Luke, Michael M. Daly and Tammy Melton. Also present were Dave Kanner, County Administrator; Deputy County Administrator Erik Kropp; via conference call, Laurie Craghead, Legal Counsel; Anthony Raguine, Community Development; a media representative of KOHD TV and approximately twenty other citizens. Chair Luke opened the meeting at 10: 00 a.m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was Consideration of Approval of the Release of the Tetherow Phase III Performance Bond and Acceptance of the Maintenance Bond. Anthony Raguine gave an overview of the item. The maintenance bond would take the place of the performance bond, and staff believes the amount is enough to cover the cost of infrastructure improvements. MELTON: Move approval. DALY: Second. Before the Board was a Public Hearing (continued from August 13 and 18) and Consideration of Signature of Order No. 2008-076, Forming the Bend Area Transportation District and Placing a Measure on the November 4, 2008 Ballot. Patti Stell of the City of Bend came before the Board. Commissioner Melton asked her to advise as to how the meeting with Deschutes River Woods (DRW) residents went. Ms. Stell said there was a communications misunderstanding regarding last week's Board business meeting so she missed it. She said there was a successful meeting at Deschutes River Woods. Over 2,600 postcards were mailed out notifying residents, and 34 people participated, which is about what is expected of such a meeting. This provided an opportunity to speak to folks about the goal of the meeting, which was to allow an opportunity to gain information on this issue. It was hoped to have a panel of pro and con citizens to tease out additional questions people might have. However, there were not enough participants to instead cards were handed out for individuals to complete with their questions. One question was who can vote on the District, whether it would be just Deschutes River Woods or the entire County. Another question was whether this would affect Dial a Ride service. Ms. Stell said that the Dial a Ride pilot program has already expired; the new program would be different. Information was provided in a respectful manner. When the meeting concluded, citizens were free to discuss the issue with staff. There was also a spreadsheet and tax calculator showing the differences between market and assessed values. Some people felt they'd be paying much more than they would be when based on assessed value. Laurie Craghead said that there was a new legal description and maps provided to the City last week. The Department of Revenue has done three preliminary reviews but has not reviewed the latest version; it will be done this week. It would be helpful if the legal and description could be approved today so they can be submitted to the Clerk for a ballot title number. September 3 is the latest possible date for any changes. Minutes of Board of Commissioners' Business Meeting Monday, August 25, 2008 Page 2 of 9 Pages The City Council already approved this in a resolution last week, and this will be attached to the Order. Ms. Stell stated that they received a preliminary response from the Department of Revenue. There are small areas that need to be adjusted but don't need to be filed with them until later. The minor technicalities can be modified after the general question has gone before the voters. Ms. Stell said that there were encouraging comments from attendees at the meeting regarding the District. Ms. Craghead added that the Board cannot exclude Deschutes River Woods unless there are findings that indicate it cannot be served, regardless of whether residents are supportive. At this time citizens came before the Board. Christy Svendsen works at CORIL, which serves people with disabilities. She read a statement at this time. She concluded that this is the right thing to do, to let the people make the choice. Frank Pennock and Jackie Pennock, representing DRW on this issue, said they have made themselves available to be contacted by anyone who has concerns, and have only received two calls, both in favor and one wanting to help out with mailings. Jackie Pennock stated that they had asked for the minutes of the August 14 meeting. Apparently there were no formal minutes taken, but she collected some notes and the agenda from people who were there. She submitted those to the Board. Ms. Pennock commented that the agenda has numbered items and the notes and comments are correlated to those numbers. Numbers 6, 7 and 8 were skipped. No one spoke up to present the opposing view so neither was done. She encouraged the Board to sign the Order and give the voters an opportunity to vote. There are people who are disabled and elderly who need the service, and some students need to use the bus as well. People will have a chance to voice their opinion. There is a website with information available and they can call her or her husband anytime to discuss the issue. Minutes of Board of Commissioners' Business Meeting Monday, August 25, 2008 Page 3 of 9 Pages Mike Schmidt, co chair with Frank Pennock, thanked City for the work they did in simplifying the ballot language issues. He reminded the Board that it is important for people with disabilities. It is a social justice issue for those who need to get to work or school. Realtors say this is a question they get all the time. It is important to DRW residents, especially Dial a Ride. Tourists also want to have an alternative to driving a car. It is also important to the environment; an alternative to putting cars on the road. Neighborhoods are the biggest impact, and this would give people an opportunity to go to appointments, school and other places. Economically it is important, as most businesses want to know that this is available. He said a source of information is www.citizensforbendareatransit.org. The cost per household would be maybe $35 for DRW and $50 for other areas. Businesses, the city, county and others benefit as well. Earl Williams of Bend stated there are many reasons to save BAT. Much of it concerns the disabled. Dial a Ride is not mandated; however, if there is transit, services need to be available for everyone. Fixed routes need to be established and maintained. Bend's non-mandatory Dial a Ride came about only after United Senior Citizens of Bend pushed for it. It is impossible to overemphasize that anyone could become dependent on this at any time. A major reason to save BAT is to keep Dial a Ride. Patriotism and supporting the troops is part of it. All troops, unless killed, become veterans, some of whom have become disabled by their patriotic sacrifices. Actions speak louder than words. Instead of displaying yellow ribbons, he wants to see transit saved to help veterans and the elderly, and to show real patriotism. Judy Martineau, President of Deschutes River Woods Homeowners Association said she did a survey, and out of 110 surveyed, only 17 voted yes. The City had said that most people wanted transit, but only 15 in their survey were from DRW. The 17 people who want it were families or mature adults. Families use it to send kids to town to keep them out of trouble. Others are people who live on unimproved roads. There is a lack of information on bus stops, routes, the schedule and other things. She said she did not think the meeting was a fair process. She questions the assessed valuation part, and feels that the numbers are not right. A legal finding cannot be made just on the basis that some people may not want it on the ballot. Commissioner Luke pointed out that the transit board that is eventually selected will decide on where the routes will be and so on. Stan Martineau said that the July 21 minutes state that the majority was for it, but they were not. There were 45 attendees at the August 14 meeting with the City, and most of them did not want a bus system. Most questions could not be answered until the measure passed. Commissioner Luke stated that the Board's vote is whether they support the system. All they could ask is for the City to hold a meeting and provide information. DRW cannot be pulled out at this point as there is no finding to support that. He believes in letting the voters decide for themselves. Carvie Burge asked if it is illegal for an official to misstate facts in a public meeting. Commissioner Luke said that everyone does their best to give accurate information. Citizens should do likewise. Mr. Burge said that he called Patti Stell when he received the notice on Wednesday. He wanted to be the "con" speaker, and told the Pennocks that. He didn't get information ahead of time so didn't attend. He stated that people with post office boxes did not get notified, nor did renters. Ms. Craghead said that the notice would have been sent to registered voters, who could be owners or renters. Mr. Burge stated that he disagrees with the dollar figures that were given regarding assessed valuation and the cost per mile for service. It is just for special interest groups. He wants to see just Dial a Ride and not the scheduled routes. The needs of the many need to be considered, not the special interest groups. This is a waste of tax dollars. He added that the last meeting it was said that it was on the ballot twice and was voted down. Commissioner Luke replied that DRW was not involved at that time. Many years ago Resort Bus Lines had a contract to run between La Pine and Redmond, and he used a monthly pass to get to work. Since he has lived in Bend he has been advocating for improving transportation. He would use it now if it was close to where he lives. The first two ballot measures were improperly worded and people thought it was only going to be funded through taxes. However, State and Federal funds can be used. More infrastructure is in place now. He would like to see a tri-county transportation district sometime before he dies. Regarding DRW, if a house is assessed at $200,000, they should not be bothered by an $80 tax increase. He supports 911, transportation and other things that affect the quality of life. Everyone needs to contribute to the community and be proud of it. He notices more and more people using the bus. There is another segment of society that no one thinks about, people with suspended drivers licenses. Along with those who can't drive or are disabled, that makes up a lot of people. Adding this later will cost a lot more money. This has been discussed for a long time, and people should have expressed their opinions by now. Some are concerned about a bus stop in winter. People can adopt a mailbox, adopt a bus stop, and keep it shoveled out. It's a contribution to the community. There have been complaints that DRW is outnumbered. If people don't want city services, they should move out to Millican or Joseph. Nancy Stevens moved here three months ago. She visited here in the past with a disabled cross-country team, but could not move here until now because there was no transportation. People should also consider the impact on the environment if everyone drives. When she runs errands, she does not call Dial a Ride; she uses BAT. This is not possible with Dial a Ride. You have to plan when to use the bus, but using the bus in conjunction with Dial a Ride gives you options. If you don't call three or four days in advance for Dial a Ride, it is nearly impossible to get a ride. It is a needed service, but so is the fixed route system. She likes the freedom and flexibility of using it. She may be part of a special interest group but if someone doesn't have access to a car, they would be one, too. Minutes of Board of Commissioners' Business Meeting Monday, August 25, 2008 Page 6 of 9 Pages She wanted people to know that if the fixed route system goes away, there is no mandate to keep Dial a Ride going. This would cause isolation and a variety of problems. She moved here because Bend has both. The would love to talk with DRW folks so they know what a typical day is for those who need these services. She may even be able to go out to dinner in the evening, which she cannot do now. People should try to get around in this way to see how hard it is. Commissioner Daly said that he spent a day in downtown Bend in a wheelchair, and it opened his eyes a lot. It is not simple or easy being disabled here. Tom Filcich stated that in all the talk about special interest groups, there doesn't seem to be anyone in a suit who says they use it. He never sees professional people using the bus. More needs to be done for the handicapped and challenged. Dial a Ride does that better. He suggested that a voucher system be started so people can call a cab. This will save millions of dollars. He does not think Bend is in a position to be a big city, and is caught up with special interests. And people who are visiting the area don't use the bus. Nicki Pistacchio said that she did community outreach and marketing for transit for twenty-two months. There are some of the special interests she encountered: a lady shopping for a house asked about routes, as her teen wanted to attend a different school. This shows how people are beginning to think about transit. She was in Safeway with her BAT hat on, and the clerk told her that she loves having the bus, her daughter with a four-year-old has to rely on it due to epilepsy. A worker at Izzy's said she takes BAT to go to work, but sometimes can't make the last bus. Then she has to walk home a long way. She wants to see later hours. Seniors from the Senior Center use it to take field trips, and some ride the bus every day. Her grandson is looking for work in places that the bus serves. She could give examples all day long. Not everyone can, should or wants to drive a car. These should not be considered special interest. Jordan Olde said he is currently a BAT rider (he was in a wheelchair). He does not consider disabled people as special interest; they are just part of the community. If there is no bus service, he would be forced to quit the job he has had for seven years. He wants to make people more aware of the need for transit. There are many people who can't get into town any other way. Commissioner Luke asked if federal dollars could allow for Dial a Ride in the entire district. Ms. Stell replied that the goal is to have both in all districts. Because DRW is rural by nature, the district would qualify for additional funds just for that area. There may be additional State and Federal funding options. Commissioner Daly stated that he is not one to hold up progress, and this needs to happen. It's the American way for people to be able to vote on this. Commissioner Melton said that it is mildly frustrating to be involved in something that you may not support fully, but there are no findings to exclude DRW at this point. This is government in action, the voice of the citizen is important, and will be heard through voting. This will affect her as well even though there is no stop near where she lives, but she will vote and others should, too. Commissioner Luke stated that he is a great believer in letting people decide how to be governed. The City realizes they should have gone to DRW with educational information much sooner. He is involved in the Oregon Transportation Committee, which talks about needed road improvements but there is no money for it. Ways should be available to keep traffic off the highways, and transit is one of them. Transit is subsidized no matter where you are. But this needs to be on the ballot. MELTON: Move signature. Voters in the urban growth boundary of Bend and the area of Deschutes River Woods are asked to consider creating a Transportation District and a permanent property tax rate of $0.393/$1,000 taxable assessed value (TAV). • What will BAT change if the measure passes? The measure would create a stable funding source for public transportation services. The proposed budget for the District would allow for extended hours of fixed route and dial-a-ride service. The changes would go through a public review process and the Transit Board of Directors. • Would property tax fund all operations? No. The district would be eligible to continue pursuing federal and state grant opportunities as the City has done. • How much will it cost taxpayers? Taxable Assessed Value (TAV)* Approximate additional annual property taxes $179,000 $ 70 $250,000 $100 $400,000 $160 *TAV is 43% of the homes market value. • Who runs the District? If a Transportation District is approved the Deschutes County Commission will appoint temporary board members to the Transportation District Board of Directors. In the May 2009 election, voters will be asked to vote on an elected board, just like the Bend Metropolitan Parks District and the Bend School District. • Would a new Transit District be part of the city or county government? No. It is a separate governing board just like the Bend Metropolitan Parks District and the Bend School District. • If the measure passes, when would the District start to get the funding? The District would begin to "earn" tax funding starting July 1, 2009. The funding would then be received by December 2009. • How would the District operate if they don't get money from taxes until December 2009? The district may apply for a tax anticipation loan, a short term loan product available through the Special Districts Association of Oregon. bend area transit FACT SHEET 2008 }7~}~ g Vtll~ O 5. • What is Bend Area Transit (BAT)? Bend Area Transit consists of two transit services: 1. Fixed Route - 7 bus lines with 168 routine stops; 10 buses 2. Dial-a-Ride (DAR) - Door-to-door transportation services for eligible riders. Eligibility means that the service is only for people with disabilities and e seniors; buses 3. Ride the River (seasonal) - One bus line with 4 stops (privately funded through sponsors) • Why did the City of Bend start BAT? As a result of quickly expanding population and higher expectations for services, the City created a fixed route system in September 2006 for the general public. As a result of implementing a fixed route system, general ridership has increased by 91 • Why are some buses more full than others? There are peak ride times and locations. If you add all the riders on the fixed routes and divide by the total hours of bus time you get an average of rides per service hour. The fixed route delivered an average of 18.31 rides per service hour and dial-a-ride delivered an average of 3.08 rides per service hour in 2007. • What is the current BAT budget, and where does the funding come from? The adopted 2008/2009 Transit budget is $3,093,400 - including $500,000 for equipment. Here is a breakdown of BAT funding: • 48% Federal and State grants ($1,475,000) • 46% City's General Fund ($1,425,000) • 6% Rider fares ($191,900) • Why can't this service pay for itself? Public transit systems nationwide do not pay for themselves with fares alone. They are subsidized by federal and state grants which require matching funds from the local jurisdiction. • Why do people ride BAT? Notification postcards were sent out to the 2600 registered voters in DRW (precinct 42) on Monday, August 11 and the meeting was held at 6 PM on Thursday, August 14, 2008 at the Morningstar Christian School on Baker Rd (behind the Riverwoods Country Store). 34 residents showed up for that meeting. Patty Stell welcomed the attendees and presided over much of the evening's meeting., 2. repeated the purpose of the meeting: " To provide residents of DRW with an opportunity to gain information on the proposed Transportation District to be voted on by citizens living in the City of Bend and Deschutes River Woods. 3. June Haines, using the Fact Sheet and the Tax Calculator, helped those who wished to figure out what their tax would be. 4. Heather Omelas was very straghtforward in her summation of the facts. There were about twenty questions from the attendees, not too harshly worded, and she fielded them very well. Of course, there were multiple comments about lack of public notice, which was countered by reminding them about all the public hearings, newspaper articles, etc. June had worked all day on her report of how the `Future of Transit' Committee decided to include DRW in the district, and it was a very light presentation. She closed by telling the attendees that it wasn't the city who made the decision to include DRW, but was the FTC. 5. Heather O. provided all the factual information regarding the proposal. The attendees (34 in number) semed satisfied. There was no formal opposition. AND THE EXPEC- TED NEGATIVITY DID NOT APPEAR!. The team (Patty, June, and Heather) did a good job of presenting all the facts or those facts, along with June's presentation, neutralizrd the naysayers. 6.,. 7. and 8. were fikipped. Nicki Pistacchio was asked to present the "pro" side and the DRW's Homeowners Association was asked to present an opposing view. No one spoke up to present the opposing view, and it didn't seem fair to present the "pro." 9. Patty Stell passed out indep(cards for the attendees to write out their questions. Patty presented the questions, and answers were handled by Heather. 10. More questions were handled after the meeting adjourned. And June Haines manned the Tax Calculator.
