Annexation The first item on the agenda was a preliminary hearing RFPD #1 on the annexation to R.F.P.D. #1. Order #81-031 (Chase) sets the final hearing date for this proposal for February 11, 1981, at 10:00 a.m. in the Courthouse Annex. MOTION: SHEPARD moved to read Order #81-031 by title only. YOUNG: Second. VOTE SHEPARD: AYE. YOUNG: AYE. PAULSON: AYE. MOTION: YOUNG moved to approve Order #81-031. SHEPARD: Second. VOTE YOUNG: AYE. SHEPARD: AYE. PAULSON: AYE. Public Hearing Paulson opened the hearing for the draft proposal of Deschutes County the Deschutes County Sign Ordinance. No comment was Sign Ordinance made from the general public, therefore, was open for staff and Board discussion. The following changes to the draft were the consent of the Board: Delete the third sentence of Section 5.030 relating to terminology of the Planning Commission. Add subsection 5.050(3a) to read as follows: "Business complex" means one property ownership with two or more business or office tenants as occupants of the property. Change Section 5.050(20d) to read as follows: "Ground Mounted Sign" means a sign which is not attached to any structure, and has a support which places the bottom thereof less than two (2) feet from the ground. Change subsection 5.050(21) to read: "Uniform Building Code" means the Uniform Building Code published by the International Conference of Building Officials as adopted by Deschutes County and which is referred to as "UBC" in this Ordinance. Add subsection 5.050(23) to read: "Uniform Sign Code" means the Uniform Sign Code published by the International Conference of Building Officials. Add Section 5.080 (5) to read: Where an electrical permit for sign installation is required, it shall be obtained from the Oregon State Department of Commerce, Building Codes Division, prior to making the final electrical connection from the sign to the electrical power source. Page 1 Of 5 Des. Co. BOC iap.uary 21, 1981 Add (v) and (vi) to subsection 5.090(b) to read: (v) Signs identifying a non-profit civic, charitable or benevolent event. (vi) political campaign signs. Change the first line of Section 5.130(6) to read: (6) The Planning Director determines violates ORS.138. Change section 5.080(1) to read: Applications for a sign permit shall be made irn=writing upon forms furnished by the Planning Director. Such application shall include a scale drawing of the sign including dimensions, height and materials and showing its relationship to the ground or to any building or structure to which the sign is proposed to be installed or affixed. When appropriate, a plot plan drawn to scale shall be submitted which indicates the location of proposed signing relative to street and property lines. Prior to the issuance of a sign permit, the Building Official may review the con- struction aspects of the proposed sign. The Planning Director or Building Official may require other pertinent information where in their opinion, such information is necessary for compliance with the provisions of this ordinance. Change the introductory paragrpah of Section 5.140 to spell out the names of zones, not just the letter representation of those zones. Change the introductory paragraph of Section 5.150 to spell out the names of zones, not just the letter representation of those zones. Change the introductory paragraph of Section 5.160 for reasons stated in the above paragraph. Change the introductory paragraph of Section 5.170 for reasons stated in the above paragraph. Change the introductory paragraph of Section 5.180 for reasons stated in the above paragraphs. Change the introductory paragraph of Section 5.190 as stated above. Add Section 5.195 to read: SIGNS PERMITTED IN THE AIRPORT DEVELOPMENT ZONE. This section shall apply to all signs within the "Airport Development" (A-D) zone as identified within the Deschutes Count Zoning Ordinance of 1979 (Ordinance No. PL- No signs shall be permitte in these zones except as set forth in this section. Delete the first sentence of Section 5.210 and change the third line to read as follows: Free-standing signs may be sixteen (16) feet in height plus Page 2 of 5 Deschutes Co. BOC January 21, 1981 Add subsection 5.230(2)(a) to read: Outdoor advertising signs in existence at the time of adoption of this ordinance shall not be considered as non-conforming signs and are not subject to the provisions of Section 5.260. Change Section 5.460 to read: PENALTIES. Any person. who violates any of this ordinance upon conviction thereof, shall be punished by a fine of not more than $500. Young also would like this above paragraph incorporated into the section dealing with political signs, rather than bonding. The above changes to.the draft were suggested per memo from Bruce Knowlton of January 20, 1981. The following changes were suggested in the work session before the Board of Commissioners yesterday during their regular meeting. Change Section 5.120(4) to eliminate the sentences relating to bonding for campaign signs. Change Section 5.120(3) to read: Signs identifying or advertising a non-profit civic, charitable or benevolent event. Said signs shall be removed within seven (7) days after the event. Change Section 5..140(1) to read: Sign Area. One (1) sign shall be permitted, not to exceed 32 square feet in area and 10 feet in height for use not in a platted subdivision or in a platted subdivision in which the average lot size is 3.0 acres or greater. For a use within a platted subdivision in which the average lot size is less than 3.0 acres, one sign shall be permitted not to exceed 3 square feet in area, four (4) feet in height and shall not be illuminated. Change Section 5.150(3) to read . . . "not to exceed fifty (50) square feet . . instead of 75 square feet. Change the last sentence of subsection 5.210(3) to clarify the intent which was expressed by the Planning Commission when the formula was developed. Change wording of Section 5.170(2a) so as to be more clearly stated. Change the last line of Section 5.170(la) to read: Right of way, provided however such sign area does not exceed a maximum of 500 square feet. Other comments from the Board included the possibility of leaving the option open to the applicant that if they did not have a free-standing sign, they would be able to allow more wall space for signing. Young and Paulson agreed with this suggestion. Shepard was not sure at this time. Paulson suggested that Bruce draft something to this effect into the ordinance to prepare for the 1st reading and adding an emergency clause. Paulson then closed the hearing. DESCHUTES CO. BOC January 21, 1981 Amending PL-15 At this time there was a 2nd reading and possible setback requirements adoption of Ordinance #81-003 amending Section 6.040 of PL-15 relating to setback requirements for residential structures from the stream. VOTE YOUNG AYE. SHEPARD: AYE. PAULSON: AYE. Establishment An order establishing a portion of Rosland Road was of Rosland Road discussed at this time. Dave Hoe~rning stated that he would like this hearing postponed until the middle of February as there has been no designation of roads within this subdivision. MOTION: YOUNG moved to continue this hearing to that time which is specified by Dave Hoerning, Surveyor or the Road Department. SHEPARD: Second. VOTE YOUNG: AYE. SHEPARD: AYE. PAULSON: AYE. Establishment At this time the Board discussed Resolution #81-004 setting of Jordon Lane a hearing date of March 4, 1981 for the establishment of NE Jordon Lane. MOTION: SHEPARD moved to adopt Resolution #81-004. YOUNG--Second . VOTE YOUNG: AYE. SHEPARD: AYE. PAULSON: AYE. Establishment Resolution #81-005, setting a hearing date of March 4, of NE Juniper 1981 for the establishment of NE Juniper Ridge was Ridge before the Board for action at this time. MOTION: YOUNG moved to read in its entirety. SHEPARD: Second. VOTE YOUNG: AYE. SHEPARD: AYE. PAULSON: AYE. MOTION: YOUNG moved to adopt SHEPARD: Second. VOTE YOUNG: AYE. SHEPARD: AYE. PAULSON: AYE. Resolution #81-005. At this time Shepard stated they should possibly look into the methods of acceptance of roans into the County. BOC Januaiy 21, 1981 Establishment of Order #81-003, establishment of Norwood Road. Norwood Road Paulson opened the hearing. Gary Judd stated that this establishment was to replace the recently vacated portion of Norwood Road, due to a realignment. MOTION: SHEPARD moved to approve Order #81-003. YOUNG: Second. VOTE SHEPARD: AYE. YOUNG: AYE. PAULSON: AYE. Contract with At this time the Board discussed the contract with the City of Bend City of Bend to hire the County Hearings Officer from for loan of the County to hold hearings. This contract became Hearings Officer effective January 1, 1981. Paulson read the agreement entirely. This contract all-ow--s--t-Fe- County Hearings Officer to hold hearings for the City of Bend for $350. per month payable to Deschutes County. .MOTION: SHEPARD moved to approve the agreement.
