DESCHUTES COUNTY BOARD OF COMMISSIONERS
WEDNESDAY, OCTOBER 8, 2008
Present were Commissioners Dennis R. Luke, Michael M. Daly and Tammy
Melton. Also present were Dave Kanner, County Administrator; Erik Kropp,
Deputy County Administrator; Mark Pilliod, Legal Counsel; Judith Ure,
Administration;; Anna Johnson, Communications; media representative Hillary
Borrud of The Bulletin and a reporter from a local TV station; and four other
citizens.
Chair Luke opened the meeting at 1:30 p.m.
Discussion of Letter of Support to State Land Board regarding the South
Redmond Land Trade.
Commissioner Daly stated that he is attending a meeting on October 14 at the
Division of State Lands to provide County input regarding a potential south
Redmond land trade. The process is lengthy and a letter from the Board
encouraging State involvement is advisable.
DALY: Move approval of the letter.

The Commissioners reviewed an Order resulting from the morning business
meeting in regard to the Board's decision to hear, de novo, an appeal on

In regard to a letter from ODOT that the attorney for Central Cascades Lines
indicated he would have available by now, the attorney has indicated that the
letter is not yet in his hands. Commissioner Daly stated that a letter from
ODOT would likely be received tomorrow from ODOT indicating that they do
not support funding CCL at this time.
Commissioner Daly added that it is likely that the agreement between the
County and ODOT to handle pass-through funds would be terminated as well,
since the County has been acting only as the pass-through agency, and the
situation is becoming awkward to manage.
Commissioner Luke stated that COIC needs a decision as they are funding
interim bus service now through other sources and have to know where they
stand in regard to receiving future ODOT funds.
He added that the attorney for CCL has misinterpreted information from ODOT
and, per ODOT, there will be no letter of support from ODOT to continue
funding CCL at this time.
Judith Ure said that there is a process to terminate an agreement with ODOT,
usually requiring a thirty-day notice.
DALY: Move that staff work with ODOT to terminate the existing
agreements.
LUKE: Second. There should be something drafted for both parties to sign.

Mr. Kanner stated that the outstanding STF formula grant money is still an
issue. Commissioner Baney asked about reopening the RFP process.
Commissioner Luke would like to see a recommendation from the advisory
committee on how this would be handled. Ms. Ure stated that this process
could take a month.

Mr. Pilliod added that the dollar amount is low enough that a full RFP process
is not necessary. Ms. Ure will contact the members to get an idea of how these
funds should be handled, and bring back a recommendation to the Board.

LaPine Transportation Services
Dear Board of Commissioners-I realize that this transportation issue is a difficult one
and we are trying to do all we can to support you. We have stepped up to provide the
Bend-LaPine service at your request so that service would not be interrupted. I think as
you move toward making a decision about this situation, there are some important facts
missing in the discussion.
Prior to January 1, 2008 COCOA (Central Oregon Council on Aging) was providing Dial-A-
Rides services to the senior and disabled population of LaPine. They were also doing one
round trip a week to Bend to serve that same populations need to get to Bend.
On January 1, 2008, COIC took over that service and in April expanded the service to allow
the general public to ride. COIC stopped doing the once a week service to Bend because
Central Cascade Lines was performing that service and we thought that coordinating with
them (we provide the local service-they provide the service to Bend) would be the right
thing to do to support their efforts as a service, and make the best use of public
funding.
Over the approximately 4 months that we tried to refer riders to their service, they were
often unable to transport the senior and disabled riders that we tried to refer to their
service, saying that they had other rides, did not have a wheelchair bus available, etc.
In August, when CCL gave notice that they were terminating their service, they then
announced that they were only continuing service to seniors and persons with disabilities.
This is the first I heard that they were providing service to seniors and persons with
disabilities, other than the rides we referred to them. It had been my understanding that
their service provision was trips to Bend primarily for commuters.
It should be noted that we have provided approximately 600 rides per month in LaPine
mostly to the senior and disabled population, since January. The public ridership is
growing but continues to be a small percent of the ridership, as is true in Bend and
across the region.
I know that the STF funds are portrayed to have less strings than the JARC and capital
funds coming from ODOT, but I do have a concern that you are still considering releasing
the STF monies for LaPine to CCL.
As reservation based systems, we as providers keep a database of our rides and riders. I
would recommend that you request from them proof that they are actually serving the senior
and disabled population with the Counties STF monies prior to awarding the money. I know
that they do one round trip to Bend per day taking clients from LaPine to CORIL.
However, CORIL has applied and receives STF monies from the County directly for that
population so CCL should not get to count those too.
Otherwise, STF is paying for that transportation twice.
The ODOT funds seem a little clearer in that CCL has been determined not to be eligible to
receive federal funds. Part of the receipt of those funds I would assume requires signing
an assurance that they can meet all of the requirements, which the review concluded they
cannot.
It seems that the County could in light of this information, turn the money back to ODOT
with a recommendation that the monies be used in Deschutes County, and let ODOT determine
the best use.
It is important to note that Deschutes County allocated $52,604 in STF to COIL who
supplied 3,083 rides to Redmond and Sisters last month and
638 rides to LaPine. Deschutes County has set aside $36,345 in STF to additionally serve
riders of LaPine. Clearly, based on population and service this is a huge amount being
directed at LaPine.

COIC has worked hard to secure funding from a variety of sources so that each local
government can dedicate a funding to public transportation but not feel the total burden
of keeping public transportation viable. It is important that these limited dollars
available for transportation are best spent.
I do feel that if the Board continues to hold funding on behalf of LaPine with the intent
to award to CCL that I should stop providing the service. The service is above what I had
budgeted for and the longer I provide this service without funding the more I compromise
the rest of the service provision for the Region. I am trying to be a good partner and
meet the needs of needs of my member governments but my accountability to the Regional
system has to take priority soon. I do have a concern about the hole we will leave if we
discontinue service.
Obviously, I respect and will support the decision that you make. I know that you are
trying to do the best thing for LaPine. COIL is committed to providing quality public
transportation services, while safeguarding public funds & coordinating to the maximum
extent possible with other providers.
