Luke and Tammy Baney; Commissioner Michael M. Daly was out of the office. Also present were Tom Anderson and Kristen Maze, Community Development; Laurie Craghead, Legal Counsel; Tom Blust, George Kolb and Dan Sherwin, Road Department; and Marty Wynne, Finance; and two other citizens. No representatives of the media were present. Commissioner Baney opened the meeting at 9:30 a. m. 1. Before the Board was Consideration of Citizen Input. None was offered. 2. Before the Board was Consideration of the Reading and Signature of a Proclamation Declaring October 10, 2007 as Bob Slawson Day in Deschutes County. Commissioner Baney read the Proclamation to the audience. LUKE: Move signature, and that Commissioner Daly be allowed to sign it as well. BANEY: Second. VOTE: BANEY: Yes. LUKE: Vice Chair votes yes. Before the Board was Consideration of Signature of Document No. 2007- 536, an Intergovernmental Agreement for FAN Services for the Bend-La Pine School District. LUKE: Move signature. BANEY: Second. Before the Board was Consideration of Signature of Resolution No. 2007- 134, Establishing a No-Parking Zone on Baker Court, within Deschutes River Woods Subdivision. George Kolb said that the owners of the Baker Road Store said that they are concerned about vehicles parking on the dirt and gravel area near the store, which is creating a traffic hazard. Commissioner Luke said that the Deschutes River Woods Homeowners' Association has asked that a turn lane be added in that area as it is hazardous to enter the flow of traffic there during busy times of the day. He asked if the Road Department staff could work with them in this regard. LUKE: Move approval. BANEY: Second. VOTE: BANEY: Yes. LUKE: Vice Chair votes yes. 5. Before the Board was Consideration of Signature of Document No. 2007- 543, a Gate Permit for Northwest Way. Mr. Kolb stated that there is a problem with vehicles parking in front of her property, using that location to access BLM land. BLM has closed their property to motorized vehicles. BLM supports the gate permit. The other neighbors are supportive of the permit as well. The permit carries conditions; it can be revoked or changed at any time if circumstances require it. Mr. Kolb said that there was a turnaround and parking area there at one time but the BLM has fenced it off. The gate would cause the users to park farther back from her property. The vehicles are parking on the County right of way. Minutes of Board of Commissioners' Business Meeting Wednesday, October 10, 2007 Page 2 of 6 Pages Commissioner Luke said that BLM is creating the problem and have some responsibility to solve it. He is not supportive of the gate permit at this time until BLM has been contacted in this regard. Tom Blust said that BLM would like to discourage access to public lands through subdivisions; they prefer access be through Lower Bridge or other public lands instead. BLM is supportive of the gate. Braedi Kolberg, the owner of the property said her main concern is that when BLM closed off part of their land, her driveway became a turnaround for vehicles. BLM did not intend this to be public access to their lands, through a subdivision. She often can't get out of her driveway because several cars will be parked there. People also let their unleashed dogs run in the area and she has found them standing in her garage. The Sheriff gets called on a regular basis due to problems with drinking, drug use, shooting guns, loud music, ATV use, speeding vehicles and other inappropriate activities on her property. The County owns the road and therefore her private property has become the parking lot. There was never an official BLM parking area there. The gate would still allow horses and pedestrians, but not vehicles. The neighbors agree that the placement of the gate in the chosen location would be very helpful. Commissioner Luke said that the subdivision property owners might be able to get a no-shooting zone established there. He said he is not ready to vote on this today. He asked if the Road Department could create a no parking area there. Mr. Kolb said that BLM still wants to leave it open for pedestrians and horses. Commissioner Luke feels the gate is the last alternative and won't solve the problem in the area. He suggested that no parking signs be put in, and if BLM doesn't like it they can create an official parking lot. Ms. Kolberg said that there is no place for vehicles, especially for horse trailers, to turn around so they use her driveway. Ms. Craghead asked if the property can be fenced and gated. Ms. Kolberg stated that it is fairly large and it would be expensive. Commissioner Baney said that the Road Department staff can investigate other options and will advise the Board if the gate appears to be the only option. 6. Before the Board was Consideration of Signature of Document No. 2007- 541, a Grant Agreement with the Oregon Department of Agriculture regarding the Control of Yellow Flag Iris. Minutes of Board of Commissioners' Business Meeting Wednesday, October 10, 2007 Page 3 of 6 Pages Dan Sherwin explained that this plant is very aggressive and is causing problems around the irrigation canals and the Deschutes River. The Oregon Department of Fish & Wildlife is also concerned about the plant because of the harm it causes to fish and other wildlife. LUKE: Move approval. BANEY: Second. VOTE: BANEY: Yes.
