Daly, Dennis R. Luke and Tammy Baney. Also present were Laurie Craghead, Legal Counsel; Catherine Morrow, Community Development; Susan Ross, Property & Facilities; Timm Schimke, Solid Waste Department; and several other citizens. Chair Daly opened the meeting at 10:00 a.m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was Consideration of Second Reading and Adoption, by Emergency, of Ordinance No. 2007-019, an Amendment to the Flood Plain Zone. Laurie Craghead stated that Kristen Maze was not here to present the item. Today is scheduled for the 2°d reading, adoption and declaring an emergency with an effective date of September 28, 2007. Before the Board was Consideration of Whether to Hear an Appeal of a Deschutes County Landmarks Commission Decision (Applicant: Tumalo Irrigation District). Catherine Morrow distributed Order No. 2007-145 to the Board and staff, requesting the Board to hear an appeal of a Landmarks Commission decision regarding a fence around a historic landmark site. The fence is the Tumalo Irrigation District head gate. The Landmarks Commission approved HLA-05-01, the reconstruction of the head gate and construction of a fish screen at that site. As a condition of that approval they required that the Tumalo Irrigation District come back to the Landmarks Commission with a design for a fence. The fence was constructed without taking that step before the Landmarks Commission and then, after the fact, the applicant went before the Landmarks Commission to get an approval of the fence. The Landmarks Commission issued a decision denying that request. This appeal is of that decision. Staff recommendation is to hear the appeal de novo, but limited to the issue of the fence. The District and the staff from the Landmarks Commission met last week and the District is willing to work with the Landmarks Commission to try and come up with a plan that will meet the Landmarks Commission concerns. That is why we are requesting that you hear it but we will not schedule the hearing until December. Hopefully, that will give them time to resolve this issue. LUKE: Move approval of Order 2007-145. Before the Board was Consideration of Signature of Order No. 2007-144, Designating The Bulletin for the Publication of All Notices Relating to Real Property Tax Foreclosure Proceedings. Ms. Craghead said the Commissioners signed an Order last year for the 2006- 2007 foreclosures. This year they are asking the Board to sign it in perpetuity rather than having to come back every year to get the Bulletin as the designated paper. There will be a notice published in the Bulletin on the 16th of August for this years tax foreclosures. Statues require us to have a designated newspaper of general circulation in the County. We are asking for it to be continuous until revoked. BANEY: Move approval of Order 2007-144. LUKE: Second. VOTE: LUKE: Yes BANEY: Yes DALY: Chair votes yes. 5. ADDITIONS TO THE AGENDA LUKE: Move approval, with the absence of Dave Kanner, that the bills go through with just two County Commissioners' signatures. BANEY: Second. VOTE: LUKE BANEY: DALY: Yes. Yes. Chair votes yes. Commissioner Baney said the Redmond City Council has stated they would come to a compromise on the agreement we have related to the tip fee increase. BANEY: Move approval of tip fee increase be put in abeyance until January 1, 008. DALY: Second. Commissioner Luke read part of ORS 294.435, Section 6. He stated changing the implementation of the tipping fee reduces revenue. This requires a resolution, not just a motion, and requires a public hearing. He would like Legal Council to make the determination. Commissioner Baney rescinded her motion. After this item is researched, it will again be brought before the Board.
