The first item on the agenda was the review and decision of Z-80-18, Larry Davis, applicant, presented by Craig Smith, Planning Department. The area involves a surface mine on 8 1/2 acres west of 10th street, south of Terrebonne. The mine has been operating for 37 years and is still continuing to produce good cinders from the area. MOTION: COMMISSIONER SHEPARD moved to approve Z-80-18 with the conditions stated in the Order. COMMISSIONER PAULSON: Second. VOTE COMMISSIONER PAULSON: AYE. COMMISSIONER SHEPARD: AYE. CHAIRMAN YOUNG: AYE. The second item on the agenda was a discussion with Jim Meston on Livestock Claims. Jim first stated that when talking with the Commissioners yesterday he had quoted a 10% payment, which is to be 80% payment on claims. Jim' said he has called around the state trying to get help with information on these livestock claims, and no-one has been able to help him. There was question as to what the livestock is worth. Chairman Young stated that maybe we could go by the 1979 guide until a recent one could be made. Commissioner Shepard suggested to Jim that maybe he could come up with a new guide for livestock figures. The first claim Jim presented to the Board was from Jay Moberly of Terrebonne for a steer worth $342.00 which dogs had chased. The steer had a miscarriage that lead to her death. The 80% amount to be paid would be $273.00. Jim Meston stated that he believed Jay Moberly to have a legitimate reason and that he had investigated the claim himself. MOTION: COMMISSIONER SHEPARD moved to pay the claim. COMMISSIONER PAULSON: Second. VOTE COMMISSIONER SHEPARD: Aye. COMMISSIONER PAULSON: Aye. CHAIRMAN YOUNG: Aye. The next claim Jim presented to the Board was for Don Martin for three yews worth $73.00. The amount to be paid would be $62.40. In this instance dogs attacked and killed the yews. Chairman Young told Jim that in both cases if the amount paid on the claim was not enough that the claimant should come to the Board requesting more compensation. MOTION: COMMISSIONER PAULSON moved to approve the claim. COMMISSIONER SHEPARD: Second:. VOTE COMMISSIONER SHEPARD: Aye. COMMISSIONER PAULSON: Aye. CHAIRMAN YOUNG: Aye. The discussion with Gale Powell was postponed until later in the meeting as he was not present. The next item discussed was a letter Commissioner Shepard received from Donald Miller regarding the cost to appeal a claim to the Board. The Hearings Officer turned down his application and Mr. Miller doesn't feel he can afford to pay $100 additional fee to appeal it to the Board. Chairman Young suggested he be called and asked to come in to talk to the Board concerning his reasons for financial difficulty in paying this fee, before the Board will consider waiving his fee. Next item discussed was in regards to a phone conve Edwards of BLM in Portland concerning the LaPine to problems with the appraisal on this matter. His lease states that he cannot cut timber. Commissioner Paulson suggested to allow him to cut he trees. Jill will call him and let him know of this. The next item under discussion was in regards to th Nuisance Suit of Mrs. Lunda. All three Commissioners and Jill Thompson have received calls from Mrs. Lunda recently asking them what she can d about the situation. Chairman Young stated that he told her that once she proceeded in court that the situation was no longer in the Board's hands. Jill Thompson also told her that we are not responsible and that the Circuit Court has the power.. Jill stated that she will need to get an execution order from the Court. Next item was an agreement for financial partition. Donald and Mary Chamberlain want to partition their lot to use a portion for a security on a loan, MOTION: COMMISSIONER PAULSON moved to approve the financial partition. COMMISSIONER SHEPARD: Second. VOTE COMMISSIONER PAULSON: Aye. COMMISSIONER SHEPARD: Aye, CHAIRMAN YOUNG: Aye.. Also for signature was a Resolution in the Matter of River Forest Acres Special Road District. Chairman Young read the'Resolution. MOTION: COMMISSIONER PAULSON moved to approve he Order. COMMISSIONER SHEPARD: Second. VOTE COMMISSIONER PAULSON: Aye. COMMISSIONER SHEPARD: Aye. CHAIRMAN YOUNG: Aye. Commissioner Shepard mentioned that Jill Thompson will be leaving on Friday but as we do not have a new legal counsel, she would be willing to come to the County in the event we need her and as it fits her schedule. Jill told the Board she would be willing to do this for a flat rate of $150 per day. Chairman Young thought this was a reasonable fee. MOTION: COMMISSIONER PAULSON moved that the Board pay Jill Thompson to act as county counsel when necessary for $150 per day. COMMISSIONER SHEPARD: Second. VOTE COMMISSIONER SHEPARD: Aye.
