2009-37-Order No. 2009-010 Recorded 2/5/2009REVIE .D LEGAL C UNSEL DESCHUTES COUNTY OFFICIAL NANCY BLANKENSHIP, COUNTY COMMISSIONERS' JOURNAL IIIIIIIIIIII~iuiuiNiuiu RECORDS CLERK U 200W7 02/05/2009 08:18:22 AM BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON An Order Setting a Construction Speed Limit of 30 mph on Deschutes Market Road from Milepost 0.32 to Milepost 0.65 located within Deschutes County, Oregon ORDER NO. 2009-010 WHEREAS, commencing on January 5, 2009, Deschutes County started road construction on Deschutes Market Road between Milepost 0.32 to Milepost 0.65; and WHEREAS, the statutorily designated speed for the subject section of Deschutes Market Road is 55 miles per hour; and WHEREAS, the Deschutes County Road Department, pursuant to the provisions of ORS 810.180(8), has determined that the construction project constitutes a hazard to the public traveling over Deschutes Market Road and a hazard to workers working on the construction project; and WHEREAS, based upon said engineering determination of danger to the public and to workers on the construction project, the County Engineer has found that a reduced temporary designated speed of 30 miles per hour for the subject section of Deschutes Market Road during the time of the construction project is necessary to protect the safety of the pubic and workers; now, therefore, THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDERS as follows: Section 1. The designated speed for the following section of road for the duration of the subject construction project shall be as follows: Road Name: Deschutes Market Road Project Name: Deschutes Market Overcrossing Phase II Designated Speed: 30 miles per hour From: Milepost 0.32 (Deschutes Market Road/Morril Road Intersection) To: Milepost 0.65 Section 2. That the Road Department shall install appropriate signs giving notice of the temporary designated speed per ORS 810.180(8). That the signs installed pursuant to this order shall comply with the provisions of ORS 810.210 and 810.220. Section 4. That this temporary designated speed is in effect for the subject section of road for as long as travel lanes are diverted or narrowed and/or there is shoulder activity adjacent to traffic or so long as work on the construction project poses a hazard to the public and/or workers on the project, to be determined in the judgment of the County Engineer. Section 5. That this temporary designated speed shall be rescinded when traffic is restored to normal travel lane use, frequent work activity adjacent to traffic is no longer present and work on the construction project no longer poses a hazard to the public and/or workers on the project, as determined by the County Engineer. Section 6. That this Order shall be recorded with the Deschutes County Clerk, and a copy shall be filed with the Deschutes County Road Department. Ago- - DATED this day of 2009.
