2008-635-Order No. 2008-052 Recorded 6/17/2008REVIEW DESCHUTES COUNTY OFFICIAL COUNTY CLERKDS ~d ZQV~-635 COMMISSIONERS' JOURNAL LEGAL COUNSE1111111 111111 06I11I2008 11;05;29 AM IIIIIIIIIIIIIIIIII 2008-635 BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Declaring Intent to Form Bend Area Transportation District and Setting a Hearing ORDER NO. 2008-052 Date WHEREAS, ORS 267.010 to 267.390 authorizes the formation of a mass transit district to provide public transportation and terminal facilities for public transportation including aspects thereof transferred to the district by the City of Bend; and, WHEREAS, ORS 198.835 authorizes the Board of County Commissioners ("Board") to initiate the formation of a transportation district located entirely within Deschutes County, Oregon by order of the Board; and, WHEREAS, the City of Bend ("City") by Resolution No. 2690, dated May 7, 2008, attached and incorporated herein, requested the formation of a transit district in order to provide a mechanism to fund public transportation within the Bend area; and, WHEREAS, the Board finds that there is a need for a mass transit system within the Bend area and it is in the public interest to initiate the formation of the district for the area legally described in Exhibit "A" and depicted on the map marked Exhibit "B," both exhibits being attached hereto and by this reference incorporated herein; and, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, ORDERS as follows: Section 1. The Board hereby declares its intention to initiate the formation of a mass transit district pursuant to ORS 267.010 et seq. for the Bend area. Section 2. The name of the proposed district shall be the Bend Area Transportation District and the boundaries shall be substantially as legally described in Exhibit "A" and depicted on the map Exhibit "B," both exhibits being attached hereto and by this reference incorporated herein. Section 4. The proposed Bend Area Transportation District, if formed, will have a permanent rate limit for operating taxes of $.393 per $1,000 assessed value that will raise an estimated $ 2.8 MILLION in operating funds for the District in the 2009-2010 fiscal year. Section 5. The Bend Area Transportation District shall be authorized to take all necessary and proper steps to plan, establish, furnish and maintain a mass transit system within the Bend area and to construct, maintain and operate any related facilities pursuant to ORS 267.010 et seq. Section 6 That an initial hearing regarding formation of the service district shall be held at 10:00 a.m. on Wednesday, July 21, 2008 in the Deschutes County Board Hearing Room, 1300 NW Wall St., (First Floor), Bend, Deschutes County, Oregon. Page 1 of 2 - ORDER NO. 2008-052 (06/11/08) Section 7 Notice of Hearing shall be given in substantially the form set forth in Exhibit "C," attached hereto and by this reference incorporated herein. The recording secretary shall cause the notice to be published in The Bulletin on July 6, 2008 and July 16, 2008, and posted on July 6, 2008, in three public locations within the county as follows: One notice shall be posted on or near the doors of the meeting room of the Board of County Commissioners; one notice upon any official bulletin board customarily used for the purpose of posting public notices within the county; and one notice shall be posted upon any official public bulletin board customarily used for the purpose of posting public notices within the proposed district. Notices posted shall be for not less than five (5) consecutive days. Section 8 The Director of the Deschutes County Community Development Department shall cause to be filed with this Board prior to July 21, 2008, a land use compatibility statement regarding this proposed special district formation as contemplated in ORS 197.175 and 199.462, and any other applicable statutory authority. DALY, COMWSSIONER Page 2 of 2 - ORDER NO. 2008-052 (06/11/08) RESOLUTION NO. 2690 A RESOLUTION PETITIONING THE DESCHUTES COUNTY BOARD OF COMMISSIONERS TO PLACE THE QUESTION OF FORMATION OF A TRANSIT DISTRICT ON THE NOVEMBER, 2008 GENERAL ELECTION BALLOT, TOGETHER WITH THE QUESTION OF A PERMANENT TAX RATE FOR SAID DISTRICT ' The Bend City Council hereby makes the following legislative findings: WHEREAS, In September of 2006, the City of Bend initiated a pilot program to change its public transit system from general public Dial-a-Ride to a fixed route transit system and an eligibility based Dial-a-Ride program for those with disabilities and low-income seniors. The purpose of the pilot project was to determine whether a fixed route transit system was a viable, more cost effective, and needed resource for those traveling in and around Bend; and WHEREAS, the pilot program has resulted in an increase of over 238,000 rides annually with the same bus hours. A delivery of over 342,996 rides in 2006/07 resulting in greater access to work, shopping, medical services, and recreational opportunities for Bend residents and visitors; and, WHEREAS, Bend is becoming a university community, and it is difficult to operate a university town without fixed route transit for the students and faculty. Fixed route transit is also needed for Bend's growing medical community. The hospital and surrounding medical complexes are a major future economic engine, and senior citizens and convalescent hospitals generate transit riders from both patrons and workers. Further, higher densities are appearing around 27th street. Money magazine named Bend the place to retire if you are into "green and clean," indicating that the senior citizen population, which tends to utilize transit systems, will grow. Bend's NE Industrial area is becoming an employment center as is downtown and the Old Mill District and access to these economically charged location by residents and visitors is essential in their continued success. Transit is also an essential component of transportation alternatives to the single occupancy vehicle offered by my most urban areas. to encourage liveability and sustainability; and, WHEREAS, The Bend City Council initiated the pilot transit service knowing that a substantial financing system would be necessary if the pilot program were to be successful and implemented on a permanent basis; and, WHEREAS, Creating a Transit District with a permanent levy would significantly improve many growing public finance problems. A permanent levy to support fixed route public transit would encourage those operating the transit system to seek capital investments in a transit fleet and support transit oriented facilities. A permanent levy will also restore lost services due to budget reductions, add service area, routes, hours of service, and build capacity in the Dial-a-Ride program for our growing senior and/or disabled population; and, WHEREAS, the City's general fund budget is primarily needed for other traditional municipal services, such as public safety and street maintenance. The Oregon model for transit operations is a transportation district, with the ability to expand to serve regional transportation needs as mandated by the public and focus on public transportation related policy, planning, and service delivery. Further, creation of a transportation district with a separate funding base would enhance police and fire protection in Bend by making more ' general funds available to public safety and road maintenance. WHEREAS, Comparable cities and transportation districts have transportation levies as follows (expressed in cents per thousand dollars of assessed value): • Tillamook County Transportation District .20 • Rogue Valley Transit District (Medford, Ashland) .18 • Basin Transit Services (Klamath) .38 • Salem Area Transit (Salem) .79 Resolution 2690 Page 1 of 16 WHEREAS, For the proposed transportation district, a levy of $.393 per.thousand dollars of assessed value in the current fiscal year could generate approximately $2.8 million to fund the fixed route transit system. Coupled with Federal and State assistance as well as fare box revenues and contract revenues, new funds can become available for limited new fixed route service. WHEREAS, A fixed route transit system would help alleviate parking problems in downtown Bend, since some employees and shoppers would not need to drive their automobiles downtown, the city's medical campus and other shopping facilities. Transit use also promotes cleaner air with reduction of particulate matter, and a healthier lifestyle as most transit users are also pedestrians. WHEREAS, residents living within the boundaries of Deschutes River Woods share the need for a reliable transportation alternative and a fixed route transit system serving the area would be an asset to residents and visitors of the Deschutes River Woods area and Bend employers; and, THE CITY COUNCIL DOES RESOLVE AS FOLLOWS: SECTION ONE. That the City of Bend hereby petitions the Deschutes County Board of Commissioners to call an election on formation of a transit district as described in the legislative findings above, together with the question of a permanent tax rate for the district in the amount of $.393 per thousand dollars of assessed value. . SECTION TWO. The Bend City Council petitions the Deschutes County Board of Commissioners to put the question to the voters at the November, 2008 general election. SECTION THREE. The City of Bend requests that the Deschutes County Board of Commissioners take all such necessary and further action as is needed to establish a ' transit district on the terms and conditions as set forth in the legislative findings above. The boundaries of the proposed district are as specified in Exhibit A, attached hereto and by this reference incorporated herein.
