DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, JULY 279 2009
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Tammy Baney, Dennis R. Luke and Alan Unger.
Also present were Erik Kropp, Deputy County Administrator; Tom Anderson,
Community Development; Marty Wynne, Finance Department; and Laurie
Craghead, Legal Counsel. No other citizens were present.
Chair Baney opened the meeting at 10: 00 a.m.

2. Before the Board was Consideration of Signature of Order No. 2009-053,
Accepting a Petition for Annexation of County-owned Property to
Deschutes River Recreation Homesites, Unit 6, Parts I and II, No Shooting
District, and Setting a Public Hearing for August 17, 2009.
Tom Anderson gave an overview of the item. Code does not require any notice
be sent on this type of hearing, but signs will be posted on the properties to alert
the public, and property owners in the area are being advised, as is a Ducks
Unlimited representative and a State Parks representative.
Commissioner Unger asked about the State Parks' rule about no shooting on its
property, which is nearby. Mr. Anderson said that they have provided input in
the past but can certainly speak to the issue again at the hearing.
Commissioner Luke stated that the Sheriff is the only one who can enforce this.
Laurie Craghead said she does not know how the State enforces their own no-
shooting rules but they can contract with the Sheriff for this service.

Mr. Anderson said that the County cannot regulate what the State or federal
agencies do. Commissioner Unger would like further information on what
those agencies might want to do in the future, but this can be discussed at the
hearing.

3. Signature of Resolution No. 2009-111, Establishing a Bank Account to
Facilitate Collection of Online Registration Fees for Health Department
Classes.
Commissioner Luke asked for details on this item. Marty Wynne said the
Health Department wants to use on-line registration for certain classes. This
will make registration easier for everyone.
Mr. Wynne said that he does not like to see bank accounts opened unless
absolutely necessary. This account will be limited to this use, and will be fairly
simple to administer. The amount handled on a monthly basis is very small.
There are no checks; the transfers are handled electronically only by authorized
personnel.

Little Deschutes Lane

11. Before the Board were Additions to the Agenda.
Commissioner Luke said that the meeting last week with the Planning
Commission was productive, and they were able to give direction to staff on
next steps relating to destination resorts and the comprehensive plan update.
In regard to the interim local rule ordinance and litigation related to it, Laurie
Craghead stated that she would like an executive session to discuss this further.
Mr. Anderson said that his staff is putting together a list of issues to be
addressed.
Commissioner Unger asked what the next steps are with the Department of
Environmental Quality regarding the South County groundwater protection
issue. Chair Baney said that at this point it is unknown, as it is in the hands of
the DEQ. She said that citizen Robert Ray has contacted the Central Oregon
Builders' Association regarding his desire to have the DEQ handle the on-site
inspection program as well as the groundwater protection program.
Mr. Anderson stated that there were a number of items discussed that need to be
put on paper so they can be confirmed with the DEQ.
Chair Baney said that some people in Terrebonne might have inquired about
whether they can be assisted with the repair or replacement of septic systems in
the Terrebonne area. Commissioner Luke asked whether there have been
repairs required in the recent past. Mr. Anderson stated that Neighbor Impact
has actually turned some La Pine area people down because they were "upside
down" on their properties. There are programs in place to help people who do
not have funds to repair a septic system or make other necessary improvements.
Chair Baney wants to make sure that people are helped as appropriate.
Commissioner Unger said that he hopes nothing said at the meeting causes a
problem for them. Chair Baney stated that she received a note from someone at
the DEQ who said that he or she cannot be objective on this issue.

She said that originally the purpose of the meeting with the DEQ was to hold a
work session and figure out next steps, and to hand off the project to the DEQ.
The DEQ representatives indicated they had wanted to hear from the public
instead. The meeting was supposed to be a hand-off meeting, but the Director
appeared to have no idea that this was to take place even though DEQ staff had
been working with the Commissioners on setting up the meeting and coming up
with an agenda.
Regarding the HUB zone meeting, Erik Kropp stated that all of the attendees
seemed supportive, and more information will be gathered to help decide if this
can be an administrative issue or has to be legislative.
Commissioner Luke said that there could be highway projects that fit but the
larger, local contractors would not be allowed to bid.
A brief discussion took place regarding federal lobbyist services.
Commissioner Luke noted that The Ferguson Group of Washington, DC
generally represents small counties and does not usually represent more than
one county in a State at the same time.
Being no further items to come before the Board, the meeting adjourned at
10:50 a. m.
