Commissioner Young called the meeting to order at 10:00 a.m. as acting
chairman in the absence of Chairman Paulson. Commissioner Shepard
was also in attendance.

community. Members of their committee are also scheduled
to do speaking engagements. She requested that the

throughout the county, and asked that the Board help
in any way possible with publicity.

John Andersen, Planning Director, said that they had

Coats. Mr. Andersen had called Mr. Coats to inform
him that a site plan would be necessary for the continued
use of the site. Mr. Andersen and George Read of the
Planning Department did visit the site the day before.
Mr. Andersen showed the Board aerial photographs of
the site to demonstrate what is occurring. He said
that it does appear that there has been a violation
of the surface mining section of the ordinance. Mr.
Andersen said that Mr. Coats had indicated that he
would consider filing a site plan. Jean Carpenter,
a nearby resident, said that during October there was
quite a lot of blasting occuring at the site. She
said that at that time the blasting ceased because
the State showed some interest.
Rick Isham, County Counsel, said that the county had
requested that the state condition their permit on
obtaining a county site plan approval. The state took
the position that they were separate issues. Commissioner
Shepard said that it was necessary for the operation
to file a site plan by the 21st of December, and until
that time it would be inappropriate for the operation
to be proceeding. He said that if the Board takes
no action at this time it would in a sense be an implied
approval, and whatever steps are required have to be
taken at this time to see that the ordinance is followed.

Mr. Carpenter said that when this was in operation
before, their biggest objection was they hours of operation
for the asphault plant. He said that it was in operation
at all hours of the night. He said that their major
concern is that legal operating hours be observed.
Mr. Andersen suggested that the Board direct the Planning
Department to place a stop work order on the site.
MOTION: SHEPARD moved that the Board place a stop
use order until a site plan is approved.
The motion died for lack of a second. Commissioner
Young said that if Mr. Coats does not file a site plan
by the deadline stated on the letter they should take
some action, but until then not put a stop work order
on the property.
MOTION: YOUNG moved that the Board proceed with a
stop work order on December 22 if the application
has not been made.
The motion died for lack of a second. Commissioner
Shepard explained that he did not second the vote because
it closes off the Board's ability to proceed prior
to that time.
