Chairman Shepard called the meeting to order at 2:07 P.M., reconvening
the January 5, 1981 regular meeting. The purpose of the meeting was
to discuss the distribution of Forest Receipts. Commissioner Paulson and
Commissioner Young were also present.
Neil Hudson, Director of Public Works, had prepared draft motions for
the distribution of Redmond's and Bend's forest receipts. He noted that
the City of Sisters took all the County Roads into their City Road System
in 1980. He also noted that all of the City of Bend's Forest Receipts
are committed to Division Street. He said that the committment to Division
Street outside of the city limits is unrelated to this. He-expressed the
Road Department's concern about having to maintain County roads that are
located inside city limits that the cities have not taken into the city
road system, which leaves the responsibility of maintaining these roads
with the County. The draft motions prepared by Mr. Hudson were as follows:
"In consideration of sharing forest receipts with the.'City.of
Redmond, it-is moved that the city enter into an agreement for
accepting all County maintained streets within the city over a
12 year period for maintenance and that all future annexations
take the adjacent roads for maintenance. It is also moved
that L.I.D.'s can be used to bring the roads up to city standards
and the county support for these L.I.D.'s will be the annual share
of forest receipts for Redmond."
"In consideration of sharing forest receipts with the City of
Bend, it is moved that the city enter into an agreement with
the County that provides for the improvement of Division Street
with the city's share of forest receipts and upon completion of
Division Street that the city take all county maintained roads
within the city for maintenance and agree to take all roads for
maintenance within any annexations."
There was some discussion on these motions. Mike Maier, Director of
Administrative Services, asked what would happen if the City suspended
work on the Division Street project. I was suggested that a time limit
be placed on this condition. There was some further discussion of the
projected development of Division Street.
Commissoner Young proposed the following motion:
In consideration of sharing the forest receipts, cities take all
county roads inside city limits and county will allocate city's share
of forest receipts to be spent as they see fit on their street
program. If the cities do not take county roads inside the city
limits, coutny will allocate cities' share of forest receipts
for maintenance of county roads inside the city limits to the
extent necessary for such maintenance. Any forest receipts above
this amount would be allocated to the cities.
There was some further discussion of the motion. Mr. Hudson noted
that since there would be more forest receipt monies that was originally
anticipated, even if the county reserved some of the forest receipt
monies that would have been given to the cities to maintain county

roads within the city, the cities would still have money to implement
their street programs. Mr. Maier briefly outlined what amounts of
money they will be dealing with. He said that the total amount of
forest receipts, including the unanticipated monies, is $159,795.79.
It was noted, however, that next year's forest receipt revenues are
expected to be considerably lower. Chairman Shepard expressed
concern about reserving these monies when the cities have been of
the understanding that they would be receiving them. He also stated
that if the forest receipts are much lower next year, this could sub-
stantially reduce their road maintenance budget. Commissioner.Paulson
suggested that they add to the motion language enabling the county
to enter into agreements regarding additional financing for future
projects.
MOTION: YOUNG moved that in consideration of sharing of Forest Receipts
that the cities take all county roads inside the city limits
and that the county will allocate city's share of Forest Receipts
to be spent as they see fit on their street program. If the
cities do not take county roads inside the city limits, county
will allocate city's share of forest receipts to maintenance
of county roads within the city limits to the extent necessary
for such maintenance. Any forest receipts above this amount
would be allocated to the cities. The county would still
consider participating in the financing of special projects
that would help the overall traffic pattern, in addition to
the city's share of Forest Receipts.
Chairman Shepard amended the motion to add the following sentence:
That the split be 80/20.
Commissioner Young consented.
PAULSON: Second.
There was some further discussion. Mr.. Maier gave some budget figures
that will apply as a result of this motion. He said that by raising
the percentage they will help Bend out but not Redmond. Chairman Shepard
said that he would vote no on the motion because he did not feel that
it was well enough thought out.
VOTE: SHEPARD: NO.
PAULSON: NO.
YOUNG: NO.
Chairman Paulson made some amendments to the motion.
MOTION: YOUNG moved that in consideration of the cities sharing forest
receipts, if cities take over all County roads inside their
respective city limits, the County will allocate the City's
share of Forest Receipts to them to be spent as they see fit
through their street fund. If the cities do not take over
the county roads inside the city limits, the County will allocate
the cities' share of forest receitts to maintenance of County
roads inside the city limits to the extent necessary for such
maintenance. Any of the cities' share of the forest receipts
above this amount would be allocated to the respective citites.
The County will still consider participating in financing
special projects that would help the overall traffic pattern,
in addition to the city's share of the forest receipts. The
base share of the cities' forest receipts shall be 16% of
the County Road Fund's share of the Forest Receipts.
PAULSON: Second.

Commissioner expressed concern about not knowing what the impact of
this action will be to both parties involved. He felt that this merited
further study. There was some further discussion of the impact this
would have. Mr. Maier said that this would not affect Sisters at all
and it would not affect the budgeted figures that the other two cities
already have, the figures they had budgeted for before it was known
that there would be additional revenue. He did not feel that this
would have any other affect until next year. He said that this will
affect the 1981-82 budget only in.the fact that they will not increase
their budget money.
VOTE: SHEPARD: NO.
PAULSON: AYE.
YOUNG: AYE.
Being no further business, the meeting was adjourned.
