Luke and Alan Unger. Also present were Dave Kanner, County Administrator; Tom Anderson and Nick Lelack, Community Development; Susan Ross and Teresa Rozic, Property & Facilities; Scott Johnson, Health and Human Services; Ken Hales, Community Corrections; David Inbody, Assistant to the Administrator; Hillary Saraceno, Commission on Children & Families; media representative Hillary Borrud of The Bulletin; and seven other citizens. Chair Baney opened the meeting at 1:32 p.m. 1. Discussion regarding BLM Land Exchange with La Pine Park & Recreation District and La Pine Sewer District. Tony DeBone of the La Pine Park & Recreation Board and the Rodeo Board gave an overview of the proposed exchange, which he believes the County will help coordinate. A preliminary concept of some of the primary uses has been developed; it will likely become multi-use after a while. (The group examined an oversized map at this time.) Commissioner Luke asked if the Bill is successful, are there any rules from the BLM or the federal government on how long the County has to hold onto the land. He also asked for an idea of projected costs to the County. David Blair of Senator Wyden's office said that it can be moved to another government entity, but the County was a strong preference of the committee and the agencies. This is not an unusual situation; often, for consistency, property is transferred via counties and cities. There was discussion about how this might affect the La Pine Sewer District. Donna Zigler said that the District has been trying to get additional land for five years. If this does not happen, they are at capacity and will not be able to take on the new school, housing, or Biogreen. A land use plan amendment would be required, and much is subject to interpretation. Tom Anderson said that he is not sure of the zoning, but feels it is likely EFU or forest. Other properties might be RR-10. He suggested that his department review proposed uses, and explain the process. Probably most significant is the wetlands areas, subject to specific uses. Commissioners Baney and Unger stated that they should get as much as possible for the community. Commissioner Luke said that he would like to be able to sell of it in the future. Having too much open space within the City limits restricts what they can do in the future. He is supportive of the County fronting the money, but eventually there will need to be a note signed and the money paid back. He would like to see about moving the land into Park and Recreation control as soon as possible. Commissioner Unger added that he supports the conveyance of this federal land to the District. As costs are known, they can work on a program to get the funds returned to the County. Teresa Rozic pointed out that one element is a cost estimate, including who does the work and to what standard. There are appraisals, conveyance documents, and perhaps more for the BLM. Commissioner Baney stated she supports the idea, but asked about including more land in the process. Commissioner Luke noted that the federal government moves slowly and it is probably best to just let the stated exchange happen and not try to include additional lands at this time. He also said that if there is a jurisdiction to transfer it to at some point, perhaps it should be the City of La Pine. 2. Discussion about Crime Prevention Services Fund Steering Committee Recommendations. Ken Hales said a recommendation has been made to the Steering Committee (which consists of District Attorney Mike Dugan, County Administrator Dave Kanner, Judge Michael Sullivan, Ken Hales of Community Corrections, Health and Human Services Director Scott Johnson, and Sheriff Larry Blanton). This sets out information on where funding is now going and where they feel it should go. Funding was originally cut, but then restored. Hillary Saraceno stated that the outcomes were shared mid-year. This started out as alternatives to incarceration, but the intent went beyond that. Mr. Johnson added that this was to address prevention in its truest sense, including recidivism. He is not sure of the impact on the Courts, but hopes to know more next week. Commissioner Luke asked why they would want to run down their reserves to do this, when perhaps they should sustain what they already have. Mr. Johnson stated that he feels that they can handle this and will be able to keep the reserves where they are required to be. Commissioner Baney asked about funding and continuing First Steps. Ms. Saraceno stated that they are in line for sustainability, and High Desert ESD may help out, as might some of the crime prevention funding. She said that there was less funding available, so they came up with the best plan they could. It is very close to what was available last year. Commissioners Unger and Baney indicated they are supportive. Mr. Kanner stated that the figures are already built into the new, proposed budget. 3. Update of Commissioners' Meetings and Schedules. Commissioner Baney is meeting with the combined Chamber of Commerce group tomorrow, so may not make the Community Development and District Attorney update meetings. 4. Other Items. Commissioner Unger asked about a request from the Red Cross for a place to store material that is now in the Umatilla County area. Commissioner Luke said that St. Charles Medical Center has its emergency supplies stored in Vancouver, along with a small amount of space in the County warehouse. Commissioner Unger stated that he would like to know about the magnitude of the material and some ways to consolidate the various locations. They need to provide the same to the City. Tom Anderson stated that he is continuing to work on the vendor food licensing issue. President today I am introducing the La Pine Land Conveyance Act of 2009. My bill involves the community of La Pine, Oregon, in the south half of Deschutes County. Like anywhere in America, the leaders in south Deschutes County are working every day to build the best place they can. They want a good education for their kids; a vibrant economy; great weekends; and a great lifestyle. Not much happens around La Pine without the Federal Government involved. In Deschutes County the Federal Government owns about 75% of the land; in southern Deschutes County the Federal Government owns about 90%. To be sure, these lands are the region's treasures; they are the source of a vibrant tourism economy; an attraction for individuals and businesses to move to the region; and the daily outlet for the people lucky enough to live there. By the same token, this proportion of Federal ownership limits the ability of local governments and civic leaders to solve problems and serve the public. My job is to help make sure that the Federal Government is an active partner in advancing communities and improving a region's quality of life. La Pine Wastewater My bill directs the transfer of about 750 acres managed by the Bureau of Land Management to Deschutes County for the purpose of expanding the town's wastewater treatment operation. These lands are within the La Pine city limits. The Special Sewer District first applied for the use of this property more than five years ago; incredibly, the BLM lost that application. Two and a half years ago my office participated in discussions between the La Pine community leaders and the BLM concerning the La Pine community's need for land to serve the public. Due to staffing limitations BLM asked the City to choose one top priority for a land transfer under the Recreation and Public Purposes Act. The La Pine City Council responded immediately that its top priority was the acquisition of land enabling expansion of their sewer district. In March of 2007 the La Pine Special Sewer District again filed a request for 490 acres. This month we were told that BLM has essentially not begun processing La Pine's request. We're told that La Pine would have been extremely competitive for state and federal economic stimulus funds, but because the conclusion of this land transfer is nowhere in sight, that opportunity was missed. This project is too important to let languish. Perhaps the most important issue affecting water quality in Deschutes County involves the threat to groundwater and the Deschutes River from household septic systems in southern Deschutes County, the region around La Pine. This project directly reduces nitrate loading into south county groundwater in two ways. First, by enabling expansion of the District service boundary to residential areas where we know that septic systems are generating elevated groundwater nitrate levels; and second, by relocating the area for spreading treated effluent, away from a relatively high groundwater area, to this new location which is judged not to threaten groundwater. La Pine Park and Recreation District The bill directs the transfer of BLM lands to Deschutes County for use by the La Pine Park and Recreation District, enabling the District to develop rodeo and equestrian facilities, public parks, and other recreation facilities. La Pine has a set of unique challenges well known to the people of Deschutes County. The town recently incorporated, and with incorporation has come a feeling in the community that good things can happen if we work together to make our town as good as it can possibly be. My bill proposes the transfer of 320 acres of BLM land contiguous to the La Pine city limit, on its western boundary. This location will enable construction of public equestrian and rodeo facilities that have become increasingly important in La Pine. The property is within reasonable walking distance of downtown, creating an ideal parade route for the annual 4 h of July Frontier Days parade. In addition, the land will provide a location for development of ball fields, parks, and recreation facilities, which would be developed as the town grows and budgets allow. The La Pine Rodeo and Frontier Days events were notified by the owner of the current location that this would be the last year for events, that the property is being developed for other uses. SHORT TITLE. 4 This Act may be cited as the "La Pine Land Convey- 5 ance Act". 6 SEC. 2. As soon as practicable after the 10 date of enactment of this Act, subject to valid existing 11 rights, and notwithstanding the land use planning require- 12 ments of sections 202 and 203 of the Federal Land Policy 13 and Management Act of 1976 (43 U.S.C. 17127 1713), 14 the Secretary shall convey to the County, without consid- 15 eration, all right, title, and interest of the United States 16 in and to the land described in subsection (b). 17 (b) DESCRIPTION OF LAND.-The land referred to in 18 subsection (a) consists of- 19 (1) approximately 320 acres of land managed 20 by the Bureau of Land Management, Prineville Dis- 21 trict, Oregon, depicted on the map as "parcel A"; 22 and 23 (2) approximately 750 acres of land managed 24 by the Bureau of Land Management, Prineville Dis- 25 trict, Oregon, depicted on the map as "parcel B". This program directly impacts children and their parents early on, Kindergarten, First and Second Grades. This is a great time to catch children and their parents at the first signs of difficulty. This program has positively impacted many youth at MA Lynch in the past several years. I have observed children to have significant improvements in their behaviors and social emotional skills. We have had several students at our school who were having constant behavior problems and to once beginning the program to have very positive behavior changes. These changes can be directly connected to the First Steps Program and the strong parent training component. I recognize budgets are very tight right now, but I believe the First Steps program is money well spent and a great way to spend Juvenile Prevention dollars. Thanks for your time and consideration. My daughter was having so many problems at school because of issues at home. We tried so many things and nothing worked, until First step. was skeptical at first but quickly saw improvements. It helped her so much. She was being sent home for bad behavior at least twice a week and having almost daily visits to the office. She now has wonderful days and contributes and respects. For me, having the home support each week was priceless. I felt hopeless and frustrated and having someone there each week to talk me through it and give me suggestions was life changing for me and for my daughter. If there is a way to continue the First Step Program, I beg you to keep it. My thanks for being able to use it this year. Dennis Luke Tammy Baney Alan Unger Deschutes County Commissioners Dear Commissioners, I submitted an application for the Deschutes County Planning Commission on April 22, 2009, but did not include a letter of interest stating why I would like to serve on the Planning Commission. This is my letter of interest. I have been an attorney since 1970 and am now finally winding down my law practice. I moved from the Seattle, WA area in 2005 to retire, but have had trouble convincing my clients to hire other counsel. But my workload has diminished to the extent that I now have time to do something else. I have wanted to become more involved with my community and this position on the Planning Commission seems like a perfect opportunity to do something useful with my newly available time while getting deeply involved with my community. I envision an important component of the job to be liaison between the Planning Commission and the community, that is, discovering what the community's opinion is about the various issues being addressed by the Commission and the County Comprehensive Plan, and explaining the actions of the Commission to the community. I believe that this will be the biggest part of the job. I have seen much suspicion, misunderstanding and distrust of the County government in the La Pine area, and I am convinced that it is in part the result of an imperfect process of communication from the County government to La Pine residents, and a sense by the South County residents that the County is not interested in hearing - and considering - what the concerns of the South County people are. I would make every effort to assist in the communication. There is by no means any certainty that the suspicion and mistrust would vanish, but it would at least be based to a correct understanding on the actions that the County is planning or doing. I hear lots of incensed conversation about things the County Government is planning or doing, based on facts that are flat wrong or have been misinterpreted out of context. I will not be an apologist for the County, but I think people should base their opinions of events on the truth rather than misinformation. If there is open communication between the residents and the planning Commission, I believe that will take some of the heat out of the relationship. I understand that another part of the job is contributing to the comprehensive planning program. Serious consideration by the Planning Commissioners, and ultimately by the County Commissioners, to input from the South County to the process of developing the Comprehensive Plan would be helpful to establishing a sense of participation in the actions of government that affect the citizens of South County, and would contribute to develop a trust that the County Government actually has some interest in the concerns of the citizen down here. The Comprehensive Plan process so far has been widely derided in the South County because it gave the citizens a list of issues to rate, but did not ask the citizens to list the issues that they considered important. By limiting the consideration to only the issues that the County wanted to be considered, the County effectively foreclosed all the other issues that the people were concerned about. This looks like a rigged system. Asking only certain questions and not allowing questions and comments does not appear to be an open process; it looks like a process that has been rigged to produce only certain results. Some have compared it to the way the Local Rule was formulated and adopted. This is the sort of thing that can be avoided if there is citizen involvement in the process from the beginning, including the planning for the process. I would like to be involved in doing that.
