Daly, Dennis R. Luke and Tammy Baney. Also present were Dave Kanner, County Administrator; Tom Blust and George Kolb, Road Department; Becky Wanless and Charity Hobold, Parole & Probation; Kyle Gorman, Watermaster; Laurie Craghead, Legal Counsel; media representative Jeff Mullins of KBND Radio; and six other citizens. Chair Daly opened the meeting at 10: 00 a. m. 1. Before the Board was Citizen Input. The Board presented a plaque and letter to Becky Wanless for her twenty years of service to the County; she will be retiring later this year. They also presented a plaque and letter to Charity Hobold for her twenty-five years of service to the County. 2. Before the Board was Consideration of Signature of Order No. 2007-148, Establishing Portions of Choctaw Road, Agate Road and Apache Road as County-maintained Roads. George Kolb said this is the final action to be taken on this issue. He added that Pumice Butte is the last local improvement district project to be undertaken at this time due to a lack of funding for road maintenance. LUKE: Move approval. BANEY: Second. Before the Board was Consideration of Approval of Document No. 2007- 257, an Intergovernmental Agreement with the Oregon Water Resources Department regarding Watermaster Services. Kyle Gorman gave a brief overview of the item, which is a program shared by Deschutes and three other regional counties. LUKE: Move approval. BANEY: Second. VOTE: BANEY: Yes. LUKE: Yes. Before the Board was Consideration of First and Second Readings and Adoption, by Emergency, of Ordinance No. 2007-022, Changing the Zone Designation for Certain Property from Forest Use F-1 to Forest Use F-2 (Applicant: Pine Forest Development LLC). Laurie Craghead explained the item, which needs to be approved this week in order to fulfill timing requirements. LUKE: Move first and second readings of Ordinance No. 2007-022 by title only. Before the Board was Consideration of Signature of Order No. 2007-146, Modifying Conditions regarding the Transfer of Certain Real Property to the City of Bend. Dave Kanner stated that this is on the agenda at the request of the City. When the County conveyed Juniper Ridge property to the City in 1990, it included a restriction regarding the use of the property until the development of a master plan by the City of Bend. This Order will allow Les Schwab to purchase property and build on twenty acres within Juniper Ridge. John Russell, the City of Bend's Economic Development Director, and Neal Cole, Corporate Counsel for Les Schwab, came before the Board. Commissioner Luke asked if this Order is just for a single property. John Russell said the City has been working on the master plan for a year; he will present the entire package to the Board when it is completed. This is just for the acquisition of property by Les Schwab Corporation, which is moving its headquarters from Prineville. Commissioner Baney asked how long it might take to complete the master plan. Mr. Russell stated that the plan is almost done but there is controversy related to the development, and negotiations are taking place. It could be mid-October. Commissioner Baney asked if the timing is critical. Mr. Cole replied that they cannot wait until the master plan is done, and would impact the construction of the facility. They would like to break ground this month and complete construction and occupy the buildings by the end of 2008. Mr. Russell stated that the City Council was concerned since this is not part of the master plan, but did not want Central Oregon to lose the business. Commissioner Baney said that she is sensitive to other businesses who might want to do the same thing. Commissioner Baney asked if there is a way to modify the restriction in order to put pressure on the City to get the master plan completed sooner. Mark Pilliod replied that the overall issue should be addressed at another day; this simply carves out a document for Les Schwab to purchase and occupy specific property. Commissioner Daly noted that what the Board does today does not tie the hands of future Commissioners, as the actions of past Commissioners does not restrict what the Board does today. Things change over time and the Commissioners should not stand in the way of this action. Minutes of Board of Commissioners' Business Meeting Wednesday, September 5, 2007 Page 3 of 6 Pages Commissioner Baney stated that the situation is bigger than Les Schwab, as she feels that even though the agreement was entered into in the past, changing the conditions should have been addressed sooner, since this favors one company over others who also might want to purchase property in Juniper Ridge. John Russell said they would like to open up more land next year but the biggest obstacle is the work being done with ODOT on the intersections and State highway. Commissioner Luke said that the City is trying to put local traffic on the highway, instead of using local roads for local traffic. Commissioner Daly stated he has not heard from anyone who wants industrial land there and no one has objected to the sale to Les Schwab. Commissioner Baney said that there has not been a great deal of publicity on this particular transaction. Mr. Pilliod noted that the controversy regarding the overall development of Juniper Ridge has been well publicized and anyone who is interested would likely be in attendance.
