and then opened the matter for discussion for
objections to be heard. Mr. Lamoine Brant stated that he owned the land
in question and would like to sell the land and so would like it vacated.
Mr. Walter Pifer was opposed to the vacation as he felt that the traffic
flow would come in more and more.
MOTION: COMMISSIONER PAULSON moved to deny the vacation of the
proposed streets in Tumalo.
COMMISSIONER SHEPARD: Second.

Next on the agenda was an order to vacate an alley in Block 6 lying between
Second and Third Streets. Chairman Young read the order into the record.
Chairman Young then opened this matter for discussion.
MOTION: COMMISSIONER SHEPARD moved to deny the vacation as
it is thought that the school may someday expand.
COMMISSIONER PAULSON: Second as there is no comment as
to why it should be vacated.
VOTE COMMISSIONER SHEPARD: Aye.
COMMISSIONER PAULSON: Aye.
CHAIRMAN YOUNG: Aye.
Next on the agenda was a resolution for vacation of All of Antelope Avenue.
Chairman Young read the resolution into the record.
MOTION: COMMISSIONER PAULSON moved that subject to correction
of the dates in the resolution and to change the reso-
lution to state that those people who are objecting to
or are in favor of this vacation should come forward.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Next on the agenda was a discussion of General Fund or Road Dept. bills.
Chairman Young stated that a summary of these bills were published once
a month in the newspaper. There was no discussion.
Next on the agenda was an appeal hearing, Z 79-13, Hagen. Chairman Young
had a letter from Mr. Bob Lovlien, Mr. Hagen's attorney in this matter re-
questing a continuance as Mr. Lovlien had to go to Portland to attend a
funeral.

Next on the agenda was the first reading of Deschutes County Procedural
Ordinance No. PL-9. Mr. Lou Dvorak stated that there had been some edi-
torial changes made in this ordinance since the last time that the Commissionrs
had looked at it. Mr. Dvorak went through the rest of the changes for
the Board. After the changes were read, Chairman Young asked for a motion
so that this ordinance may be read by title only.
MOTION: COMMISSIONER PAULSON moved to read Deschutes County
Procedural Ordinance No. PL-9 by title only for the
first reading.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Chairman. Young then read the Ordinance by title only. The second reading
will be on February 6, 1980. Mr. Bill Smith had a few suggestions to make
regarding this ordinance. Mr. Smith.will provide the Board and Lou with a
copy of his suggestions and he and Lou will get together to go through the
ordinance. Mr. Dick Knoll came into the meeting and stated that the Planning
Staff had not had time to go through the ordinance since the latest changes

had been made. The staff would like time to go through and get acquainted
with this ordinance.
Next on the agenda was the second reading of 203.12, Restricting Issuance of
Building Permits.
MOTION: COMMISSIONER PAULSON moved that 203.12 be read by title
only.

CHAIRMAN YOUNG: Aye.
Lynn Jarvis, GRAY, FANCHER, HOLMES & HURLEY had some comments to make concerning
this ordinance. She stated that she and Lou had met for 3 hours making
changes but some of the changes which she had advised were not reflective in
this ordinance before the Board today. Commissioner Shepard asked Ms. Jarvis
if she would outline her ideas in writing and submit them to the Board. Ms.
Jarvis said that she would do this. Ms. Jarvis also asked that perhaps one
of the commissioners and herself and Mr. Dvorak could get together and perhaps
rewrite portions of this ordinance so that it would become a "tighter" ordinance.
Mr. Dvorak said that his would be fine with him if the Board so wished to
meet. The Board told Ms. Jarvis that after they received her list they would
attempt to set up a meeting.
Next on the agenda was Ordinance No. 203.13 - adoption of Oregon State Struc-
tural Specialty Code and Fire and Life Safety Code.
MOTION: COMMISSIONER PAULSON moved to read this ordinance
by title only.

MOTION: COMMISSIONER PAULSON moved to adopt Ordinance 203.13 as written.

Next on the agenda for consideration was the resignation letter of William
G. Monroe, Deschutes County Planning Director. Chairman Young read the letter
into the record. The effective date of Mr. Monroe's resignation is February
15, 1980.
MOTION: COMMISSIONER SHEPARD moved to accept Mr.Monroe's letter
of resignation.
COMMISSIONER PAULSON: Second.

CHAIRMAN YOUNG: Aye.
Present this morning at the meeting was Mr. and,!Mrs. Leon Gore with. a pro-
blem regarding a trailer house that is being delivered prior to approval of
a conditional use permit. Mr, and Mrs. Gore would like permission to store
their trailer house on their lot without living in it, without any hook-ups,
until such time as their conditional permit is approved.
MOTION: COMMISSIONER PAULSON moved that the Board approve the
placement of the Gores mobile home on their property

for storage only, not for occupation or hook-up of
any kind, until such time as the appropriate hearings
body approves or denies the application. The Gores
will be required to apply this week for the conditional
use permit and to pay the required fee and that the
mobile home would be allowed to stay on the property not
to exceed 90 days or determination by the hearings body,
whichever comes first.
