BOARD OF COUNTY COMMISSIONERS
OCTOBER 21, 1980 - REGULAR MEETING
Chairman Young called the meeting to order at 10:03 A.M. with all three
Commissioners present.
The first item on the agenda was the Re-hearing for Frank Dean, CU-80-47.
This item was heard by the hearings officer and approved. It was appealed
by neighbors of Mr. Dean to the Planning Commission, which overruled the
Hearings Officer's decision, denying this application. It was then appealed
by Mr. Dean to the Board of County Commissioners who also denied his request.
This re-hearing is due to new criteria established in determining placement
of mobile homes. Chairman Young opened the meeting to the public for testimony.
The first person to testify was Dan Van Vactor in behalf of the neighbors of
Mr. Dean, in opposition to this application. Mr. Van Vactor stated that
in the subdivision there are 11 single-wide mobile homes, in an area designated
for these type of mobiles, three double-wide mobiles and 12 site built houses.
Also there are two lots which have been issued building permits for. Dan
stated that this should justify the criteria that 50% or more of the lots
in the area must have conventional housing. Chairman Young opened for testimony
from the applicant or his representative. As there was no one to represent
Mr. Dean, Chairman Young closed the hearing.
MOTION: COMMISSIONER PAULSON moved that the Board draft an Order
not allowing the placement of the mobile home for CU-80-47,
Frank Dean.

The next item discussed was a Resolution #80-219 providing for the Director
of Public Works to have authority to make decision and sign Improvement
Agreements.
MOTION: COMMISSIONER PAULSON moved to adopt Resolution #80-219.

The next discussion was with Mr. Dave Luther. Mr. Luther stated that he owns
property just south of Redmond. This property is where the Miniature Golf
Course is. Mr. Luther also stated that the reason he was here is because
he would like some solution to the downzoning of his property. Mr. Luther
owns 1 acre which was zoned at the time of purchase C-2. He also stated that
the Redmond Plan has designated this property as industrial property. When
the Comprehensive Plan was adopted, the property became zoned MUA-10. Mr.
Luther stated that this property is made up of sand and rock and is not good
for any type of agriculture or farming use. He talked with the County Assessor
and found that the value of the property at time purchased was assessed at
$15,000.00 per acre. The assessment value now for the MUA-10 zoning is only
$5500.00 per acre. Mr. Luther stated that this downzoning has been a financial
burden for him and his family and wished to request the Commissioners to
consider rezoning it either industrial land or C-2 as it was previously.
He feels that this property does not fall into the criteria of farm land and
stated that he cannot do anything with this property now. Chairman Young
suggested that the County initiate a zone change for Mr. Luther and feels
that Mr. Luther should not have to pay for this problem as it was..a mistake
that this property was downzoned.
Commissioner Shepard stated that there should be a policy established for this
type of problem and stated that Mr. Luther was not the only one to have this
problem with the new Comprehensive Plan in effect. Commissioner Paulson
suggested that Mr. Rick Isham, County Counsel, look into this matter and
review it for investigation of information and report back to the Commission.
Rick stated that he will report back at his earliest convenience, about
next Tuesday, October 28, 1980.

Commissioner Paulson stated that his Ordinance might start a precedence and
would be the beginning of similar problems. Rick Isham stated that the decision
of the Hearings Officer, which was approval, is upheld until it is appealed.
There is a 15-day appeal period of which is past, due to the Hearings Officer's
decision was made August 8, 1980.
