Deschutes County Clerk Certificate Page C { If this instrument is being re-recorded, please complete the following statement, in accordance with ORS 205.244: Re-recorded to correct [give reason] previously recorded in Book or as Fee Number and Page BOARD OF'.COUNTY COMMISSIONERS OCTOBER 17, 1980 - SPECIAL MEETING The meeting was called to order by Chairman Young at 10:35 A.M., with Chairman Young and Commissioner Shepard present. Commissioner Bob Paulson attended after the meeting was called to order. This meeting was called to order in the matter of Mr. Wayne Roan's Wood Operation. This operation has been taking place for some time on property which is zoned Rural Residential (RR). This meeting was open to the public. John Andersen, Planning Director, stated that on September 30, 1980 the Planning Department sent a letter to Mr. Roan informing him that the operation on his property must be cleared off as it was in violation of the zoning ordinance and should be removed within 15 days. John stated that yesterday, October 16, 1980, he entered this property and noticed men working on splitting machinery. John informed Mr. Mark Roan of who he was and stated that they must cease the operation. John placed a "Stop Work" notice on this property which prohibits any further operation completely. John then talked with Wayne Roan, property owner, before any action was taken by the County. Mr. Wayne Roan requested of John that the Board grant them an extension of time to clear this operation from this property. As John was leaving he stopped to talk with a neighbor of the Roan's property. Mr, Palmer stated that he was very happy to see the County taking some action regarding this operation in violation of the zoning ordinance. Mr. Wayne Roan stated that he had submitted an application for a variance on another piece of land which he will transferring his wood operation to. Wayne Roan also stated that the media had blown this operation way "out of proportion" and that it was not fair to him. He stated that he had received a letter of August 8, 1980 from Margaret Hayden of the Planning Department that he was not to store wood on his property and that it should be removed. Mr. Roan said that he has worked on removing this operation , but that his wife has been in the hospital and had a couple operations lately. Mr. Roan stated that he would like three more weeks to complete his operation and remove it from this land. He requested that he be allowed to finish processing the wood before removing it from the property as it would be easier for him to do this, but even if he did not complete the process it would only take a couple weeks to remove it. Mr. Ron Palmer, neighbor, stated that he understood that Mrs. Roan had been in the hospital, but that Mr. Roan was notified back in August that he would have to remove the operation and Mr. Palmer felt that this was more than enough time to have removed it. Mr. Fred Locks also stated that Mr. Roan has had plenty of time to remove the wood out of his property even with the problems he has had. Commissioner Shepard stated that the Stop Work order means that the wood cannot be processed before it is removed and that since he has had plenty of time to do so that he should remove this wood without completing the process. MOTION: COMMISSIONER PAULSON moved that the Board require Mr. Wayne Roan to have his wood removed within two weeks., October 31, 1980, with no further processing. COMMISSIONER SHEPARD: Second.
