MINUTES OF BUSINESS MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, OCTOBER 29, 2007
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Michael M. Daly, Dennis R. Luke and Tammy Baney.
Also present were Dave Kanner, County Administrator; Chris Bedsaul, Community
Development; Laurie Craghead, Legal Counsel; and one other citizen. No
representatives of the media were present. Chair Daly opened the meeting at
10:00 a. m.
1. Before the Board was Citizen Input.
Commissioner Luke disclosed that he has been contacted by a woman who lives
out by the airport, trying to put a local community/neighborhood group together
to talk with the County about upcoming construction work to be done at the
Bend Airport next year.
2. Before the Board was Consideration of Signature of Order No. 2007-154
Accepting or Denying an Appeal of the Hearings Officer's Denial of a Land
Partition (Applicant: Hopp) - continued from October 22.
Chris Bedsaul gave an overview of the item, which has been discussed by staff
and Legal Counsel. The original notification didn't contain the necessary Title
18 citation, and the Hearings Officer's decision includes this part of Code as a
basis for denial. It has been determined that people entitled to testify did not
get adequate notification. Additional information has been provided by the
applicant. It is felt that this be heard on appeal based on the dwelling issue.
Laurie Craghead added that because of the limitation notification, the Board
could hear this on a limited de novo basis on the specific aspects. The time
clock has been extended indefinitely.

Commissioner Luke does not want to hear this. The other Commissioners were
supportive of hearing the appeal.
BANEY: Move to accept a hearing on this appeal on a limited de novo basis,
based on Code Title 18.40.060.
DALY: Second.
VOTE: LUKE: No. (Split vote)
BANEY: Yes.
DALY: Chair votes yes.
3. Before the Board was Consideration of Signature of Order No. 2007-155,
Accepting an Appeal of the Hearings Officer's Denial of a Legal Access
Application (Appellant: Sporasky).
Mr. Bedsaul stated that the appellants applied for a lot partition; the Hearings
Officer denied the application in regard to legal access. The applicant made
efforts to acquire access from the County; there were time constraints. The
applicant has since acquired the legal access from the County and staff feels they
made a reasonable and prudent effort and should be able to have an appeal heard.
Commissioner Luke asked if the Hearings Officer had information on the
access, would it have been approved. Mr. Bedsaul said it would have been.
Bruce White, representing the applicant, asked if this could be heard as soon as
possible in view of Measure 49 being on the November ballot. Commissioner
Daly asked if this could be scheduled in less than the ten day period that is
usually required. Ms. Craghead stated that it would be difficult to do this in
such a short time frame due to publication requirements. Commissioner Luke
expressed concern about setting precedence by allowing this type of scheduling
adjustment. Commissioner Daly said that this is a unique situation and he
doesn't think it would have that kind of impact since it is on one minor issue
and the neighbors are supportive. Staff will work with Mr. White to try to
schedule this hearing in an expedited manner.

4. Before the Board was Consideration of Signature of Document No. 2007-
542, an Amendment to the State Drinking Water Program Administered
by Deschutes County.
Ms. Craghead said that in January the State will make the amendments she had
requested; however, the current agreement is being signed by other counties and
she recommends approval.
LUKE: Move approval.
BANEY: Second.
VOTE: LUKE: Yes.
BANEY: Yes.
DALY: Chair votes yes.
5. ADDITIONS TO THE AGENDA
None were offered.
Being no further items to come before the Board, Chair Daly adjourned the
meeting at 10:30 a. m.
