Deschutes County Clerk Certificate Page If this instrument is being re-recorded, please complete the following statement, in accordance with ORS 205.244: Re-recorded to correct [give reason] previously recorded in Book or as Fee Number and Page DESCHUTES COUNTY BOARD OF COMMISSIONERS April 20 and 21, 1982 - Regular Meeting Chairman Shepard called to order the meeting of April 20 and 21, 1982 at 10:00 a.m. on Wednesday, April 21. Commissioner Paulson and Commissioner Young were in attendance. Discussion Commissioner Paulson stated that he had discussed this regarding matter with Ron Nelson of Central Oregon Irrigation Potentially District. He explained that this is a pit on Highway 20 Hazardous and Bear Creek Road that has been used as a target Activity on practice area. COID has land adjoining County land and County Land the people are shooting off of COID land onto County land. Commissioner Paulson indicated that Mr. Nelson has expressed an interest in a joint venture between COID and the County to erect a fence. Mr. Nelson stated that COID has posted the land but people are removing the signs. Commissioner Paulson noted that if a fence were built and posted it would alleviate the problem but the target shooters would just find someplace else to use. Commissioner Young asked if it would cost more to put up a fence and post it or improve the area for a rifle range. It was felt the fence would be more expensive. Commissioner Young suggested that the cost of a fence be investigated. Commissioner Paulson noted he would be willing to talk to the County Recreation Committee to try to locate a suitable site for a rifle range, and suggested that Mr. Nelson check into the cost of a fence. Discussion Connissioner Paulson noted this was .7 of an acre on regarding the Pilot Butte Canal. Ron Nelson stated that if the Transfer of County wanted to maintain that water right they would Water Rights have to transfer to land on the Pilot Butte Canal system. Commissioner Paulson asked if there were any way to transfer the water right to the Central Oregon Irrigation District with a reversionary clause. Mr. Nelson stated that the COID has not been interested in acting as a custodian. He noted the water rights were vested in lands by a court decree in 1958 and to move the water right from the land takes action by the state. Mr. Nelson stated that the County will probably be acquiring small amounts of water as partitions and plats are approved. Chairman Shepard noted that the County will need to figure out some means of disposing of these water rights. Commissioner Young suggested that County Counsel look into it. Mr. Nelson noted that if the water right is not used the water rights are considered abandoned and the assessments can go on. He noted that in this particular problem the use of the land has changed from a piece of ground to be irrigated to a subdivision that has blacktop over the water rights. He stated that the application was originally started in 1978 and the County may be able to get it approved by the state. He noted that the request before the Board is to sign a release allowing the landowner who made the application make the transfer. He explained that the man who owned the land at the time the property was subdivided made the application and when he went to map it, found that the County has expanded their right-of-way. Commissioner Young suggested that the Board sign the release. Rick Isham noted that he would bring it to the Board for signature. For Signature: Chairman Shepard noted that this ordinance, amending Ordinance Ordinance PL-15 has been through hearing and approved #82-018 by the Hearings Officer. Rick Isham stated that this ordinance would require two readings. MOTION: YOUNG moved that the first reading be by title only. Chairmamf)Shepard suggested perhaps the County could offer a sliding scale rate for disposal at the landfill plus a contractual arrangement. Neil Hudson, Director of Public Works, and Roy Wickersham, Solid Waste, will talk to all the large users of the landfill and see what kind of agreement can be reached.
