DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, AUGUST 17, 2009
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Tammy Baney, Dennis R. Luke and Alan Unger.
Also present were Dave Kanner, County Administrator; Tom Anderson,
Community Development; Laurie Craghead, Legal Counsel; Anna Johnson,
Communications; Susan Ross, Teresa Rozic, Renee Warner and Deborah Cook,
Property & Facilities; and six other citizens, including two representatives of the
media.
Chair Baney opened the meeting at 10: 00 a. m.
1. Before the Board was Citizen Input.
The Commissioners and members of the audience acknowledged Renee
Warner's twenty years of service to the County.
2. Before the Board was a Public Hearing, and Consideration of Signature of
Order No. 2009-054, approving a Petition for Annexation of County-owned
Property into the Deschutes River Recreation Homesites, Unit 6, Parts I &
II, No Shooting District.
Chair Baney opened the public hearing. Tom Anderson gave an overview of
the item, and indicated which agencies had been contacted and submitted input
on the issue.
Formal testimony can be taken today from agencies and citizens. Each property
was posted with signs indicating the hearing details, and direct reminders were
sent to all who had expressed an interest.

The northern most parcel is typically submerged during the year. Most of the
shooting in that area appears to come from the State Park land across the river.
Shooting is not allowed in the southern portion of the Park, but is still allowed
on the north end.
The two other County properties are for the most part accessible only by boat.
Commissioner Luke said that shooting while on the river is not covered by
County jurisdiction. He asked how the people floating on the river can be
controlled. Mr. Anderson said that the Division of State Lands has control, not
State Parks. The game warden has some authority as well.
Commissioner Luke asked that testimony from previous hearings be included in
this record. Mr. Anderson acknowledged this would be done.
Nadine Ruth testified that she got this issue started because she has pellets
landing on her back deck, and cannot walk on her property much of the time.
There is also a lot of noise before sunrise. The neighbors to the south have had
hunters crossing their property to get to the County properties, and the
neighbors have been harassed when they tried to get the hunters to stay off of
their property. Some hunters have responded to requests to be more careful by
pelleting the property even more. She has contacted the Sheriff's Office on five
occasions.
Commissioner Unger said that the State has to cooperate to manage the
shooting on the other side of the river.
Ms. Ruth said she thought the hunters have been on County land and was not
aware of the State land. (She referred to property near parcel # 1 of the
annexation.)
Commissioner Unger asked how long the duck hunting season lasts. Ms. Ruth
said that she thinks it is from September through January. Commissioner Luke
said that the DSL covers the river to the high water mark.
Joe Wannamaker, Park Manager for State Parks, testified that they don't have
an interest either way as to whether hunting is allowed. The area does allow
shooting at this time. If it is closed to shooting, even if the land is underwater,
the State would reconsider how the land is managed.
Commissioner Unger stated that it appears if the County declares a no-shooting
zone, the State would look at adjusting how the State land is used.

Mr. Wannamaker indicated that there is no public hearing per se for this; it
would be handled administratively. There are other areas on the Willamette
greenway which are subject to similar situations.
Commissioner Baney asked if signage of some kind would help. Mr.
Wannamaker stated that the homes are clearly visible. His agency does not
have control of the river itself; the Division of State Lands controls this.
Commissioner Unger would like to see some balance between hunter rights and
homeowner rights. He asked if a letter to the DSL would help with them
examining the issue.
Mr. Wannamaker stated that a letter would help. They could reduce the size of
the zone if appropriate. Commissioner Unger stated that the island might be a
place to allow this, as there is Parks property all around it.
Mr. Anderson pointed out where the Park property is located. He added that the
Park land is open area, without campsites. Commissioner Luke stated that
shooting towards a residence is already illegal and this would not change
anything.
Mr. Wannamaker said that only a part of the State property allows shooting or
hunting. Commissioner Luke said that State Police cannot enforce this law; the
County can to some point, but not on the river.
Commissioner Baney asked how someone would know where it is allowed and
where it is not. Mr. Wannamaker said that it is published. It has to be
specifically stated where shooting is allowed and hunters are expected to know
this.
Commissioner Luke asked if someone can shoot from County land over to the
State lands. They can already shoot upstream or downstream.
Commissioner Baney asked if these areas are prime for hunting. Mr.
Wannamaker said that there are some locations that are well used but the size of
the area has gotten smaller.
Commissioner Luke asked how far it is from one side of the river to the other.
Mr. Wannamaker replied it is about 25 yards wide there. Mr. Anderson said
that the lots affected are about 100 feet wide, and the County properties are
about the same size.

Ms. Ruth said that most of the lots are about 90 feet wide; hers is about 135 by
1,000 feet or about three acres, but others are smaller. She stated that last
February a parcel north of hers was added to the no shooting zone, which she
felt was a problem as it would cause more hunters to enter the waters near her
property. She does not see hunters in boats; most are on the shore. The island
parcel is close to homes and gets the most trespassers. The campground is
closed that time of the year, so perhaps the hunters could be there then instead.
Mr. Anderson said that parcel #2 is about two acres in size.
Camilla Emmons stated that she and her husband own the furthest northern
parcel. They have tolerated shooting since 1998, and each fall is there is no
sleeping in, but the biggest problem is the shots coming into the area. She can
hear the pellets hit the metal roof of the neighbors' house. Children play in the
area and it is not safe for them. She said her neighbor, Jane Hayhurst, could not
attend today. A portion of the island is her property, and they have had many
discussions with the hunters about property lines.
Commissioner Unger said that the parcel that is being discussed is impacted the
most. Ms. Emmons stated that the neighbors have said that trespassers are a
constant problem.
Ms. Emmons said she has never seen a hunter shoot from a boat or canoe.
Usually they are on the land. Sometimes they ask for permission to retrieve
their downed ducks from private property, which clearly indicates they are
shooting onto the private land.
Ms. Ruth pointed out, on an oversized map, the location of her property and
where the river now goes through. There is a new channel and the existing map
is no longer accurate.
Commissioner Unger asked whether the new channels go under DSL control.
Laurie Craghead said that she does not know, because the Deschutes River has
never been included on a State list of navigable rivers. Commissioner Luke
said that this law was never designed to keep people from trespassing. Unless
there is a sign indicating it is private property, how would anyone know.
Chair Baney asked for additional public testimony. Ms. Emmons commented
that Commissioner Luke said that it should be posted; it has been, but people
have removed the signs.

Commissioner Luke said that he has no problem with parcels #I and #3 going
into a no shooting zone, but does not want to act on parcel #2 at this time. The
hunting groups and the State came to an agreement on the land across from the
Sunriver marina. Most hunters are courteous. He would like more information
on parcel #2. He would like to know more about what the State would do in
this regard.
Ms. Craghead stated that if there is a majority that does not want to include
parcel #2, the order would need to be amended. Commissioner Luke would like
the hearing to be continued. Commissioner Unger said that he would like to
hear more about this particular parcel.
Chair Baney disagreed; she feels this is a time sensitive situation. Parcel #3 is
surrounded by no shooting zones, and she would like to see all three approved.
The State seems to indicate that they would take action only if the County does
first. Ducks Unlimited has responded as well. Shooting from a boat or canoe
does not seem to be common.
Commissioner Luke said that there is no proof that people are not shooting from
boats. Chair Baney replied that if you are sitting on your deck and hear pellets
hitting the roof and you see no boats, there is value to that observation.
Commissioner Luke stated that if someone shoots over County land, that is too
far for pellets to travel. Commissioner Baney said that area #I is mostly no
shooting.
Ms. Craghead said that corridors of 150 feet on each side of the river was set
because that is about the maximum distance for pellets to travel.
Commissioner Unger said he would like to have more information on parcel #2.
State Parks would have to change how it manages its property. There would be
more of an impact on people because it would be compressed into a smaller
area.
Commissioner Luke said that pellets landing on property is not a violation of a
no shooting zone. Commissioner Unger added that the State can adjust its rules
accordingly.
Mr. Wannamaker was asked how long it would take the State to respond; he
said a couple of weeks upon receipt of a request.

Staff was instructed to do an order for parcels #I and #3, but more information
is to come on parcel #2. Dave Kanner said that hunting season begins in
September, and the Board will not meet until September 9 on this issue.
Ms. Craghead asked if the current order can be approved with references of
parcel #2 omitted. Mr. Kanner said the order does not reference the parcels
separately.
LUKE: Move that Counsel amend the order, including just parcels #1 and
#3, to be considered for approval at the Wednesday, August 19
afternoon work session.
UNGER: Second.

An order addressing only parcel #2 will be addressed at the Wednesday,
September 9 morning business meeting.
Mr. Anderson asked what additional information is needed on item #2.
Mr. Wannamaker said he would report to his agency on parcels #I and #3, and
advise them that the Board is looking for more information on parcel #2.
Commissioner Luke asked how to access the parcel, as he would like to make a
site visit. Mr. Wannamaker said that there is no road accessing it.
Mr. Kanner said that an order could be approved, with exhibits A and B
amended to remove references to parcel #2.

Mr. Anderson stated that he is not sure how the signs would be posted, but they
would be strategically placed and probably by boat.
The hearing was continued to the September 9 business meeting.

Dear Commissioner.
An article in the Bend Bulletin regarding the expanded No-Shooting zone has prompted me to contact
you regarding our concerns about how this will affect my immediate neighbors and me.
I live on the Deschutes River. Directly across the river from my house is a legal shooting zone. I have
teamed from the County Commissioner's legal assistance office that this small area is owned by the
county. I watch and hear the hunters all during water fowl hunting season. During this last season I
called the SheriFs department five times.- This is the number of times that I heard or felt their shot gun
pellets land on my deck, rattle against my windows or rain down from my roof. On one occasion I
called across the river to say that their pellets were hitting my house. The response was to send more
buck shot my way.
Expanding the no-shooting zone in the area between Mile 202 & 203 makes sense for that
neighborhood, however it will have a serious Impact on my neighbors and me, as it will bring more
hunters to use the area across the river from our homes. Although the sound of shot gun Mass a half
hour before sunrise is quite annoying, I realize this hunting zone existed before our homes were built
The most serious impact of having the hunters so dose is that pellets.rain down on our home and yard.
Our property ends at the rivers edge. During hunting season I am unable to even walk out to the river
on my awn property because there are people with guns directly across the river. We feel this is a
significant health and safety issue.
I am asking that you declare the small county owned area a No-shooting zone also. This area is
adjacent to existing no-shooting zones and La Pine State Parts. I have enclosed a copy of the county's
no shooting district map and indicated my lot on the map. I would like to attend one of your business
meetings where you allow citizen input I would appreciate any suggestions as to how t should proceed
from here as 1 do not know the protocol.
The legal description of my property is Deschutes River Res 70 35+PT.36

Dear Mr. Luke
My husband, David Hayhurst, and 1 have owned our home south of Sunriver for eighteen years. In the
early years there were few hunters, few homes and fewer recreational users of the area. Time has
exponentially altered the situation and made some definition of appropriate uses for appropriate locations a
necessity. Several years ago the neighborhoods down river from the park voted themselves Non-Shooting
areas and joined in the River Corridor Plan. At the time the government agencies that share these property
lines assured us that the county regulations would be honored and adjacent areas of state and federal
property would closed where they abutted the newly closed lands. Slowly through the years, that has
happened. The State Park closed the area south of their Powerline Road, the Federal Lands have been
closed in most areas. The zone was determined to include the river as it nuns between these lands.
With few maps and surveying done years ago, it was assumed that the three small areas, now designated
county property and surrounded by Deschutes River Recreational Properties, Unit Six, were park property,
divided by straight lot and section lines occasionally breeched by river meander. It was not until after the
No Shooting Area was founded that the three small properties were determined county land. They are
totally surrounded by the No Shooting Zone and would have been included. as such according to the
information the county gave us at the time the zone was plotted, had they not been thought to be included in
the State Park area, already deemed by them to be No Shooting.
There has been increased use of these areas and any use is dangerous. The properties are to small to allow
any likelihood of a bird shot from the plot, landing on it. Shooting from any of these areas means shooting
into private property or into the park trail system. Homeowners are nearly forced to stay in the house and
keep their animals in as well. Shot falls on roofs and windows. The hikers and riders on the trails are
unlikely to surmise that shooting of any kind is allowed. It does not present a logical expectation.
The size and location of the areas makes them an attractive nuisance. Each is accessible only by river or
ingress through private property. Virtually all is posted as No Trespassing. These signs are ignored or
vandalized regularly. Additionally, hunters and their dogs have no legal access to the surrounding areas to
retrieve downed fowl, which they must by law do. To legally get their birds they must contact either an
owner or contact a State Trooper to enter the posted properties. The county lots in the area are too small to
reasonably expect a downed bird to land anywhere but the river or private land on the other side of the
river. The situation encourages the hunters to violate both the law and endanger homes and homeowners
and their pets. We cannot stand in our yards and shoot into the county lands, but they may shoot at us.
Walking out to explain to someone that they are illegally on your land is not a happy event when the
trespasser is armed. And 1 have twice been run off my own yard by hunter's dogs.
The years have changed the nature of this area. It is far more residential: the park trails completed, close to
the river and more used. These three very small areas seem out of character today. We ask you to honor
the intent of the No Shooting area we established and close these small areas to conform with the areas
surrounding them.

We have serious concerns about the legal hunting zone in the area across the Deschutes
River from our home. I cannot walk on my own property along the rivers edge during
waterfowl hunting season. There are people with guns on the other side of the river. The
peace and serenity of our forest neighborhood ends before sunrise during hunting season.
Recently an area north of us along the river was included in the no-shoot zone. That
makes perfect sense for that area The area directly across from us should be included
also. Closing the area north of us will send more hunters in our direction and make an
already bad situation worse.
We are just south of mile #205 on the river. Please include this area in the no-shoot
corrider.

Dear Commissioner.
1 have been planning on contacting in the Commissioners to protest the shooting that is
permitted from the area, across the Deschutes River, directly towards our house. A recent
article in The Bend Bulletin, discusses expanding the No-Shooting Zone further down river.
This greatly concerns us because unless you include us in the No-Shooting Zone, we will
have our current situation aggravated. More hunters will almost certainly come up river to use
the shooting zone directly facing our property.
Our house is at 54647 Silver Fox Drive and abuts the Deschutes River. Directly across the
river from the back of our house is a legal shooting zone. Apparently this is a small strip of
county land on the river. It is sandwiched between the La Pine state park on the North and
the Deschutes River on the South. The river runs approximately east west in the shooting
zone. We are on the south side of the river such that when the hunters on the north side
shoot at waterfowl, they necessarily shoot towards our house.
I like to walk on my property along the river year-round but I can't use my property starting in
the fall without the risk of getting shot. Once when walking in the morning before I knew
hunters were hiding across the river waiting to ambush ducks, they shot where I was walking.
The pellets hit the bushes near me. I yelled at them. I got a lecture about how they were in a
legal hunting/shooting zone. They couldn't have been more than 50 yards from me when I
was walking on my property. I do not know exactly how many feet it is from where they shoot
to our back deck, but it is too dose. Our neighbors, Roger and Nadine Ruth, have reported
pellets hitting their house and ours. We are right next door and the same distance from the
river as they are. A small projectile recently shattered our metal light fixture on the back deck.
I cannot find the bullet to prove it was the hunters, but I have saved the pieces of the fixture;
from the point of impact it looks like it was struck by a bullet.
I can't believe that the county and La Pine State Paris allow a shooting zone that puts us in
the sights of the hunters. I am not exaggerating - come look at the site. I have entered the
park and examined the hunting site from the county land. (It is easy to find from all the spent
shell casings littering the shoreline). The hunters always position themselves facing the river,
in order to shoot ducks as they fly over the water or fly over our property. The hunters
frequently place decoys in the river to attract the ducks. They never shoot north into the Park,
they always shoot south towards our house. There are signs marking the shooting zone.
Interestingly, the signs could have been placed around the bend further up river, where there

are no houses directly across the river. In that location the river flows north-south, such that
any shooting would be down river and not towards homes.
We bought this house two years ago but the house was on this site since 1989.1 do not know
when the shooting zone was approved. I question the legality of the county and the state park
continuing to allow shooting onto private; property towards homes, when it is now on
NOTICE, that we are being endangered by the hunters.
We request that you include our neighborhood as a no-shooting zone along with the area
between Mile 202 & 203. If it makes sense for that neighborhood; it should make sense for
ours.
I am recently retired and split my time between our home in Medford and our home at 54647
Silver Fox Drive. We do not receive mail at 54647 Silver Fox. We can be reached at our
