BOARD OF COUNTY COMMISSIONERS
JANUARY 24, 1980 - DAILY MINUTES
Chairman Young called the meeting of January 24, 1980 to order at 10:00 a.m.
with all three Commissioners present.
The first item on the agenda was a preliminary hearing for River Forest Acres
Special Road District. Chairman Young read the notice of final hearing; the pro-
posed hearing to be held on February 20, 1980. Chairman Young asked for any
comments from the audience regarding this matter.
MOTION: COMMISSIONER SHEPARD moved to set the final hearing for
February 20, 1980 for the Special Road District.
COMMISSIONER PAULSON: Second.
VOTE COMMISSIONER SHEPARD: Aye.
COMMISSIONER PAULSON: Aye.
CHAIRMAN YOUNG: Aye.
The next matter on the agenda was a request for road standards variance
for Christy Acres Plat #487. Gary Judd from the Road Department was present
for this matter. The applicant was not present. Mr. Judd explained what
the applicant wants. Mr. Judd said that this property is in a rural subdivision
and they would like to go to private road standards. Chairman Young asked Mr.
Judd for a recommendation. Mr. Judd stated that the Road Department was not
giving a recommendation except for the fact that the roads will probably never
go anywhere. The commissioners asked various questions regarding the placement
of this subdivision.
MOTION: COMMISSIONER PAULSON moved to deny the variance based
on the fact that the roads may be needed to extend to
adjoining property in the future as indicated on the map.
Also, the fact that there may be a fair amount of traffic
on the road.
COMMISSIONER SHEPARD: Second.
Commissioner Shepard feels that more information/evidence must be received in
order for the Board to even consider granting a variance for the applicant.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: No.
The next item on the agenda were a few things for signature. The first was a
minor partition MP 79-193, Johnson. After all three commissioners looked over
the milar a motion was made.
MOTION: COMMISSIONER PAULSON moved to approve MP 79-193, Johnson.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
MP 78-27, Green was the next minor partition for signature. The commissioners
oriented themselves with the milar and a motion was made.
MOTION: COMMISSIONER PAULSON moved to approve MJP 78-27, Green.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.

MP 79-205, Brown was the last minor partition for signature.
MOTION: COMMISSIONER PAULSON moved to approve MP 79-205, Brown.

CHAIRMAN YOUNG: Aye.
Gary Judd had two more requests for road variances to bring before the Board.
Plat 476, Ranchette View Estates. Mr. Judd showed the Board a map of the area
and stated that the Road Department advises against granting this variance.
MOTION: COMMISSIONER PAULSON moved to deny the request for
variance for plat 476.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Lower Bridge Estates, Plat 46555. The Road Department recommends for this
variance request.
MOTION: COMMISSIONER SHEPARD moved to approve the variance for
Plat 46555.
COMMISSIONER PAULSON: Second.
VOTE COMMISSIONER SHEPARD: Aye.
COMMISSIONER PAULSON: Aye.
CHAIRMAN YOUNG: Aye.
Next on the agenda was a discussion regarding Des Chutes Pines, Plat 46460.
Present for this discussion was. Craig Smith, Jill Thompson, Bob Lovlien,
Mr. Morris the applicant, and Dave Hoerning. Mr. Lovlien explained that this
plat had been started in 7-78 and has been held in limbo since. There have
been numerous reasons why this plat has not been able to be approved until now
the DEQ has not given a reason as to why this is not being approved. Chairman
Young feels that this is foolish and thinks the commission should go the head
man at DEQ and get some answers. Commissioner Shepard stated that he would like
a chance to talk with Dick Nicholls a representative of DEQ before going to the
head man. Commissioner Young stated that the Board would leave this matter in
the hands of Commissioner Shepard to unravel.
The next matter brought up was that of a refund order that the Board had to put
on "hold" on January 23, 1980 due to a question that Commissioner Paulson had.
Receipt 46 15423 for $40.00 a partial permit fee was refunded as it was denied.
It was approved.
Chairman Young had two refund orders for signature: Tom Parmenter for $91
Receipt 46 13250--approved. A refund order for Nicholas Cartwright for $173.81
due to an error which was made.
MOTION: COMMISSIONER PAULSON moved to approve the refund order for
Nicholas Cartwright.
COMMISSIONER.SHEPARD: Second.
VOTE COMMISSIONER RAULSON: =Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Another refund order for approval for Bruce McCoy for $22.75. A code was
changed therefore causing an overpayment.
MOTION: COMMISSIONER PAULSON moved to approve the refund order for
Bruce McCoy.

Jill Thompson had a matter that she wanted to bring before the Board's attention.
This had to do with the animal control matter of when stray cows or horses were
picked out and they were held at one of the animal control officer's private home.
Jill asked the Board if they wanted to pay this employee anything for housing
the animals and if they wanted that stated in the lease. It was decided that the
employee would be paid $1.00 for services and the County would provide feed and
such. Jill will be returning to the Board with the agreement drawn up.
Commissioner Shepard had a letter from Paul Speck attached to some documents;
a resolution of intention to exchange. This had to do with the Ca-:Reeve land
trade. Jill looked over this resolution and advised the Board not to sign the
resolution especially since it was not drawn up by the County's Counsel.
There being no further business, the meeting was adjourned.
