Public Hearing Chairman Paulson opened the public hearing.
Amendment to Rick Isham, County Counsel, explained the ordinance

Request by Mr. Isham said that he had received a letter from Mr.
Greg Steckler Steckler dated the end of June requesting a release
for a relhease of another tax lot with respect to some property under
of property a land sales contract. He briefly explained the history
on a land of this contract. He said that there was $11,837 still
sales contract owing on the contract, with $3,000 owing in unpaid taxes.
He expressed some concern about the division of a third
parcel, as this is under a planned unit development,
involving some common area. After some further discussion,

it was determined that the only way of obtaining the
deed to the second parcel would be to pay off the con-
tract, because of the common area involved.
Request for Dick Knoll, Associate Planner, came before the Board

Bud Evans, 18270 Rock Spring, Bend; and Kit Korish,
220 N.W, Straight, Bend; were also present to discuss
this. They are residents of Bear Springs Acres.. They
lodged a complaint against a neighboring property owner
within the subdivision, Heinz Bir_kenfeld, who is
operating an upholstery business out of his home. Mr.
Evans explained that prior zoning enforcement officers
had gone to his property to investigate, but Mr. Birken-
,feld denied that there was any business activity, He
has since run an ad in the Yellow Pages for his business.
There was some further discussion. Chairman Paulson
suggested that Mr. Andersen place this in his file of
zoning complaints and handle it as time became available.
Commissioner Young suggested that;-they check the former
zoning enforcement officer's file and see if there is a
reasonable assumption that there is a violation taking
place and if so, they could send a letter to Mr. Birken-
feld giving him a certain amount of time to respond.
It was agreed to send a letter. The option of setting
up a fee system was discussed. Revenue for zoning enfor-

MOTION: SHEPARD moved that they accept the recommendation
of the Planning Commission and appoint Stephen
Thompson and Duane Clark to the Planning Commission.
Stephen Thompson's term will expire July 1, 1984
and Duane Clark's term will expire July 1, 1985.

Other Staff/ Richard L. Oberdorfer, Western Radio, came before the
Public Con- Board to lodge a complaint regarding the bids for the

letter from him dated July 14, which Chairman Paulson
read aloud. He lodged his complaint based on inconsis-
tencies between the advertised specificiations and the
actual specifications. Doug Brown, attorney representing
Mr. Oberdorfer in this matter, was also present.

He said that the bidding specifications called for
.25 microvolts but the bid was awarded to Rheinholdt
TV and Communications who bid a unit that produced
.35 microvolts. There was-further discussion between
the Board, Mr. Oberdorfer and his attorney, and Neil
Hudson, Director of Public Works.
MOTION: YOUNG moved that the award of the contract
to Rheinholdt stand and that the matter be
closed at this time.

For Signature:Before the Board was Resolution #81-052,in the Matter
Resolution of Road Load Limit Posting of Tetherow Road. Chairman
#81-052 Paulson read the resolution aloud in full.
MOTION: YOUNG moved to adopt Resolution #81-052.

(2) Requests Before the Board were two requests for refund. The
for Refund first was receipt number 24999 in the amount of $40
to be refunded to J.R. Griffin. The second was re-
ceipt number 24976 in the amount of $51.48 to be re-
funded to Chester Armstrong. The first one was approved,
there was some question on the second one and it was
withheld until the Board could obtain clarification.
MP-81-19, Craig Smith brought this before the Board for signature
Ernest Raw- and approval. The applicant was Ernest Rawlins, MP-
lins 81-19.
MOTION: SHEPARD moved to approve MP-81-19.

MJP-80-23, Craig Smith brought MJP-80-23, Donald Hite applicant,
