JANUARY 31, 1980 - DAILY MINUTES
Chairman Young called the meeting of January 31, 1980 to order at 10:00
a.m. with all three commissioners present.
The first item on the agenda was a petition for signature for promulgation
of a rule to be sent to LCDC. Jill Thompson had presented this to each of
the commissioners previously and had explained it to them.
MOTION: COMMISSIONER SHEPARD moved to sign the petition and send
it to LCDC.
COMMISSIONER PAULSON: Second.
VOTE COMMISSIONER SHEPARD: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Due to the fact that Representative Tom Throop has to be in Salem by 1:00 p.m.,
the discussion regarding senate bill 191, mobile home fees in mobile
home parks was taken next. Chairman Young explained that the senate passed a
bill recently that requires the yearly inspection of all mobile homes in mobile
home parks for a fee of $4.75. Chairman Young stated that the Board of Commissisoners
had received some letters from mobile home users against this bill.
Letters were received from the following: Mrs. Mary Putnam with a two-page
petition; Allens Riverview Trailer Park owners; Bob Schouten; La Pine Trailer
Court, Mr. Stafford. Chairman Young then read a news release from Klamath
County which. stated that this county would not enforce this fee. Tom Throop
made a presentation in opposition to this bill. Mr. Throop said that he feels
that if this fee is imposed then services should be provided; this fee will not
secure further services for mobile home tenants; also, he feels that this is
a discriminatory gesture towards people who reside in mobile parks. Mr. Throop
stated that the next legislative session will be in January, 1981; therefore,
it will be one whole year before Mr. Throop can "attack" this issue at the state
level. Mr. Th.roop urges Deschutes County to follow Klamath County's lead and
not enforce this fee. John Glover, County Sanitarian, then had a presentation
to make in which he stated that the ORS states that the County will enforce such
fees as provided by the State. Mr. Glover is opposed to this fee as the mobile
is inspected thoroughly before the license is ever issued annually. Chairman
Young then asked if there was anyone is the audience who had any comments to make
in opposition to this bill. The following owners gave their comments: Willard
Fix, Riverview Trailer Court; Eddie Astin, Lowell's Trailer Park; Jim Newton,
Green Pastures, Redmond; Jim Dart, Desert Terrace Mobile Park, Redmond; Jay
Johnson; Kim Warden, Crown Villa. The following tenants spoke.itt opposition
Ellen Holroyd; Wilman Spencer; Dan Griggs; Tom Powell; Ken Glantz, Bldg. Official.
Commissioner Paulson stated that he felt that Deschutes County should follow
the example that Klamath County set but felt that their decision should be based
on firmer evidence that the county will not be penalized. Commissioner Paulson
introduced a motion to elimnate the annual inspection and that the Board have a
document drawn up similar to Klamath County's stating that Deschutes County will
not continue to collect the $4.75 fee as outlined in Senate Bill 191. Commissioner
Shepard seconded this motion. Commissioner Shepard stated that he did not like
to jump into these things and would like to wait until further information is
known and the commissioner have had a chance to talk to county counsel. Com-
missioner Shepard moved to table the motion until, a later date when more information
is known. Commissioner Paulson seconded that motion. The vote was taken:
Commissioner Shepard-aye, Commissioner Paulson-aye, Chairman Young-no. Repre-
sentative Th.roop stated that he would make a phone call to Paul Bailey to find
out if the County had to charge the fee or if they could discontinue doing so without
being penalized. A short recess was declared.

The commissioners reconvened the meeting, still waiting for Mr. Throop to report,
and took up another matter regarding a zone change. Ms. Janet Moore told the
Board that the Planning Department would not take her application for a zone change
until she had talked to the commissioners. Ms. Moore stated that all around her
home there are duplexes and she has been zoned such;--that no duplex can sit on
her property; she would like to change it back to where a duplex can sit on it.
Chairman Young and Commissioner Shepard advised Ms. Moore to go back to the
Planning Department and file for a zone change and ask to have the fees waived.
Next on the agenda was Howard Kraus, District engineer for the 7th Mountain
Service District. Mr. Kraus presented to the Board'an order awarding the
equipment contract to Richards of Rockford. Richards of Rockford had increased
their original bid but they were still $16,000 less than the next lowest bidder.
Mr. Kraus read the order for the Board.
MOTION: COMMISSIONER PAULSON moved that the order be approved to
award the bid to Richards of Rockford subject to approval
by county counsel as he was not present.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Mr. Throop returned to the meeting to report on his phone call. He stated
that Mr. Paul Bailey had informed him that it was the right and responsiblity
of the county involved to either enforce or not enforce the fee. The ocunty
reserves the right to state that the county is meeting adequate sanitary standards
and it does not need the added fee.
MOTION: COMMISSIONER SHEPARD moved to put the motion back on the floor.
COMMISSIONER PAULSON: Second.
VOTE COMMISSIONER SHEPARD: Aye.
COMMISSIONER PAULSON: Aye.
CHAIRMAN YOUNG: Aye.
Commissioner Paulson stated that he would like to rephrase his motion if the
seconder will approve. Commissionter Shepard approved.
MOTION: COMMISSIONER PAULSON moved that since Deschutes County has
is adequately inspecting mobile home sanitation hook-ups
at this point, that we administer Senate Bill 191 without
having any fees attached to the inspection related to that.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
The next item on the agenda was a declaration of dedication for the County
from Joseph Summers.
MOTION: COMMISSIONER PAULSON moved to approve the dedication.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.
CHAIRMAN YOUNG: Aye.
Commissioner Paulson told the other commissioners that due to an interanl
mix-up four names were left off the commissioners lists when they appointed
the comprehensive plan review committee. There were three people from
La Pine and Mary Wright from Redmond wh_o wished to be considered. It was de-

cided that another person should be added to this list and that person should
be from the La Pine area.
MOTION: COMMISSIONER SHEPARD moved to appoint Kitty Shields on this
committee.
COMMISSIONER PAULSON: Second.
VOTE COMMISSIONER SHEPARD: Aye.
COMMISSIONER PAULSON: Aye.
CHAIRMAN YOUNG: Aye.
Commissioner Shepard stated that Some time ago the other two commissioners
had charged Mr. Shepard with the formation of a sign committee. Mr. Shepard
had a list of names that he would like the other two commissioners to approve.
Those people were:
Jack Holt
Doug Smith
Ted Anderson
Bruce Knowlton
Roxanne Wentler
Commissioner Paulson stated that it might be a good idea to have another
person on this committee who would not be likely to go around putting up
signs for one reason or another. The postmaster, Randy Craig was suggested.
Commissioner Shepard will ask him if he would like to serve.
MOTION: COMMISSIONER PAULSON moved to appoint this committee with
the additional of Randy Craig if he so desires to serve
and if he does not, to find someone to replace him.
COMMISSIONER SHEPARD: Second.
VOTE . COMMISSIONER PAULSON: Aye.
