Luke, Michael M. Daly and Tammy Baney. Also present was Dave Kanner, County Administrator; Erik Kropp, Deputy County Administrator; Laurie Craghead, Legal Counsel; Kevin Harrison and Paul Blikstad, Community Development; David Inbody, Assistant to the Administrator; and two citizens. No representatives of the media were present. Chair Luke opened the meeting at 1: 30 p.m. 1. Before the Board was Discussion of an Appeal of the Hearings Officer's Decision regarding an Application for a Conditional Use Permit for Surface Mining Activities (Johnson Road; Applicant: Latham Excavation). This item was continued from the morning Board business meeting Paul Blikstad gave an overview of the item. Commissioner Luke asked about the timeline. Bruce White said that the clock could be extended if the time is reasonable. Mr. Blikstad said that a de novo hearing might be impossible to hold prior to the end of the year. Ms. Craghead stated that deliberations would have to occur in early December for findings can be drafted before the end of the year. Mr. White indicated that a decision by the end of February would be acceptable. The Board reviewed an oversized aerial photograph of the subject area. The application would expand the amount of mining being done. It is already zoned for this use. An argument has been made that a study of Economic, Social, Environmental and Energy (ESEE) impacts is necessary for this expansion. Staff feels that the interpretation of the ESEE was to include crushing on site. The Hearings Officer found that noise sensitive uses relate to all areas of a property. Staff does not agree, since the property is zoned for this type of use. Minutes of Administrative Work Session Monday, November 10, 2008 Page 1 of 4 Pages Mr. Blikstad said there were issues as to where rock crushing would be allowed. Several sites could be buffered by stockpiles of material. The Hearings Officer limited crushing to one of three sites that the applicant wanted approved. The other big issue is the amount of screening necessary to expand the mining operation. State Parks commented that the headwall would be visible from some of the trails in the State park. Mr. Blikstad said that he walked the trails and a headwall could be seen from one small point on a trail. Other mining operations are visible from the trails. Commissioner Luke said this mining site was approved years ago, and asked why this does not apply. Ms. Craghead replied that they want to do more excavation. The issue is whether the original decision included all of the area and whether the ESEE applies to the entire site. Mr. Blikstad referred to an oversized site plan. Ms. Craghead said that she is not sure what additional information could be provided as it appears complete. The appellant states that they did not have adequate time to provide evidence. Commissioner Baney does not want to be limited by an on the record hearing. Commissioner Luke said that if there are questions that are not already in the record, that information could not be included. Mr. Blikstad stated that the public feels like there is more of a sense of participation if the public can testify. Commissioner Daly pointed out that the new Commissioner has had years of experience on the Planning Commission and also as Mayor of Redmond. BANEY: Move that this be heard de novo as long as the applicant will extend the clock for a decision no later than the end of February 2009. DALY: Yes. VOTE: BANEY: Yes. DALY: Yes. LUKE: Chair votes yes. 2. Discussion of Leasing County-owned Property to Non-County Entities. Susan Ross stated that this is similar to the facilities use policy. There are many requests to use County facilities. The rule has been to allow nonprofits to lease facilities if they provide services that the County may be providing otherwise. This can be broadly interpreted. Minutes of Administrative Work Session Monday, November 10, 2008 Page 2 of 4 Pages Commissioner Luke asked about the exclusion of wireless facilities. Ms. Ross stated that these structures have been allowed on a negotiated basis. A company has requested a tower be installed near the County landfill. There are buffer properties that might be suitable for this purpose. Ms. Ross feels that allowing one entity to do this would open a door for others. The Commissioners feel that these requests should be addressed on a case-by-case basis. There needs to be a benefit to the County, either by combined use or by revenue generated. Dave Kanner stated that it was felt that this should be policy and not in Code. 3. Continued Discussion of Ordinance No. 2008-026, regarding Code Violations and Enforcement. Ms. Craghead gave an overview of the proposed Ordinance. Commissioner Daly asked why the property owner would be responsible for others using his or her property. Ms. Craghead said it is not clear in current Code but the owner is ultimately responsible for how the property is being used. It takes three citations before the County can go any further. 4. Economic Development Grant Requests. • Central Oregon Boxing Club - defray rental costs of the use of the Fairgrounds - Commissioner Luke granted $500; Commissioner Daly granted $2,300. Mr. Kanner said that the Redmond Education Foundation asked if the grant funds granted to them should be returned since the event was canceled due to inadequate ticket sales. Commissioner Luke asked if Mr. Kanner could find out if the funds would go into another educational fund. 5. Update of Commissioners' Meetings and Schedules. Commissioner Baney is in Salem on Friday to attend "Toward One Oregon" program. She is moderating a panel for AOC as well. Interest would be zero percent for the first six years; after that point it will be at 3.6% Commissioner Luke would like the addition of a clause that indicates if they sell the entity, the County will be paid off. Ms. Ross stated that there would be a due on sale clause. The Board acknowledged the death of Bill Friedman, a long-time resident, former Mayor of Bend and a member of the City Council of Bend. Commissioner Daly said that LCDC has indicated the County needs to update the master plan for the Fairgrounds, to include the adjacent property that could be brought in to the urban growth boundary. 7. Executive Session, called under ORS 192.660(2)(h), pending or threatened litigation; and ORS 192.660(2)(e), real property negotiations. At this time, the Board went into executive session. It has been our practice not to lease to these companies. We also receive requests from groups who wish to lease space at county- owned buildings. It has been our practice to lease office space to nonprofit organizations that serve clients who would be served by the County. We recommend that the Board consider the following guidelines that would clarify to whom the County leases and on what general terms: Leases for Communication Facilities It is the policy of Deschutes County that the primary and priority use of county facilities is for county and/or government-associated activities. The County will consider proposals to lease land for wireless communication facilities on these conditions: o The communication equipment does not interfere with County communication systems or the operation and maintenance of the County facility where it is sited. o The lessee will sublease to other users (to minimize the number of communication sites on county-owned land). o Annual consideration will be at least six percent (6%) of the appraised value of the leased land. o Leases will be for the longest possible term--preferably twenty (20) years. Leases for Office Space It is the policy of Deschutes County that the primary and priority use of county facilities is for county and/or government-associated activities. Nonprofit organizations may lease office space in county, subject to availability, and in accordance with the provisions of this policy. The County will consider requests to lease office space to nonprofits on these conditions: o The nonprofit serves the same client base as a Deschutes County department or program, is a service that would otherwise have to be provided by Deschutes County, or is a service that benefits Deschutes County and/or its employees. o The lessee will abide by all policies and procedures governing use of County facilities. o The rental rates may be below market rate if a hardship exists or if the nonprofit provides services in kind (e.g. language interpretation, childcare). For the purpose of this policy, unless otherwise specified, the following definitions shall apply: "County facilities" means real property that is owned by Deschutes County including but not limited to buildings, facilities, or real property which is fenced, enclosed or otherwise developed and any associated grounds. Central Oregon Boxing Club was founded in 1999 under Opportunities Unlimited. It has been a member of the United State Amateur Boxing Association since 2002. These organizations teach young adults the skills needed to become healthy, productive members of the community. Through amateur boxing, they are taught self- discipline, self-esteem, teamwork, goal setting and the value of hard work. Project Name: Oregon State Golden Gloves Tournament Project Description: Central Oregon Boxing Club was awarded the Golden Gloves sub- franchise for the State of Oregon allowing them to host Golden Gloves sanctioned competitions over the next four years. This is the only organization in the State of Oregon with such a distinction. The grant funds will allow the organization to rent space at the Deschutes County Fairgrounds to host the two-day Men's Oregon State Golden Gloves Tournament. Amateur boxers will compete to represent Oregon at the regional competition. The event also serves as a fundraiser for the organization, as well as raising money for Grandma's House. Vision Statement: Opportunities Unlimited, Inc. and the Central Oregon Boxing Club are dedicated to teaching young adults the skills they need to become healthy, productive members of our Central Oregon community. Through amateur boxing we teach young adults self-discipline and self-esteem, as well as teamwork, goal setting and the value of hard work. The goal of Opportunities Unlimited and the Central Oregon Boxing Club is to help each youth stay in school and learn to respect themselves and others. The Population we serve: Opportunities Unlimited and the Central Oregon Boxing club primarily serve youth in Jefferson County, from age 8 to age 20. However, any Central Oregon youth are welcome and the sport of amateur boxing includes up to age 35. Our target population is young men and women in school, including higher education, in need of direction, support and mentorship. The Boxing Club is open year around and has as many as 23 kids training at one time. Organization History Gordon Graham founded Opportunities Unlimited, a non-profit organization, in 1998. Its primary purpose was to teach young people in the judiciary system a new way of thinking through a cognitive program called On-Solid Ground. Deschutes County and Jeldwen Corporation funded the program. In January of 1999, The Central Oregon Boxing Club was started in Bend, under Opportunities Unlimited's non-profit status. The Boxing Club has since moved to Culver, Oregon as the two volunteers for the club moved to Jefferson County and the need for youth outreach seemed high in this area of Central Oregon. The Boxing Club, a member of the United States Amateur Boxing Association, has been located in Culver since January 2002. Volunteers & Other Services Opportunities Unlimited and the Central Oregon Boxing Club primarily operate using volunteer time. Mark Evans, the head coach for the Boxing Club, volunteers and is a Level 3 certified coach and a Level 2 official. Mr. Evans is also a State Certified Alcohol & Drug Counselor and a Master Facilitator of the following Gordon Graham cognitive programs: A Framework For Breaking Barriers, On-Solid Ground and Seeds Of Success. Mr. Evans Opportunities Unlimited/Central Oregon Boxing Club 2008 works full time for the Oregon Department of Corrections as a Corrections Counselor. Mr. Evans daily uses his skills to train, teach, counsel and mentor the youth in the Central Oregon Boxing Club to prevent substance abuse, teen pregnancy and delinquent behavior. Another volunteer, Sonya Littledeer-Evans, is a Level 1 certified coach and a Level 2 certified official. Mrs. Littledeer-Evans helps with supervising youth, coaching, event promotion and Spanish translation. She works full time as a Supervisor for Jefferson County Department of Community Justice in the Juvenile Division. Mrs. Littledeer-Evans is often able to help with appropriate referrals from the Juvenile Justice System to the Central Oregon Boxing Club. For the youth of Jefferson County, Opportunities Unlimited and the Central Oregon Boxing Club serves to prevent further penetration into the justice system. Additionally, seven certified officials volunteer their time as judges and referees. Four local physicians work ringside at our local boxing shows and help ensure that each youth is fit to participate. Not for profit Tax ID number: 911735791 Opportunities Unlimited/Central Oregon Boxing Club 2008 2 Proiect Proposal Opportunities Unlimited and the Central Oregon Boxing Club were recently awarded the Golden Gloves Sub-Franchise for the State of Oregon for the next four years. This gives our organization alone the right to host sanctioned Golden Glove competitions in Oregon. If, at the end of the first four years, our organization has been successful at hosting the Oregon Golden Gloves, we are guaranteed to continue our contract for the next four years. The Lottery Funds Grant would allow us to rent space at the Deschutes County Fairgrounds for two days to host the Men's Oregon State Golden Glove Tournament. At this tournament, male boxers will be competing in amateur boxing to advance to the regional competition. Those who advance will be representing Oregon and will be sent to regional competition, held in Las Vegas, Nevada. Our tournament will draw boxing teams from Oregon, Washington, Idaho and even Northern California, Nevada, Wyoming and Montana. This year's event will be held at the Deschutes County Fairgrounds, as will the events for the next three years. Our events will bring hundreds of participants to the area where they will require hotel accommodations, travel services, and dining options in the surrounding area. These aspects of the tournament and the use of the Fairgrounds, provide direct economic benefit to Deschutes County. We anticipate approximately 500 spectators each day of the tournament; in addition there will be many boxing officials, coaches and staff in attendance - many who will be flying into the Redmond airport. Our organization will be purchasing catering services and renting chairs and tables from the Deschutes County Fairgrounds. Team Oregon will also fly out of Redmond to travel to the regional tournament in Nevada. 2009 will be our first year hosting this annual event, which will be a huge fundraiser for our non-profit organization as well as the other non-profit beneficiary; Grandma's House of Central Oregon. We have committed $5000 of the proceeds of this event to Grandma's House of Central Oregon. Additionally, proceeds from the event will also pay to send team Oregon to the regional tournament. Jerry Andres and Jeld-Wen Communities have donated the $1800 required to secure the Golden Gloves sub-franchise bid. We desperately need your assistance putting this first year's event on to ensure future events are successful and continue to bring such economic benefits to Deschutes County and Central Oregon.
