Chairman Paulson called the meeting of March 18, 1980 to order at 10:02 a.m. with himself and Commissioner Shepard present. The first item on the agenda was a discussion regarding denial of MJP 79-81, Alton L. Botts, applicant. Chairman Paulson read a note that was attached to the file from Lou Dvorak which states that the applicant would have to refile a major partition as the time has elapsed for an appeal, however, the commissioners could hear the applicants' case if they so desired, informing the planning depart- ment and the road department if they so choose. Gary Judd from the road department was scheduled to show up and discuss this case. Mr. Botts stated that he was trying to split an acre of land on Brosterhouse Road and it is zoned for 20,000 square foot lots. Mr. Botts stated that he had been told by the Road Dept. that the Botts would have to put in curbs and the like and pave the full length of the one acre road and since there are other residences on that road who would use it, the Botts don't feel that they should have to carry the financial respon- sibility of getting it paved. Mrs. Botts stated that this matter had not been appealed before the 10 days was up was because they were in California at the time that the letter came. It was suggested that the neighbors should cooperate with one another and see if together they will all pitch in and get the road paved. Phil Paschke suggested that the neighbors sign a road agreement. Lou Dvorak stated that he would research this matter further for the board and report back to them and to the Botts. MOTION: COMMISSIONER SHEPARD moved to required the Botts to reapply for their major partition, that the fee be waived for a new application, and if they disagree with the result, which obviously they must, then their case should be channeled to the Hearings Officer on appeal, and in the meantime, staff will research some of the issues that have been discussed. CHAIRMAN' PAULSON: Second. VOTE COMMISSIONER SHEPARD: Aye. CHAIRMAN PAULSON: Aye. The next item on the agenda was a discussion regarding the re-filling of vacated county positions. Commissioner Paulson had put this on the agenda, but as Chairman Young was not present, he wished it to be put on the next day's agenda. The next item on the agenda was a transmittal of record in the matter of Statutory Way of Necessity for Lester C. Davis and Joyce Davis. This document stated what was in the record that was made available for the court. Chairman Paulson read the transmittal order. MOTION: COMMISSIONER SHEPARD moved to approve the transmittal of record in the matter of Statutory Way of Necessity for Lester C. Davis and Joyce Davis. CHAIRMAN PAULSON: Second. VOTE COMMISSIONER SHEPARD: Aye. CHAIRMAN PAULSON: Aye. Another item for signature was Final Plat X6487, present for this and said that the problem with MOTION: COMMISSIONER SHEPARD moved to app Acres. CHAIRMAN PAULSON: Second. Chairman Paulson read the order for the record. MOTION: COMMISSIONER SHEPARD moved to approve the order. CHAIRMAN PAULSON: Second. VOTE COMMISSIONER SHEPARD: Aye. CHAIRMAN PAULSON: Aye. There was an order in the matter of PP#538, Mountain High for J. W. Ward. Chairman Paulson read the order into the record. MOTION: COMMISSIONER SHEPARD moved to send the proposed order to Mr. Ward for his examination and signature. CHAIRMAN PAULSON: Second. VOTE COMMISSIONER SHEPARD: Aye. CHAIRMAN PAULSON: Aye. Commissioner Shepard asked Lou Dvorak if he had ever gotten in touch with John Stenkamp of KBND. Lou said he did and that Mr. Stenkamp is putting a presentation together to bring before the Board. Chairman Paulson read an order in the matter of refund of taxes to W. A. Brinson, $116.37 and one to Dept. of Verterans' Affairs for $136.29. MOTION: COMMISSIONER SHEPARD moved to approve the refund of taxes. CHAIRMAN PAULSON: Second. VOTE COMMISSIONER SHEPARD: Aye. CRAIP-14AN PAULSON: Aye. There was another major partition for signature, MJP 79-85, Moe. Phil stated there are no problems with this partition. MOTION: COMMISSIONER SHEPARD moved to approve MJP 79-85, Moe. CHAIRMAN PAULSON: Second. VOTE COMMISSIONER SHEPARD: Aye. CHAIRMAN PAULSON: Aye. There was an order in the matter of a land sale to Central Electric Cooperative, Inc. Chairman Paulson read the order for the record. MOTION: COMMISSIONER SHEPARD moved to approve the order. CHAIRMAN PAULSON: Second. VOTE COMMISSIONER SHEPARD: Aye. CHAIRMAN PAULSON: Aye. Commissioner Shepard had a matter that he wanted to bring up regarding Mr. Coleman- Berger's problem in Redmond. Mr. Coleman-Berger had wanted to set up an auto dismantling yard in Redmond and needed to lease at least 5 acres of land from the county for 35 years. Commissioner Shepard wondered what had ever/ become of this. Chairman Paulson stated that he had just been out looking at the property that morning and said that if the yard was put on the east side of the existing wrecking yard he would see no proble with it. Commissioner Shepard asked if this site was in the Redmond Urban Growth Boundary. Lou Dvorak stated that it was. Lou stated that the county may want to be a co-applicant with Mr. Coleman-Berger and if the use was granted by the city of Redmond and the hearings officer, then the county could lease the land to Mr. Coleman-Berger if they so desired, with Mr. Coleman-Berger paying all the fees. Commissioner Shepard felt that someone should call Mr. Coleman-Berger and tell him of this development. Lou Dvorak felt that something should be put into writing and he would take care of doing this as he could inform Mr. Coleman-Berger of all the legal aspects as well as what the Board wants to do. 2 Lou stated that he would call Mr. Coleman-Berger and then would report back to the Board.
