Deschutes County Clerk Certificate Page t- - If this instrument is being re-recorded, please complete the following statement, in accordance with ORS 205.244: Re-recorded to correct [give reason] previously recorded in Book or as Fee Number and Page DESCHUTES COUNTY BOARD OF COMMISSIONERS March 3, 1981 - Regular Meeting Chairman Paulson called the meeting to order at 10:00 a.m. Both Commissioners Young and Shepard were also present. Amendments to Rick Isham said that he had two order for transfer of the Agenda funds--for today's agenda. Discussion re- Dr. Quas and Bob Mayfield were present to discuss with garding Possible the Board a possible land trade with the County. Dr. Land Trade with Quas has 130 acres of land with river frontage near Dr. Quas Oden Falls that he would like to trade to the County for 720 acres of County land near Buckhorn Road. There was some discussion on the values of each piece of prop- erty and some of the inherent problems that need to be addressed. One problem noted by the Planning Department was the County land in question was zoned Surface Mining Reserve and the Comprehenisve Plan states that the County should not dispose of land with surface mining potential. Mr. Mayfield suggested that the Commissioners inspect this property personally to see if they felt that surface mining was a realistic possibility. After further dis- cuslsion on conditions that Dr. Quas and Mr. Mayfield would like to have the County agree to before a trade, Chairman Paulson asked them to submit to the Board in writing the terms of the agreement and any riders to a contract they would like to have included. It was also agreed that the two parties should meet in the near future to go out and inspect the two parcels of land in question. Update on Pat Pilcher came before the Board to present a brief County Lands update of his progress with the County Lands Inventory. Inventory He has completed his field work at this point and is now in the process of compiling the data in the form of a map and text. He briefly outlined the major land holdings of the County. He noted that there may be some points of historical interest on some of these parcels, as several parcels had old homestead sites. Two of the most frequent problems he found were some cases of timber theft and overgrazing on lands that had been leased for grazing. He said that currently only 11 grazing leases are in effect, yet in many cases, the land is being used for grazing even though it is not currently being leased for such a use. He also noted that the county owned a park, known as Annette Dodds Park which was located west of Lava Butte. It was covered by some lava but is was mostly second growth pine, and a very interesting spot because it is an island in the lava flow. Access to it is from Benham Falls Road. It is situated on the east side of the river and a couple miles east of Benham Falls. Pat expects to have this inventory completed-in two weeks and will present it to the Board at that time. Page 1 of 5 'Deschutes County BOC March 3, 1981 Industrial land At a previous meeting, Commissioner Young brought leasing policy to the Board's attention the fact that the Mainline and proposed lease had taken a sharp increase in rent due to the lease adendums fact that the rents were based on the prime interest rate. After consulting with some local real estate firms, he found that leases are more commonly computed with the Portland Consumer Price Index. He consulted with Rick Isham who drafted a discussion draft for the Board to review at this meeting. The computation of rent in this draft was tied to the Portland Consumer Price Index, or twice the amount of property tax on the leased property, whichever was greater. The first year's rent, however, was to be twice the amount of the property tax, and would include payment of the property tax in that amount. Commissioner Shepard noted that the language in the lease did not clearly state that this amount should include the payment of property tax and should be changed to clearly indicate this. Rick Isham siad that prior to the renewal date on these leases, the Board could hold a meeting to de- termine whether they wanted to continue to go by the current agreement or make adjustments. This would make it more reasonable if the consumer price index should take a jump as the prime interest rate had done. Rick had also typed up an adendum to the Main- line lease, to correct the sharp increase in rent it had experienced due to the old lease policy. Commissioner Shepard noted that in the second paragraph in read "true-s ca- value" but should be changed to read "the most recent assessed value". Rick said that he would redraft this to include the changes noted by the Commissioners in the form of a resolution. All the Commissioners were in agreement with the concept of this lease policy and noted that it will change only the payment provision of the industrial lease agree- ments. Helen Rastovich said she would like a directive on where the funs sE_o_uTd go. Rick Isham responded that they should go into the land salesund for disbursal at the end of the year. Award of Bids on Neil Hudson of the Road Department presented to the Trucks Board a memorandum regarding the award of bids for two 5-6 yard dumptrucks. One bid was rejected be- casue it did not meet the required specifications. The low bid was from Murray & Holt Motors (GMC) for $45,887.06. MOTION: YOUNG moved that the Board authorize the urchase of two 5-6 yard dumptrucks for $45,887.06 from Murray & Holt Motors and authorize the purchase of rubber tire rollers under a lease purchase agreement as dis- cussed on January 13, 1981. Deschutes County BOC - regular meeting March 3, 1981 Award of Bids on Neil Hudson presented to the Board a memorandum McVey Bridge regarding the award of bids for the McVey Road arch culvert pipe bridge. They received 13 bids, one of which was rejected because it was only a partial bid. He recommend that the contract be awarded to the low bidder, Del Barber Construction, Inc., in the amount of $13,323.00. MOTION: SHEPARD moved to accept the recommendation of the Road Department that the bid be awarded to Del Barber Construction, Inc., for the McVey arch concrete culvert type bridge in the amount of $13,323.00. Discussion re- Neil Hudson said that the Public Works department had garding Public originally planned to install a security alarm system Works Alarm and later decided to install a fire alarm system as System well, in the hope that it would save on the,cost,.0f insurance premiums, as well as the cost of restoration in the event of a fire. Aftre designing the system and preparing the specifications, they opened it for bids but received none. The estimated cost for this project is between $30,000 and $40,000. They plan to refine their specifications and go out for bids on this project again. They intend to separate the two systems and call for bids on each system separately, which would give the Board the option of installing one or both of the systems. .This ,will `-also _,giye -each.: system a s.epar.ate cost.. . Discussion regard- Chairman Paulson had a letter from the Deschutes County ing appointment to Fair Association stating that Don Meltenberger's term the Deschutes on the Deschutes County Fair Board had expired and County Fair Board recommending that he be reappointed to another three- year term. Don Miltenberger be reappointed County Fiar Board for another Other Staff/Public Ben Russell came before the Board to express interest Concerns in beginning a zoological garden or small zoo for Cen-. tral Oregon. This was a result of the shooting of a tame deer in the area by the Department of Fish and Wildlife. He expressed interest in some county land that is currently under consideration for industrial development, located on Highway 97 North. Commissioner Shepard said that his proposition iney be able to co- exist with the industrial use, and that the Board would keep him posted. Mike Maier said that he would like to set up a policy that on any transfer of funds the involved departments go through Rick Isham for the drafting of the order. In the past there had been some problems with dis- crepancies as a result of the language of the order.
