DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, SEPTEMBER 24, 2007
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Michael M. Daly, Dennis R. Luke and Tammy Baney.
Also present were Dave Kanner, County Administrator; Tom Anderson, George
Read, Anthony Raguine, Will Groves, Dee Van Donselaar and Kristen Maze,
Community Development; Laurie Craghead, Legal Counsel; and one other citizen.
No representatives of the media were present.
Chair Daly opened the meeting at 10: 00 a. m.
1. Before the Board was Citizen Input.
None was offered.
2. Before the Board was Consideration of Signature of Document No. 2007-
510, an Amended Improvement Agreement for Required Visitor-
Orientated Accommodations for Caldera Springs Destination Resort.
Will Groves explained the reason for the amendment. The accommodations are
now under construction, but because the project will cost nearly $2 million
additional, a revision to the agreement is needed.

3. Before the Board was Consideration of First Reading of Ordinance No.
2007-021, Amending County Code, Adding Supplemental Provisions for
Home Occupations.
Kristen Maze said there have been no changes since the last meeting and no
additional public comments have been received.
LUKE: Move first reading.
BANEY: Second.
VOTE: LUKE: Yes.

DALY: Chair votes yes.
Chair Daly then did the first reading, by title only. The second reading and
adoption will be considered at the October 10 Board business meeting.
4. Before the Board was a Public Hearing on an Appeal of the Hearings
Officer's Denial of a Tentative Plat Application for a Residential
Subdivision off 5th Street, Redmond (Applicant. Rencher).
Laurie Craghead stated that there have been changes to the application so this
will be addressed at a future date. Dee Van Donselaar said that a hearing was
not noticed. The planned date at this point is October 22. Ms. Craghead added
that the clock has started over as of the new submission.
5. Addition to the Agenda.
Before the Board was a Work Session regarding Ordinance 2007-023,
Expanding the Bend Urban Growth Boundary to Accommodate a School
Site.
Anthony Raguine explained that this involves eighteen acres to be used for a
future school site. There was a public hearing before the Hearings Officer and
she found the requirements for a UGB expansion have been met. The area is
part of the old Bend Pine Nursery site. The City Council had its first reading on
September 19, with the second reading planned for October 3 and adoption, by
emergency, at that time.

Laurie Craghead stated that the Board is obligated to approve this change, and
ex parte contact is not allowed since it is a quasi judicial matter.
Commissioner Luke asked about the additional westside site; Mr. Raguine said
they are waiting for a lot line adjustment. Commissioner Luke asked if
infrastructure changes are needed at the Bend Pine Nursery site; Mr. Raguine
stated that there is nothing needed in the way of roads, per George Kolb of the
Road Department. There is no site plan developed yet; traffic impacts will be
addressed when the park is planned. The City and other agencies will be
required to make necessary improvements; the County has already negotiated
with the City on the amount to be contributed by the County.
Commissioners Luke and Baney asked if the City's UGB is going to be
annexed in a piecemeal fashion. Mr. Morrow said that the Board needs to
decide if this is an appropriate track. There may be cases where this is a good
idea, such as adding a school site or affordable housing. The larger need should
consider the entire scope and address the particular need. The Board has the
ability to call them up or take no action since the action would be legislative in
nature.
Commissioner Baney asked if the Board should meet with the City Council and
establish how this type of issue should be addressed. Ms. Morrow replied that
she has been trying to get answers from them on this issue, and as of this date
has not been able to do so. The approval of both jurisdictions is needed to make
this type of change.
Commissioner Luke said that in the future that if any UGB amendments are to
be considered, he would like to know when one goes before the Hearings
Officer.
Ms. Morrow said that Habitat for Humanity is also applying; she will keep the
Board posted.
Ms. Craghead stated that whenever there is a comprehensive plan amendment
proposed, there is no 180 day clock and the Board can call it up if desired. It
has to be called up within the twelve days, but then can be delayed after that
point.
Being no further items to come before the Board, Chair Daly adjourned the
meeting at 10:45 a.m.
