BOARD OF COUNTY COMMISSIONERS
AUGUST 20, 1980 - COURTDAY MINUTES
Chairman'-'Yo'ung called the meeting to order at 10:00 a.m., with all three
commissioners present.
The first discussion was a preliminary hearing on the Spring River Sanitary
District. Pat Dooley, initiator of the petition for Spring River Sanitary
District was present and stated that he would definitely be present for the
final hearing. Chairman Young read the Notice of Final Hearing setting the
date for September 17, in the Courthouse Annex Conference Room "A" at
10:00 a.m. The hearing was then closed to the public.
MOTION: COMMISSIONER PAULSON moved to set the final hearing on the
above matter for September 17, 1980.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER SHEPARD: Aye.
COMMISSIONER PAULSON: Aye.
CHAIRMAN YOUNG: Aye.
The second item on the agenda was a final hearing on the matter of Apache
Hills/Cline Falls Subdivision.regarding a petition filed to waive the re-
quirement to pave the roads for the subdivision. At the time Apache Hills
Subdivision was established, the guidelines for that subdivision stated the
roads would be paved. The following persons gave testimony on the matter:
DICK FORCUM: Dick stated that there is an easement but it is a private
easement. He also mentioned that there is no possible way to have an ease-
ment running along 95th Street, and that the best place for the easement is
through Cline Falls Oasis. Dick represented the people of Apache Hills.
The main concern of these people was of access to the highway. Presently,
the access is cindered roads through Cline Falls, which are not adequate
for traffic.
LEE BE14DER: Lee stated that when he bought his property in 1978, that
he was told that they could get by with gravel roads.
JOHN OSHALL: John related to the Board the guidelines and conditions for
that subdivision.
LEANORA LENATSO:- Leanora stated that she owns about 55 acres in Cline Falls
Subdivision. She had dedicated a 30 foot easement to the County for the
purpose of useage and that the County would maintain it. She stated that
the purpose was never fulfilled and that it has not been maintained. She
feels that she has already contributed to the development, and doesn't
think she should be taxed on any further development.
MIKE BAIN: Mike stated that as a homeowner in Cline Falls he would like to
see the road paved, as the Apache Hills residents will be using the road
and it is not adequate at present. He doesn't feel that he will benefit
as a homeowner if the road is not paved because of the dust and gravel on
the road. He agrees with the paving of the roads, but cannot afford to
pay for it.
JAMES COOPER: James stated that he was against the paving of the road, and
doesn't wish to pay for it.
BRUCE MILLS: Bruce suggested that the road be oiled down instead of paved.
LEONA MACY: Leona stated that she does not like the dust and would like
to see the road paved, but she cannot afford to pay for the paving.
At this time the hearing was closed to the public as there were no' further
comments.

The next item on the agenda was a preliminary hearing on the Vandevert Acres
Special Road District. Chairman Young read the Notice of Final Hearing
setting the date as September 17, 10:00 a.m. Tom Hanna, representing the
Vandevert Acres Special Road District, stated that he doesn't see any
problems with the Road District.
MOTION: COMMISSIONER SHEPARD moved to set the hearing for September 17.

COMMISSIONER PAULSON: Aye.
CHAIRMAN YOUNG: Aye.
Next, Chairman Young read a Resolution setting a hearing on the vacation
of Burgess Road (a portion of) for October 1, 1980.
MOTION: COMMISSIONER SHEPARD moved to adopt the Resolution setting the
hearing for October 1, 1980.
COMMISSIONER PAULSON: Second.
VOTE COMMISSIONER SHEPARD: Aye.

The Chairman then read an Order regarding the vacation of "E" street in
Terrebonne, Oregon. Ms. Eileen Blackler stated that the road doesn't go
anywhere. It just goes into a cliff, and is not used much by traffic.
MOTION: :COMMISSIONER PAULSON:moved to adopt the Order.
COMMISSIONER SHEPARD: Second.
VOTE COMMISSIONER PAULSON: Aye.
COMMISSIONER SHEPARD: Aye.

The next item discussed was in regards to liability insurance on airplanes
for county employees. Doug Maul stated that Bend Air., which rents planes,
does not have any liability coverage for rentals. He also stated that
coverage can be obtained for about $75.00 per pilot and for an additional
$40.00 the County can be insured on that policy. Bend Air owns the planes
and has insurance policies available but they have a $30,000.00 limit; Doug
felt that this amount would probably not be sufficient enough. Doug wished
the Board to consider this matter very seriously. Commissioner Paulson
stated that the County should not add airplane insurance onto the county
policy but that each individual flyer should obtain their own, before using
a plane for county work. Myer Avedovech stated that it was not just the
idea of insurance but the Board should also consider that the county needs
a policy stating conditions of airplane usage. Myer stated that if the
county agreed that planes could be used with insurance coverage, anyone
might want to use planes as a means of travel even though it is not a
regular means of transportation. Doug will check into the insurance rates.
MOTION: COMMISSIONER PAULSON moved that the Board set a policy that
no one be using private airplane travel for county business
until the matter on insurance coverage is finalized.

The next item under discussion was an Order in the matter of effective dates
for applications and application permits. This matter was a discussion to
review the Order,"as it would appear to the Board for signature at the
meeting of August 21, 1980. Commissioner Paulson outlined the changes
and additions to the definitions or application dates and application permit
dates. Chairman Young did not agree with the Building Permit Application
rules. He stated that it should become effective when the fee is paid.
Commissioner Paulson will draft a final copy to present to the Board at
the meeting of August 21, 1980 for action.
Myer Avedovech brought to the attention of the Board that he was asked to
give the County Counsel mail to the Commissioners until Pick Isharaâ–ºcomes
into position on September 15. Myer stated that he has received a decision
from Bend Airport regarding the zones. The county hhs a tentative zone of
AD in affect for that area. The Airport states that the County failed to
adequately address what the impact of the master plan uses were. They
did not feel the findings supported the agricultural uses financially.
Myer will submit copies to the Board so that they can review the matter,
and will get together with John Anderson to formulate a plan to present
to the Board.
Being no further business, the meeting was adjourned.
