Luke and Alan Unger. Also present were Nick Lelack, Todd Cleveland, Kristen Maze, Community Development; Laurie Craghead, Legal Counsel; and four other citizens. No representatives of the media were present. Chair Baney opened the meeting at 10: 00 a. m. 1. Before the Board was Citizen Input. None was offered. 2. Before the Board was a Public Hearing and Consideration of First Reading of Ordinance No. 2009-018, regarding Allowing the Expansion and Conversion of Recreational Vehicle and Manufactured Home Spaces as a Conditional Use. Chair Baney read the opening statement. In regard to bias or prejudgment, the Commissioners had none to disclose. She then opened the public hearing. Kristen Maze gave a brief overview of the item, which was citizen initiated. Currently RV parks are not allowed to expand while manufactured home parks can. It has been found that these facilities were primarily established in the early 1970's and earlier, and 33 remain today. At this time 24 parks are not within city limits and are used for residential. Many of them contain both manufactured homes and RV's. Minutes of Board of Commissioners' Business Meeting Monday, July 20, 2009 Page 1 of 4 Pages In 1996 an amendment allowed manufactured home facilities to expand but it did not include RV's. The new amendment would include those and also MUA property. Ms. Maze stated that most of the parks are already expanded out to their capacity at this time. This amendment cannot be used to create a new facility; and all current regulations would have to be met. Commissioner Baney for clarification about the number of spaces to be approved. Ms. Maze stated that the information provided is from 1995. Commissioner Luke clarified that this is just for a conversion or expansion, but only the existing facilities can be considered. Ms. Maze said the Planning Commission recommended approval, but a few clauses were changed to clarify the wording. There was no opposition at the Planning Commission hearing. Ms. Maze pointed out the changes at this time. James Lewis, representing the applicant, agreed with the staff report. He pointed out that the RV parks are thriving and viable businesses, but it is hard to bring those up to standard without changes to the Code. This will allow them to upgrade to existing standards, and serves an important community need. Other entities such as the Department of Environmental Quality and the Oregon Department of Transportation will ultimately be able to provide input. Before the Board were Additions to the Agenda. Todd Cleveland said that the County is the on-site agent for the DEQ for inspections and permitting. Commissioner Luke said that it was suggested by a few citizens that DEQ handle this service in the future in regard to site evaluation and groundwater work. Mr. Cleveland said they handle the drinking water program, restaurant inspections, licensed accommodation inspections, foodborne outbreak inspections, other issues related to health. Commissioner Luke asked how that ties into the groudnwater situation. Mr. Cleveland said it involves humans and how they interact with the environment. Health hazards and water quality interact and are all linked. All of the inspectors have to be trained on the entire process and all of the potential impacts of humans on the environment. If the program were to be turned over to the DEQ, they would have to provide services to the entire county and not just the south County. Mr. Cleveland stated that there would be a service issue. To get a building permit, certain permits and inspections have to occur in a timely fashion. Community Development is a one-stop shop and handles these as part of the process. If the DEQ had control of the water or sewer aspects, it would complicate the process, take more time, and likely end up costing more. Commissioner Luke asked if State rules apply. Mr. Cleveland said they do, although there are some items that the County requires as well. The County can require more than the DEQ, but not less. The DEQ would have to make sure it complied with the County's requirements. Commissioner Luke asked about the map created to review the information. This will be discussed at the July 20 afternoon work session at length. Nick Lelack emphasized the importance of the one-stop shopping at Community Development. It is difficult for customers and others if there are multiple entities involved.
