DECEMBER 18, 1981 - CONTINUATION OF DECEMBER 16, 1981 COURTDAY MEETING
Chairman Paulson called the meeting to order at 9:00 A.M. Commissioner
Shepard and Commissioner Young were also in attendance.
Continuation Chairman Paulson noted that written testimony had been
of Hearing on submitted by the Central Oregon Builders Association (COBA).
Ordinance #81- He also noted that the Planning Department had prepared
043, the Sub- a sheet containing proposed changes based on testimony
division and given at the December 16 hearing. Also submitted to the
Partition Board as written testimony was a letter dated December
Ordinance 17, 1981 from Bob Lovlien.
Chairman Paulson opened the meeting for further oral test-
imony. Paul Ramsey, Avion Water Company, carne forward.
He said that he agrees with the proposed written changes
prepared by COBA.
Mike Kment, COBA, said that with respect to Section 6.035,
Provisions, he would like to see the County maintain authority
in the urban growth areas. He said that the changes pro-
posed by the Planning Department are unacceptable being
consistent with the urban area agreement. He also said
that there was a cost problem in requiring that iron pipe
be used. He said that with the changes that have been
proposed in their written testimony it would allow for
development that would not be prohibitively expensive.
He also suggested that there be a variance allowing the
issuance of a building permit if all the final improvements
have not yet been completed. There was some further dis-
cussion on this, especially concerning the larger density
developments. Mr. Kment suggested that they borrow from
the Multnomah County ordinance for the higher density devel-
opments. John Andersen, Planning Director, suggested adding
the words "no building permit shall be issued by the County,
unless this provision is waived by the hearings body be-
cause of the character of the subdivision." It was the
concensus of the Board that this language should be added.
Bob Lovlien spoke briefly about the variance criteria.
He said that this criteria was hard to meet and suggested
that it be modified. He felt that these criteria would
restrict development of more innovative types of projects.
He suggested giving the Planning Commission and Hearings
Officer more discretion on these criteria. There was some
discussion on this. Mr. Andersen said that because of the
liberal provisions for phasing, alternative developments
should be provided for.
Mr. Kment said that they are not satisfied with delegating
responsibility to the muncipalities. He felt that the
County should assume the responsibility. Mr. Andersen
said that the County is bound by a management agreement
with the cities, because of this these provisions cannot be
changed.
Being no further testimony, Chairman Paulson closed the
hearing. Commissioner Young said that he is concerned
about the City having the authority to stop a development
in the urban growth boundary outside the city limits.

He felt that they should not have the authority to
control development outside of their jurisdiction.
There was some further discussion on this. Commis-
sioner Young suggested that the Board accept and incor-
porate Section 6.035, General Provisions, as sub-
mitted by COBA. Commissioner Shepard stated that the
both governing bodies had agreed with this management
agreement and was not longer in the stages of consideration.
There was some further discussion.
Chairman Paulson called for the first reading including
changes that.will be incorporated into the ordinance.
MOTION: SHEPARD moved to indicate that the items on
the page submitted by staff, plus page 23, Sec-
tion 4.050 (2) be incorporated into Ordinance
#81-043.

title only.

Chairman Paulson gave the first reading of Ordinance #81-043
by title only.

Mr. Isham noted that because they don't have unanimity
it cannot be read by title only. Chairman Paulson stated
that the second reading of the ordinance will be on
December 31, 1981 at 10:00 a.m.
