Chairman Paulson called the meeting to order at 10:00 A.M. Both
Commissioners Young and Shepard were also in attendance.
Public Hearing: Betsy Shay of the Planning Department stated that there
Amendment to had been an oversight concerning the Bend Urban Area
Bend Urban Area Zoning Ordinance that she hoped to have the Board resolve
Zoning Ordinance at this time. Last October Gary English came to the
public hearing for the ordinance to request that plant
nurseries be allowed in three zones: UAR-10, SU-22 and
RL and RS zones as a conditional use. When the amend-
ment was prepared the qualification that this use be a
conditional use was not included. The ordinance before
the Board today is to rectify that oversight. Gary
English now has an application pending and it has been
pending since last fall. This ordinance must be in
effect before his application lean be finalized.
MOTION: SHEPARD moved that the Chair give the first
and second reading of Ordinance #81-006 by
title only.

Vacation of Gary Judd of the Road Department brought Resolution #81-
River!Bend Dr. 007 before the Board for signature and approval. This
resolution is for the vacation of a portion of River Bend
Drive, which is included in one of the LID's. The por-
tion to be vacated was never constructed.

lishing a hearing date for the vacation of a

Discussion: Commissioner Young said this is a problem which is

exceeds the revenue from the tax, making this a cost
liability for the county. The taxpayers who must comp-
ensate for this cost are residents of the urban areas.
Young said it would actually be less expensive to com-
pletely exempt some of these from paying tax. Commissioner
Paulson responded that they cannot remove these from the
tax roles, but possible the Board could draft a reso-
lution or an order which would direct the Assessor not
to collect taxes on property which amount to less than
a specified amount. Commissioner Y-oun~ said he would
place this item on the agenda again ter further re-
searching the matter.

Amendments to the agenda:
1. Memorandum from the Board to the Building Official.
Commissioner Youn said that past actions prompted the
assumption that thie Building Official was not completely
aware of his duties so the Board drafted a memo in which
those duties were defined. Commissioner Paulson said

this memo serves as a directive to the build'UR-offi_cial.
MOTION: SHEPARD moved that the Board sign the memo to
Ken Glantz, Building Official.
YOUNG: Second.

2. Proposed notice to those holding a lease with
Deschutes County.
Commissioner Shepard had drafted a notice, but in the
third paragraph it stated "in the near future". This
would not apply in all cases. Commissioner Young sug-
gested changing that to read "the lease will be expir-
ing". Chairman Paulson agreed this would be approporiate.
Young noted that this would give them notification that
the lease would be up for review at its expiration.
MOTION: PAULSON moved that the document by typed up in
a letter as discussed, signed and distributed.

3. Discussion with Randy Povey regarding MP-79-156.
Mr. Povey is the surveyor who was handling some part-
itions for the owner of the land, Mr. Fisher. This
partition is an old one that had not met some of the
conditions set forth by the County. When Mr. Povey
received letters of expiration relating to this partition
he thought they were for another partition that the
owner had decided to let lapse. He did not discover
that it was this partition that was not in compliance
until he went to sell a parcel, and found that it was
not a legal parcel because the roll change requirement
had not been met. Also the mylar had not been signed.
Commissioner Paulson said that there was nothing in
the record to indicate that the material was not there,
as required, with the possible exception of the docu-
mentation which is nothing that bears signature.
MOTION: YOUNG moved that MP-79-156 be processed based
on:the findings of fact that conditions were
met prior the expiration date.
PAULSON: Second.
VOTE": PAULSON: AYE.
SHEPARD: AYE.
YOUNG: AYE.
The Board will sign this when they get the other signatures.
