Deschutes County Clerk Certificate Page C - If this instrument is being re-recorded, please complete the following statement, in accordance with ORS 205.244: Re-recorded to correct [give reason] previously recorded in Book or as Fee Number and Page F DESCHUTES COUNTY BOARD OF COMMISSIONERS March 3, 1982 - Courtday Meeting Chairman Shepard called to order the continuation of the meeting of March 2, 1982 at 10:02 a.m. Commissioner Paulson and Commissioner Young were also in attendance. Chairman Shepard noted that amendments to the agenda included an Appli- cation for Operating Permit for Power-Driven Machinery on Deschutes County Land from Central Oregon Pumice and hearing an approval of a variance granted by the 'Planning Commission counter to a denial by the Hearings Officer. The Board will review and consider the Planning Commission's decision. Discussion This was brought before the Board by Rick Isham, County regarding Counsel, in continuation of the matter discussed at Contracts and yesterday's meeting. Mr. Isham prepared a resolution Agreements authorizing Doug Maul, Facilities Coordinator, to sign with regard to contracts for personal services on behalf of the county Doug Maul in amounts less than $5,000.00. Mr. Isham noted that the Board had not considered in great detail the joint decla- rations for Worker's Compensation coverage. As of the 1979 Legislature, any person who provides primarily personal services to the county and is injured in the course of his.work.would be eligible for Worker's Compen- sation benefits under the county coverage. In the event the county did not carry him under their coverage, the county would constitute a non-complying employer for the purpose of that coverage. Mr. Isham explained that this means the county would have to hire big companies to do work like drywall, plumbing, electrical, etc. The legis- lature has allowed an employer to sign with a sole pro- prietor what is called a "joint declaration". That is then filed with the county's Worker's Compensation carrier which says that this person is truly acting as an independent contractor, that he has no employees and that he understands that he will not be covered under county Worker's Compensation insurance. Until 1979, SAIF was required by law to insure sole proprietors if they wished to be insured. When SAIF became a public corporation, they were given the same right to refuse people as any other insurance carrier providing Worker's Compensation insurance in the state. Prior to 1979 or 1981, people were able to obtain Worker's Compensation coverage and that was a requirement before they could do work for the county. According to Mr. Isham, Doug Maul is finding that people available to do small jobs are not insured with Worker's Compensation coverage. The method of safe-guarding the county is to have this joint declaration signed and filed with the carrier. Mr. Isham prepared a form of joint declaration which is to be submitted to the carrier, SAIF, for approval. MOTION: PAULSON moved to adopt Resolution #82-007. YOUNG: Second Page 1 of 3 DESCHUTES COUNTY BOARD OF COMMISSIONERS March 3, 1982 - Courtday Meeting Chairman Shepard wanted assurance that Mr. Maul is fully aware of any problems that could arise and that proper caution will be taken to ensure this. Mr. Isham noted that Mr. Maul will hire people as in the past. For those without Worker's Compensation coverage prior to beginning work, a joint declaration will be filed with the Worker's Compensation carrier. VOTE: SHEPARD: AYE PAULSON: AYE YOUNG: AYE Mr. Isham felt that because a few other people are authorized to enter into small contracts, it might be a good idea to inform county supervisors that when they are hiring someone to do work and the person is not covered by Worker's Compensation, they be apprised of the situation. Perhaps someone like Mike Maier could administer that portion of the proram so the county would not be picking up any potential liability for part-time work. Commissioner Paulson suggested that Rick Isham be asked to discuss this matter with Mike Maier and put together a document to go to department heads explaining this. Chairman Shepard so ordered. Application Chairman Shepard introduced the application from Central for Operating Oregon Pumice for an operating permit for power driven Permit on machinery on Deschutes County land. Commissioner Paulson Deschutes stated that this was a very standard document that is County Land presented to the Board each year by Bill Miller of Central Oregon Pumice. Mr. Miller has a fence that goes through county property and wants permission to patrol the fence with power driven machinery to eliminate vandalism and fire hazards. Chairman Shepard signed the operating permit. Review and Before the Board was a matter for review and consideration. Consideration MOTION: YOUNG moved that the Board call up the matter of Pruitt of the Pruitt Variance, V81-12, for review. Variance PAULSON: Second VOTE: SHEPARD: AYE PAULSON: AYE YOUNG: AYE Board of Commissioner Young mentioned that the Board of Equalization Equalization is in need of one more member. He noted that the person will have to be appointed by the Budget Board. He stated that the meetings will begin on Tuesday, March 9, from 5:15 until 9:00 p.m. and will continue through the week. Lois Prante, a citizen attending the meeting, agreed to serve on the Board. Commissioner Paulson noted that there Page 2 of 3 DESCHUTES COUNTY BOARD OF COMMISSIONERS March 3, 1982 - Courtday Meeting was not a quorum of the Budget Board, however, a motion would be entertained and the quorum vote would be obtained by phone. MOTION: PAULSON moved that the Budget Board appoint Lois Prante to a position on the Board of Equalization. YOUNG: Second Commissioner Paulson suggested that the Chairman of the Board of Equalization, Commissioner Young, call one of the other members of the Budget Board to get one more vote. VOTE: SHEPARD: AYE PAULSON: AYE YOUNG: AYE The motion is pending until there is a quorum of the Budget Board. There being no further business the meeting was adjourned.
