Daly, Dennis R. Luke and Tammy Baney. Also present were Dave Kanner, County Administrator; Kristen Maze and Terri Payne, Community Development; Laurie Craghead, Legal Counsel; and one other citizen. No representatives of the media were present. Vice Chair Luke opened the meeting at 10:00 a. m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was Consideration of Second Reading and Adoption of Ordinance No. 2007-020, Various Text Amendments to Modify Deschutes County Code. Kristen Maze gave a brief overview of the item. BANEY: Move second reading, by title only. LUKE: Second. VOTE: BANEY: LUKE Yes. Chair votes yes. Commissioner Luke conducted the second reading at this time. BANEY: Move adoption. LUKE: Second. Before the Board was Consideration of First Reading of Ordinance No. 2007-005, Changes to the Destination Resort Code. Terri Payne gave an overview of the item. Laurie Craghead stated that the record has been closed so no testimony can be taken at this time. Commissioner Luke asked how the 45 and 38 weeks were determined. Ms. Payne stated that the numbers were not scientifically derived as far as she knows. Ms. Craghead added that legislation was done after a lot of discussion and compromise. Commissioner Baney said that with the changes being made in reporting, she wants to see how this works out. She doesn't see urgency in adopting the part relating to the number of weeks. Ms. Payne said that this won't affect existing destination resorts; they would have to modify their conceptual plan and it would come before the Hearings Officer. Commissioner Luke stated there is no scientific data to support the number and only theories. He doesn't see why someone would want to put a property in a rental pool if they didn't intend to rent it out. Ms. Craghead added that the property would have a deed restriction that would require it be in the rental pool. Commissioner Luke said if there is a problem with reporting, that has nothing to do with the number of weeks; it just takes greater enforcement. Commissioner Baney observed there is no scientific data; properties just have to be available, but not rented. She feels that the increased reporting requirements would eventually show how the market for this works. She'd like to address this component in the future. BANEY: Move amendment of the Ordinance to retain the 45 week requirement instead of going to 38 weeks. The motion died for lack of a second. LUKE: Move first reading of Ordinance No. 2007-005.
