BOARD OF COUNTY COMMISSIONERS
OCTOBER 8, 1980 - BOARD MEETING
Chairman Young called the meeting to order at 10:01 A.M. Commissioner
Paulson was not present at this time. Commissioner Paulson attended the
meeting at 10:15 A.M.
The first item on the agenda was a discussion regarding the LaPine Redi-
Mix operation. Mr.-and Mrs. Lunda of LaPine were present to speak against
the LaPine Redi-Mix Company. The Lunda's were present before the Board
at a meeting last month expressing concern that nothing has been done
regarding their complaint against Redi-Mix. This was presented again at
the meeting today. Mr. Lunda stated that the County should be enforcing
the zoning law and also stated that he feels they should not be burdened
with this responsibility. Chairman Young stated that because the Lunda's
have already taken this to the Courts, that it is now in the hands of the
Court to enforce any action taken in the decision. The Lunda's related
some items which they felt were not in conformance with zoning rules.
Commissioner Shepard stated that if Redi-Mix is complying with the site plan
which was filed in 1976 they are not in any zoning violation. One item
of particular concern was that Redi-Mix does not have a fence between them
and the neighboring properties. The Lunda's stated that this was in the
zoning ordinance. There was.question as to whether this was cited in the
site plan or not. Rick Isham, County Counsel, stated that the Redi-Mix
Company would have three options. One would be to have a fence, the other
options would be landscaping or that the operation be enclosed. Rick stated
that there are existing trees and shrubery and that this was sufficient
as a boundary. The Lunda's expressed their concern stating that they want
the County to do something. Chairman Young stated that the county was in
process of bringing a case against Redi-Mix when the Lunda's decided to take
the matter to court. This turned the authority over to the Courts. It
was decided that the Lunda's would consult their legal advisor and possibly
have their legal advisor and Rick Isham get together on this matter.
The next discussion was in regards to an exchange of EFU land between the
County and KBND. The land owned by KBND is located on Studio Road. Mr.
John Stencamp came before the Board to verify this exchange and get further
comment. Commissioner Paulson stated that the trade would have to be in
conjunction with the current zoning ordinances. He also stated that due to
an earlier decision by the Board, KBND must finance the appraisal fees for
the trade. Chairman Young stated that KBND should be advised of their
responsibility to get the land appraised as they are the party requesting
this trade. County Counsel, Rick Isham, will contact these people.
Commissioner Shepard commented on the new front door to the annex as it
does not have an emergency bar on the inside. Commissioner Shepard feels
that the door should have a bar for safety and so that a key is not needed
to get out from the inside. Commissioner Paulson suggested talking to Mike
Maier on costs for this. All members of the Board agreed that the door
should have an emergency bar particularly as it is a public building.
For signature was an Order #80-214 providing for a temporary mobile home
permit for Paulette Morris. This permit would be so they could reside in
the mobile home until after the Hearings Officers meeting.
MOTION: COMMISSIONER SHEPARD moved to approve this Order #80-214 with
correction noted on Hearing date.
COMMISSIONER PAULSON: Second.
VOTE COMMISSIONER SHEPARD: AYE.
COMMISSIONER PAULSON: AYE.
CHAIRMAN YOUNG: AYE.
As there was no further business, the meting was adjourned.
