Luke, Alan Unger and Tammy Baney. Also present were Dave Kanner, County Administrator; Erik Kropp, Deputy County Administrator; media representative Hillary Borrud of The Bulletin and representatives of KOHD and KTVZ TV, and approximately twenty other citizens. Chair Luke opened the meeting at 6: 00 p.m. Before the Board was a Public Hearing and Consideration of Adoption of Resolution No. 2010-009, Creating a New $100 Skyliners Road Event Fee, and Limiting the Events Permitted on Skyliners Road. Erik Kropp gave as staff report, explaining the benefits and potential problems relating to the use of Skyliners Road. (A copy is attached for reference) Residents have commented on lack of notification of events, problems with access for emergency vehicles, deliveries and so on. The resolution will create a new Skyliners Road event fee in the amount of $100, in addition to the current $35 fee. The fee revenue would be used for Reserve Deputies to patrol the road during events, and the six events held last year would be allowed again this year. Some events simply cross Skyliners Road and have minimal impact. Section 5 stipulates the number of event dates; there is only one that is more than once. Skyliners Road event fees will be temporary until such time as the bike lanes are added. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 1 of 17 Pages Mr. Kropp emphasized that everyone agrees that Skyliners Road needs to be reconstructed. It is funded by federal dollars, but it is listed at being reconstructed in 2016 although the need is there to move that up. Letters have been sent out asking for the priority to be moved up. Commissioner Luke said they previously talked about the fee not necessarily being for the Sheriff's Office, if the City of Bend or another entity can provide the same service, this should be broadened. Mr. Kropp said this could be changed. Commissioner Luke asked what the City charges. Mr. Kropp said it is about $145, which includes an ADA accessibility fee. George Kolb of the Road Department explained that Forest Highway money is the only way March 2 tri-agency meeting, and it is hoped it will be known when this can happen. They need to coordinate this with the construction of a water line with the City of Bend. Commissioner Unger asked what kind of road Skyliners Road is, what its main purpose is, etc. Mr. Kolb stated that the road has been maintained by the County for at least 18 years. About six years ago they tried to classify it as a forest highway, which would make getting funding easier. A few years ago the County tried again and finally got on the project list. Originally it was to be done in 2013, but it was delayed to 2016. It accesses Phil's Trail and Tumalo Falls and an extensive network of trails. It is a great road to ride. There is a subdivision at the end of the road, and some residents that even live beyond the bridge. The road was constructed as a cinder base with oil mass surface. The cinder base is starting to show through. Commissioner Baney said that there is an opportunity to work with the City of Bend, unlike Road 45. There is no point in digging it up twice. Mr. Kolb said the road will be surveyed and planning has started on the water line. The water line is outside the road in an easement; they hope to do the project in 2012. The water line would be best on the shoulder so the road would not have to be dug up for repairs. The road would be 32 feet wide in the future, which would allow 12 foot travel lanes and bike lanes. Chair Luke opened the meeting up for testimony. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 2 of 17 Pages Doug Treadwell said he has seen the road start to have hundreds of cars and a lot of bicycles. He does not think the recommendation does any justice for the residents. They have complained about this for the past two years. The status quo is not what they want and this is not a fix. It is a dangerous road. They try to be careful when driving but there are a lot of others using the road who are not familiar with it. He does not want to see the events continue. Initially he thought that a couple of venues were educational and useful. But it is clear to him that it has to be all or nothing. Commissioner Unger said that the resolution would set an event fee. There are also people who use the road just to ride, and are not part of an organized event. Commissioner Baney stated that they often have to set up something to be reviewed, and the Board wants to hear recommendations. She asked when the most unsafe times are on that road. Mr. Treadwell said from late spring to late fall, in the late afternoon. He added that the possibility of using Century Drive would be just as good as Skyliners. Commissioner Baney said in July there were 153 cyclists on the road, per a count. These were not part of an event. She wants to get a better understanding if it is the events themselves or if it is the normal usage. She'd like to find out how to make it safer. Mr. Treadwell said that the events encourage others to mimic what they do, which is ride in the middle of the road. They requested some signage. The new signs say "share the road", which indicates that they can ride anywhere on the road. He suggested this be indicated as single file only. Ed Surdyk commented that while riding his bike this summer, and people who were coming here who questioned why this road was being used. It is in poor condition. He encouraged event organizers to realize that at some time the road will be torn up to be repaired, and they would have to find another location. The time to find a new location is now. Mark Spencer said that he is a cyclist and has lived here for twelve years. He discovered Skyliners Road before he was ever in an event. He never had any negative situations while using the road. I thinks that the proposal to improve the road is a good one, and it will be good for cyclists and residents. But he does not think it will make a significant difference in safety. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 3 of 17 Pages Cyclists are used to dealing with rough roads, traffic, rocks, cinders, obstacles and other problems. Waiting on road improvements is not the answer. He appreciates the fact that the fee would go to improve awareness and more oversight during events. That alerts both the cyclists and the motorists and brings everyone's awareness up at that time. The event organizers need to do abetter job in this regard, having cyclists be more aware and polite, not ride in large groups, etc. All the events are in a time trial format, one at a time, and if there is a pass they are to get around the other one as quickly as possible. Most cyclists know they are supposed to stay to the right of the road unless dodging obstacles. He hopes that the Board will consider the perception of the area and the nation as a whole. This has been a wonderful thing for the community, outdoor activities, and beautiful. He doesn't want to see the people living there lose their lifestyle. It's the same reason we want to ride our bikes there. Anything that can bring safety to everyone's attention is good. Eric Anderson of Skyliners Road clarified that the source of the tension between the road biking community and the residents is not the short inconvenience needed to slow down. The source is the fact that they are forced to participate in this environment of near death too often. They don't want to see an accident happen and feel it is imminent due to increased traffic. No one up there wants to be part of an interaction of a bike and vehicle. Commissioner Baney asked if he recommended no cycling. Mr. Anderson said he is pro-cycling and that would be impossible. He would encourage people to use another route until the road is improved. And he asked when the bike lane comes into play. Commissioner Baney said there is no bike lane on much of the road. Mr. Anderson stated that it is not acceptable as it is. Diana Short of Skyliners Road said that she has six kids, and when there are bicyclists on the road, she feels it is hard to get around them. There is no place to go. The road is narrow. Last year she scheduled a day to come home after the event was supposed to be over, and found it went on for another hour and a half. She got behind an officer, but was very frightened because the cyclists were hugging the center line. To get around them is difficult. She is concerned about the cyclists' safety. She does not let her kids ride on that road for anything. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 4 of 17 Pages Commissioner Luke said that Road 45, River Summit Drive, was also an oil mount. Sunriver had to maintain it. Skyliners had some of the same issues. He asked if the County does maintenance on it. Mr. Kolb said that a lot of work done for potholes does not last long because there is not much of a base. It needs a whole new road. It could be a two-year project, including the water line. Dick Ridenour is a Skyliner resident and submitted a document in writing. Through this process, Mr. Kropp has been very helpful and provided a good atmosphere for interaction. The process has gone well. He feels that Skyliner in its present condition is dangerous for bicycles and cars to coexist. He knows there is tremendous independent use of the road, but could be some cause and effect due to event use. There is a lot of potential event traffic that would not be there otherwise. All three of the Commissioners have probably driven the road and know it is narrow and limits bicycle use. When you have traffic both east and west bound, there is no place for a bike. He rode a bike for a number of years as his only transportation. Even riding in the bike lanes is dangerous, and he was hit twice. He had a close call during one of the events due to an inexperienced flagger and poor lighting, and almost hit a bicyclist. It may not be possible to get highly skilled flaggers. He does not see a way for the events to occur and permit the significant use of the road at the same time. He does not want to close the road to all events, though. He has lived there for many years, and feels that the events should be discontinued until the road is reconstructed. At that point it would be as good as any road could be for that kind of event. He asked that no events be permitted until that time. John Short lives on Skyliners. As far as the difference between an event and normal cycling traffic, two things occur. One thing is that they start cyclists thirty seconds apart, so there are cyclists on both sides. On a normal day, this does not happen at one time. The other thing is that cyclists in events do not believe they have to obey traffic laws. If they are on the yellow line, that is not good. The road will deteriorate further. He does a fair amount of public permitting. If someone meets the law, they get the permit. The Code seems to show that they can issue it if it does not endanger public safety. This resolution does not change this. They are all just as dangerous. There should not be bike events permitted at this time. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 5 of 17 Pages Gina Miller owns Fresh Air Sports, and produces the Thursday night time trial series. She has been to four or five meetings in combination with residents, and she was encouraged that there was a lot more communication to try to find a solution rather than animosity between the cyclists and residents. With the last few meetings, the issue seems to be cyclists in general. The events are not the biggest concern because they use certified flaggers and signage on the roads for each event. Recreational cyclists can be there at any time and you would not know they are there. Her events have small numbers, usually between 25 and 60 per week. Typically this is an hour on the road, between about 6 and 7 p.m. The impact is minimal. One compromise might be to start the events at 6:30 instead. There is not much traffic from 6 p.m. on. Another proposal is that there are six events annually, and they could limit it for four nights instead of six. It is not a high revenue event as much a community service. The time trial series gives people a chance to volunteer for other events. It is not economically viable if they are cut back too much. She likes the idea of signage to educate recreational cyclists. The cyclists know to ride single file and how to pass. This is the sixth year and there have been no issues with vehicles and cyclists. This is because of the education they have done, the level of cyclists who know the rules of the road, and because of signage and flaggers. To Mr. Spencer's point, there will safety issues in any event. That's why they are mitigated. These things would not go away with a different venue. They have looked at China Hat Road and other locations. There are other venues but they have their own issues associated with them. Commissioner Baney said that when the road gets reconstructed, it will be a mess for a while. Ms. Miller said they may have to forgo the event during that time. They use the road adjacent to Skyliners for the duathlon, where they run three miles. It is hard to find a venue where there is a safe place to get off the bikes and run. It is ideal there because they don't have to cross traffic. Commissioner Luke asked if they have to over time eliminate the number of events as the road deteriorates, is there a group that could advise on how to prioritize. Ms. Miller stated that all of the event coordinators are in the room and they'd be the ones to talk with. He said that the old highway that parallels Highway 20 near Horse Ridge has very little traffic and has BLM on both sides. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 6 of 17 Pages Ms. Miller said they have looked out there. The challenge is also parking. If they go south or east, it can be hard. She is also doing a road race on Rickard Road, and the County building area will be used for parking. A lot of people on the west side ride their bikes there. Commissioner Luke said that there seems to be a lot of room to park, a beautiful two-lane road and very little traffic. He suggested she take a look at it. Marcy Monte has lived on Skyliners for 22 years. Every single person has said they are concerned about safety. She is an athlete and health and wellness is to be promoted. Using this road does not promote either. The riders and drivers are aggressive to each other daily. She likes the idea of education. One person gets hit, and one was hit by Summit last year, it will change lives. She always talked with her children about driving safely. There is a whole new generation of kids in the area, and it is scary. Racing promotes recreational use. Everyone practices what they do. Someone brought up the condition of the road. It heaves with ice and is horrible to use. It is disintegrating. Her stance is there are no races that will decrease the use of recreational riders, and it needs to be set up for bike lanes. It seems logical to do the water line at the same time. Money is so important, as is health and wellness. It is not a safe road for people to ride on right now. Brian Douglass is CEO & pres of Smith Rock Race Group. The Cascade Lakes relay crossed Skyliners and is not part of these events. As they put together events since 1994, they have dealt with many jurisdictions. He is happy to work with Deschutes County, who has been willing to work out issues. Ms. Miller has a good point about cutting the number of events from six to four. If she takes two nights off the schedule, she cuts down the number of event dates to ten. This is significant. The top year was 14. Two nights off her situation is a good compromise. Trying to find flat ground in Bend to do this is difficult. If the County will cooperate and allow a road to be closed to make it safe and easier for event organizers to use, they would be open to this. Commissioner Luke said that no one lives on the Horse Ridge road and it would not need to be closed off. Mr. Douglas said they found a location near Eagle Crest. It is hard to find a location where they can get a permit and still be safe, and have the same type of terrain. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 7 of 17 Pages Commissioner Luke asked how much worse the road would have to be to not work for their event. Mr. Douglas said that they are runners and the condition of the road is not an issue for them. He said that this idea of increasing fees to add a public safety aspect is novel, but he would like to have the opportunity to pay the fee if they could get a deputy on Century Drive and Cascade Lakes Highway on July 31 this year. Staff has not ever mentioned this. They could get this help in the past. He would like them to have the same option when they do the Cascade Lakes Relay. Commissioner Unger stated that Ms. Miller's event would be for four days, instead of two. Peter Aune of Skyliners said he has had some close calls as a driver that really scared him. The road is too narrow for bikes. He has ridden it once and it was scary for him at the time. Now they load their bikes up and do biking elsewhere. He is not anti-bike and appreciates it is a beautiful place. He'd love to see nice, wide roads. It has great elevations and sees the attraction. He feels that there should be nothing until it is safe. Shawn Loftus stated that none of the residents have a problem with cyclists, and most love the outdoors. They want to be able to drive home safely. This has nothing to do with recreational cyclists, but have some control over events. What he hears from event organizers is that they want to run viable, profitable events. Safety should carry some weight. He already sent some e-mails. Commissioner Luke asked if there have been serious accidents on this road. Mr. Loftis said that there have been some close calls. It is difficult to understand how narrow the road is. He measured the road and did a guide on how wide it is. He figured out wide a Subaru is. (He presented a sketch during his testimony) A Subaru has to give a five foot safe passing zoning per statute. The cyclist has to be able to fall. The assumption of guilt is on the motorists. The Subaru has to be over the center line to pass a cyclist. His wife has a Suburban, which would have to go two feet over the center line. He drives a tow truck, which is 8-1/2 feet wide and thirty feet long. He is terrified that he will hurt someone. This is a life and death issue for those who live on Skyliners Road. He has driven home in his lane, with numerous curves with limited sightlines. There is not a lot of reaction time. Having to pass cyclists could lead to a head-on collision. The permit says the riders can go three feet from the fog line. That puts the Subaru more than halfway into oncoming traffic. A larger vehicle ends up into the other lane entirely. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 8 of 17 Pages Century Drive has bike lanes. It is 14 feet wide. His tow truck can go on this with no interference. There should be no discussion about having events there. He asked the County to consider the wording. How can a driver comply with Oregon law on Skyliners Road. How would the County define an unsafe condition. The other issue is when there are cyclists on both sides of the road. From the perspective of risk management, there is no way a motorist can go up the road during an event any faster than the slowest rider. There is well documented evidence that the road is not safe. Commissioner Baney asked about handling recreational riders. That is the vast majority of riders. Should it be closed for this in general. Mr. Loftis understands that there is not a lot of control over this, and education is important. He would like to see all cyclists have a license. General rules being posted would be helpful. Last year the residents were willing to have the road shut down for an event that brings in millions of dollars. Other events should be shuffled off into other venues. There were two events in particular, US Elite National and Cascade Cycling Classic, which bring in a lot of money and should be accommodated. But this would mean shutting down the road for a few hours. But the professionals will be on that road for weeks in advance. He would help in this regard but it needs to be safe to drive home. Jim Terhaar, a resident, said he is an avid cyclist. He seldom rides the road because he knows how dangerous it is. Most of the problems are with recreational cyclists. The events, like the Thursday night events, are relatively low impact. The riders have been courteous and the events are brief. During the Cascade Cycling Classic was interesting but there was an issue of being escorted by motorcyclist police officer, as most cyclists had to ride the center line. It was hard for a car to fit through this and some of them were not going to move over for anything. However, the road was closed. The bigger issue of the events is that it does bring people in to train. There are a lot more people out there during the weeks before the races, and the roads are not closed. They ride two abreast. When the junior events were I training, the parents were in pace cars, trying to be safe. They don't move over so you have to wait for them. This is not during the event. So the events bring more cyclists onto the road. Until the road is fixed, it is not a safe place. It is a great road for them and a good course, but the road is in too poor shape. There are too many cracks and potholes on the sides, forcing cyclists to move into the lane. A police escort is needed to get home during the events when the road is closed for events. Minutes of Board of Commissioners' Public Hearing - Skyliners Road Monday, February 8, 2010 Page 9 of 17 Pages Commissioner Baney said that this is called a partial closure for residents. Commissioner Luke said the tourists like to use the road, too. Mr. Tehara indicated that he hasn't noticed problems with this, but if driving it for the first time they might not know what to look for. Kelly Esterbrook of Skyliners works for the Forest Service. She is not there to talk about inconvenience of events or conflicts on the road. She is there to express her concern about the safety and hazards. In her career she handled risk management for fires, and dealt with the forces coming into alignment that create tragedy. The events play into this. She feels there is a pending, imminent problem. There have been issues. Specifically, there are the following. Road speed is 55. It is narrow and in terrible condition with potholes, large cracks and in some places no shoulder. The curves. The blinding sun, when the majority of recreational riders are out there after work and you can't see through your windshield. Another hazard is snow. Riders do use the road in the snow and snow removal does not get the snow on the sides. People drink and drive on that road. She has cleaned up enough cans on the road to know. Putting all of those things together is a pending tragedy. Sun, potholes, bad road, there have been two instances when a bike on her side met up with a car and vehicle coming the other way. This should not occur. The cyclists can't get off the road. The bike events designate the road to others who may not know the road or how to properly bike, that it is okay. The drivers will be found to be at fault. The biking events bring more and more users. Regular citizens start using it, and it gets caustic sometimes. Adding an officer to an event is one thing, but doesn't help the situation when there is not an event. People need to realize that it is not a safe place to ride. Letting events happen there is an endorsement that the County feels it is safe. Bob Storjohann expressed concerns about the safety of the road. He feels that events promote the use of the road. Other issue is that OMNI has moved out of the Skyliners Lodge, and the potential of another user with more vehicles is a possibility. And Tumalo Lake has two new buildings going in. He was on snowshoes up there and it appears a new bike trail is being mapped out. Maybe the Forest Service is in charge of it. The name of it is Jet 14. is marked off with placards stapled to trees. It is more activity in the area on a road that is not the safe already. It intimated that the cars should share the road with bikes. It should be both. It made him realize that the bicyclists that are taking advantage. It is mainly the recreational bikers. Like other residents, if you honk at the cyclists they don't seem to care. They stay two and three abreast. He would like to see the local governments lobby to get the road done as soon as possible. 2016 is not good enough. The road is not safe enough and putting bike events that promote further use is not a good thing. Commissioner Baney said the reconstruction of the road is a priority. Mr. Storjohann said that the residents should probably lobby the representatives as well. Commissioner Luke stated that it would help if they would make more funds available. He said if the City and County did the work early and the federal government would refund it later, that would help but he doesn't know that this would ever happen. He added that the County has been fortunate enough to do some roads with this fund. Chad Sperry said they promote and produce the Cascade Cycling Classic and other events. The community of Bend is a real gem. They have been working hard during this bad economy to promote these. Cycling has seen a strong growth and people are willing to travel and spend money to do this. It puts millions of dollars into the community. The average time for each event is about three hours. For ten events, that is only about 30 hours. This is a small impact when compared to recreational riders. He does not know how this can be fixed. The events do cause a delay in people's lives. They want to minimize the impact. They will continue to try to minimize this. An event will create some kind of delay. Part of the delay is because of flaggers on both sides of the road. They want everyone to be safe. They try to safely escort people through. They need to push the education piece. They can educate competitors and the general public. As far as the number of competitors pre-training, out of the 725 competitors, only 26 were from Bend. The US National only had 15 from Bend. Most are coming in from other areas. There will be a few pre-riding the courses but not that many in comparison to recreational riders. They have looked extensively for a different venue. The road is not optimum. They have looked a lot, but need a road that is relatively flat with the mileage they need, from 10 to 20 miles, and a key part, parking for 200 to 300 vehicles. The high school is the only area in the Bend area that works. The alternative would be taking the event outside of Bend. There could be Sisters or Madras that might be equivalent, but it would remove tourist dollars from Bend. They are looking at alternative situations. Commissioner Baney stated that this has become a tourism cycling community, and she thanked him because this has brought the community together. At what point do they look at a road and decide if it is conducive. Mr. Sperry said that they are looking at other areas. They need major parking with a road adjacent to it. Commissioner Baney asked about using snow parks. The County could partner and makes some of those calls to other agencies. Ultimately when the road is closed to rebuild it, that will have to happen. There could be ways to do this ahead of time. The Cascade Cycling Classic is the holy grail of cycling, and she wants to remain a partner in having this happen. Mr. Sperry said the CCC is a community event, the longest running professional event in the U.S. They are definitely looking for alternate sites and will continue. They'd like to keep Bend as the hub. Commissioner Luke said the Tetherow area does not have that many residents. Perhaps that area might work for this. There are some opportunities. Perhaps a parking area and transportation can be arranged. Commissioner Unger asked if Mr. Sperry has been to Europe. He said no, just this country. Commissioner Unger asked about Europe's smaller roads. There will always be a conflict between vehicles and bikes, usually the recreational user. Mr. Sperry stated that cycling in Europe is more widely accepted and the events get better support. That is the NFL there. It is a different mindset. Commissioner Unger asked about anything that could be done to make things better. Mr. Sperry said that they could do a better job policing the area before the events. They have seen a number of cyclists coming in several days before the events. It is a good source of revenue, but they also want to pre-ride the venue. They don't need a follow car and there can be penalties for this. Their risk factor goes up outside the event as well. Mr. Sperry said there is a technical guide, but information several days before that event would be good. Commissioner Unger said that it would be good if recreational cyclists could get similar information. Commissioner Baney stated that the events are important, as is safety, and they will do what they can to help with this situation. Mr. Sperry said the do different things in different areas, and they could help with pushing harder to make the road safer. He would help in whatever capacity he can. Dave Kanner said that he has driven through Tetherow. He asked if anyone has looked at that location. The roads are new and challenging. Mr. Sperry said they used a portion of it. It is only five kilometers, and was used to extend Skyliners to be able to comply with the race rules. He said that part of it has been parceled off and they have to work with those who have gated portions of it. Commissioner Baney said to not the issue of a private road to hinder progress. Commissioner Unger said they have to train people here that they have to drive to Mt. Bachelor to ski, as it is not out the door of the hotel. He said that Century Drive might be an idea. Mr. Sperry said there is a huge topographical issue and elevation problems that don't comply with the national and international roads. Commissioner Luke asked what they look for when seeking a venue. Mr. Sperry said that it is lightly traveled road in comparison to many others. The second component is that there can't be major elevation changes. Flatter is better. Distance is the other issue. It is long enough; has to be 12 to 20 miles. They can't connect with other road anywhere else. They have looked at China Hat Road, but parking is a problem. Tad Hodgert said that he promoted events for years, here and in other locations nationally. He lived at Skyliners for 15 years as well. When weather permits, he rides the road regularly. He heard that time trials have been put on for six years, willing o make that commitment. He agrees that the recreational cyclists have some bad apples He has not flipped off any of his neighbors and has ridden the road for decades. He has never had a bad experience except when being passed by large equipment or semis. The mindset needs to change. The road is far better than roads in other countries where they have famous races. The national championship events in Europe, there are not recreational cars. The roads are skinny and shut down. We've finally gotten to that level. Skyliners has been written up for decades and is cycling nirvana. The road can be shut down during time trials for brief periods of time. Running escorted cars with police during the event is not the answer. There is no room for this. The little events have educated cyclists and the impact is no different than recreational cyclists. He rides the road to and from work. He agrees on getting the road fixed. He has been pushing that for years. It has been at least twenty years since the last chip seal. The problem is not the events. The little events don't create many issues. The big events should be treated as such. About 20% of tourists visit Tumalo Falls. The road should be shut down for 1-1 /2 hour segments for few days. Those people who come here from around the world are not the recreational cyclist who cause problems. It is really simple. Commissioner Unger stated that it is the mindset. He got passed by someone driving too fast when he went up the road. Commissioner Baney asked about signage, `single file only'. Mr. Hodgert said yes, until the road is better. She asked about the speed and whether speed should be reduced. Mr. Hodgert does not think it is an issue. Commissioner Luke stated that is determined by the State. Commissioner Baney asked if it is a hazard to honk when passing. Mr. Hodgert says that rookies tend to look to see what is coming and can lose control or weave. Commissioner Luke said that the road to Alfalfa has the same problem. Mr. Hodgert says Oregon law says two wide is legal. He stated that there is an image of Bend as a mountain town. They don't want to be in the desert more than necessary. Everyone likes to see the mountains in photographs. Chuck Kenlan of MB Sports Education Foundation said that the Cycling Classic is their event. It is a fundraiser for them. One reason the Cascade Cycling Classic is the longest running in the country is because of loyal sponsors. They are local, not national. The community supports the event. Similar events that got big and went national found the races go away when the sponsors go away. By moving the events away from Bend decreases the value of the event. He said that a lot of work has gone into this and he feels it is a decent compromise to limit some events. Mr. Kenlan talked about time trials, distance and terrain. They have looked for venues and there are some that will close the road for an event. They would love to close Century Drive for a few hours but it is unlikely that will happen,. The Forest Service won't close any roads for this. Levi Lightheimer came here. He is one of the best riders in the road. He one a medal at the Beijing Olympics. He supports the resolution. It is not perfect but a good compromise. He wants to speak as a user. He has been in Bend for 22 years. During the spring and summer he rides the road several times a week. He has never felt endangered on it. He uses it also as a motorist, to visit Tumalo Falls and to access mountain bike trails and to fish. He has driven during events and did not feel it was a risk. He may be more aware of cyclists and potential hazards, but never felt that he was risking a cyclist's safety. He feels much less safe on other roads here. He rides about 4,000 or 5,000 miles a year. He has also ridden in Europe. Commissioner Luke said there are discourteous drivers and cyclists. He stated that both sides need to be more courteous. The cyclist is not going to win if there is a problem. Mr. Kenlan said that both need to be safe given the conditions at the time. There is a manual at the DMV on how to ride bikes. His organization coaches about 60 to 70 kids on cycling in the summer, including bike safety. They go on roads, trails and city streets. They want kids to be able to bike to school if they want to. Commissioner Unger said that construction will happen eventually, so a different location will have to be found at least short-term until that is done. Mr. Kenlan said this is the fourth year using this for time trials. U.S.A. Cycling said that they have to have a closed venue. It has been done on other roads in the county. Skyliners seems to be the best match. And there needs to be room to park the vehicles. John Gobershock helps with cyclists. Just as there are people who have a license to drive who should not do so, there are cyclists who should not bike. It takes just a few bad eggs to make a bad impression. The event participants are aware of the hazards. The avid cyclists try to education the recreational cyclists. Communication is important, and the recreational cyclists need to know that their improper actions can risk losing the events. Commissioner Unger said this could help change the culture - safe cycling, safe driving and make money at the same time. Tim Edwards of the Sheriff's Office stated that the Sheriff's Office was opposed to events on that road in the past, but have softened their opinion. They realized the tourism dollars, which are important and want to do their part to help make them safe. There should be no illusion that a deputy will make the event safer. One deputy on ten miles of road won't make that much of a difference, but might help remind people to do the right thing. Commissioner Unger asked about cycling for two hours and driving for two hours, limiting the use of either for periods of time. Capt. Edwards said that the organizer should do this. Commissioner Luke said this would be six or so times a year and perhaps they can plan around it. Capt. Edwards said that if you know what to expect and it is accurate timing, that would be helpful. He has to live with the Sisters Quilt Show each year. Commissioner Luke said someone asked about the City police. Capt Edwards said they have the same jurisdiction to enforce State laws. He does not think the escort is a good idea. It makes it too complicated. Commissioner Unger stated that it appears any can enforce a State law. Capt. Edwards said that most traffic law is State law. Mr. Kanner observed that one thing that was discussed was the idea of imposing certain conditions in the permit as a Code violation, only the County could enforce that. He is not sure how much of an impact a Code violation would have on event organizers since the penalty is not that significant. The presence of a deputy or reserve deputy might have an impact on compliance to the conditions. Many Code violations are enforced by the Sheriff's Office. Commissioner Baney stated that this was prompted by the partial road closure when the road was actually closed. Capt. Edwards said that rather than swear in City officers, he would rather use just his people. Commissioner Luke said that this is not a land use hearing and he does not want to let individuals speak a second time. Commissioner Luke said that testimony via e-mail or in writing is welcome. Commissioner Unger asked about the next step. Commissioner Luke said there will be further discussions and probably a decision prior to the end of March so people can plan accordingly. Yes. BACKGROUND AND POLICY IMPLICATIONS: Events that take place on a County right-of-way require a County permit as detailed in Deschutes County Code Chapter 8.16. The County event permit fee is $35. Skyliners Road has been a popular location for events. The chart below shows the number of permitted events using Skyliners Road as well as the number of "event days" (some events run multiple days) from 2005 - 2010. Residents in the area have expressed concerns about events that use Skyliners Road. For some events that use Skyliners Rgad, the permit has included requirements that the event organizer notify the neighbors; cyclists stay within 3 feet of the fog line; and emergency vehicles, local traffic, and service and delivery vehicles will continue to have access. Staff organized a meeting on January 13, 2010 for residents of Skyliners Road and event organizers to discuss the 2009 event season, areas for improvement, and potential solutions. The feedback from the residents included the following comments: some event riders stayed in the middle of the road even when the resident was following a Bend Police motorcycle serving as an escort; the turnaround points are dangerous due to shadows, curves in the road, and inexperienced flaggers; prior to events a large number of cyclists practice the course and some unsafely ride more than 2 across the road and some are accompanied by a slow moving car following the rider; pilot cars are not helpful; and all events on Skyliners Road are not safe and should not be approved until the road is reconstructed. Suggestions from the meeting that had general support from residents and event organizers included adding a sign along the road informing cyclists to ride single file, more enforcement of cycling laws during the event and at other times, and more education for the cycling community. There are planned improvements for the road. Skyliners Road is on the Forest Highway project list for 2016. Deschutes County and the City of Bend have asked that this project move up due to the planned waterline replacement beginning December 2011, the overall deterioration of the road, and safety issues. The Road Department has serious concerns about the inability to maintain the road if it is not reconstructed by 2013. I hope you'll understand, then, the only way to eliminate the injury potential to both motorists and event-bicyclists on Skyliner Road is to eliminate the events. I don't write that with tongue in cheek, but with the understanding of one who has owned property in Skyliner for 45 years and of one who has lived there for 15 years. I've seen a lot of bicycle traffic on Skyliner Road. I wonder if you (or whoever has sanctioned these events) has examined the road from the Aubrey Hall burn to Skyliner? The road, of course, has a number of blind curves, including two double-blind S curves at mile 5 and mile 7. And the road is narrow all the way from the burn to Skyliner, not permitting in the best of conditions a bike lane wider than 18". But in fact what little bike lane there is varies mostly from very narrow to entirely crumbled away. So even the most conscientious bikers rarely ride inside what little bike lane survives. To cap the roadway danger, at all times of the day, light conditions on the road surface flashes back and forth from intensely bright sunlight to shadow: at times, one driving, at any speed, in a bright stretch simply can't see a biker in shadow ahead, whether the biker is inside or outside the bike lane. Further, I know you mean what you say when you impose stipulations. Inconvenience and irritation aside, though, I'll point out the bikers don't appear well schooled in the stipulations. During the event of 7/23/09 I was driving home from town when I approached one of the turn- around points, the one at the base of the mile 5 S curve. The "certified" flagger had her shade 2/8/2010 Page 2 of 2 canopy set up in the shade (who wouldn't want shade in the heat of that day?). As I approached, driving in a patch of bright sun, I saw the canopy and slowed down, at the same time passing a biker who was on my right. I could see the flagger moving around. But the shadow kept me from seeing what she was doing; so I slowed down more. As I neared the flagger, I could see she was waving what appeared to be a sign, but the sign was in shadow and not recognizable from the patch of bright sun. 1 could see the flagger waving the sign with one hand and giving a hurry- up come-on waist-level wave with the other. Was she signaling me to hurry up and pass the turn- around point? Who knows. But I assumed so and kept moving, slowly, thank goodness. At that instant the biker I had just passed, shot around me from the right side, directly across in front of my truck and headed back down hill. Close call, indeed. You might want to know also, even though the stipulations so prohibit, a number of the bikers rode two and three abreast, certainly more than three feet from the fog line and in fact taking up the whole right lane. Others riding singly ranged back and forth across the whole right lane. This after all is a time-trial race, and the racers are intent on making time, not on residential traffic just wanting to get home. As a Skyliner resident, I certainly have a vested interest in the outcome of your sanction of bike events on Skyliner Road. But please know I also have decades of risk-management experience: I'd certainly risk-management point of view recommend strongly against sanction of these events. In any case 1 hope you'll take the time, if you haven't already, to do a mile-by-mile in- person assessment of the bike/motorist hazards present on Skyliner Road. Transportation funding in today's world takes partnerships between the state, federal, private, and local government sources. If you are referring to South Century Drive work that was done this last summer, that was a federal project. The County helped with securing right of way, but it was their project and their funding. The state requires bike lane on most roads that are constructed new or are major repaving projects. The River/Summit Road you mentioned was a project that was over ten years in the planning and funding stage. The majority of the funding for that project came from the Federal Forest Highway fund (around twelve million dollars) with a little over a million dollars coming from Deschutes County. The Forest Highway Fund is the same fund that will be used for Skyliner Road. Once your project is selected for that fund, it takes from five to ten years or more for the funding to come through. The Forest Highway fund was also a part of the money used for the Sun River Interchange. The rest came from ODOT, Sun River Corp plus the Sun River Homeowners, with the biggest share contributed by Deschutes County. In the past, ODOT would have been the biggest contributor to the Sun River Interchange, but that is not always true anymore on state projects. Until the forest payments to Oregon counties was extended and the recent gas tax was approved, Deschutes County was looking at what roads could go back to gravel. Funding for road construction has not kept pace with the demand. This is not a complaint, just a fact. While Skyliner Road is an important road, the funding the County has needs to be prioritized to the projects that served the most vehicles per day. This is not true just for our county, but all levels of government that have roads to build and maintain. What may seem like wasted money to you is a wise investment to those people who use the projects that were funded. The Forest Highway Fund money is awarded on a competitive basis. A project in Deschutes County competes with other projects in Oregon. There is a great demand for those funds. We were very fortunate that Skyliner Road was chosen. Dennis R. The proposed 2016 delivery date creates concerns for the City of Bend, including the following: The City is working collaboratively with Deschutes County and USFS to install a major water line concurrently with the re-pavement of Skyliners Road, in an effort to efficiently utilize tax dollars by re-building the road only once. The waterline is scheduled to be constructed in FY 2011-2012, creating a substantial timing gap for the project, and significantly inhibiting our ability to move forward with the single largest water infrastructure need in the City of Bend, affecting 50% of the City's water supply. ■ Skyliners Road is a pivotal multi-modal route for citizens and visitors to Central Oregon. The condition of the road is deteriorating, which makes the route potentially unsafe for bicyclists and motorists. Investing in our local recreational assets, this route in particular, is critical to our continued success in attracting tourism to our community while ensuring safety on this road. We were very concerned to see Skyliners Road project lim been programmed for a likely 2016 delivery. There are a number of reasons for our concern: ♦ The proposed route is the primary access for both winter and summer recreation use in th-- Deschutes National Forest as well as serving as access to the Skyline subdivision (50 lots) arnd the water intake for the City of Bend. Recreational use consists of the Tumalo Falls Recreation site, several trailheads for mountain biking, hiking and cross-country skiing and also access to the high county (Broken Top Trailhead). ♦ The City of Bend is planning on replacing a waterline from the intake facility located abol e Tumalo Falls into the City of Bend and this waterline will be located within the Skylines Road right-of-way. Construction on this pipeline is expected to begin in December of 2011 and be completed by December of 2012. It would be beneficial to all agencies involved, (City, County and Federal Highways), to have these projects occur simultaneously and there is a good opportunity to combine resources to reduce the overall cost of both projects. ♦ There is a very realistic concern by the Road Department that they will be unable to maintain Skyliners Road in a drivable condition for much longer considering the condition of the existing roadbed. Initial estimates by our engineers indicate that if the road is r.ot reconstructed by 2013, it may have to revert back to a gravel surfaced roadway as i he pavement is in poor enough condition that an overlay or patching would not hold up throug 1 a winter season. Enhancing the Lives of Citizens by Delivering Quality Services in a Cost-Effective Manner ♦ This route is also identified on a plan being developed by the Deschutes County Committee on Recreation Assets as a Phase I project. This committee is made up of representatives of Deschutes County Commissioners, Bend City Council, City of Sisters, City of La Pine, City of Redmond, Sunriver, La Pine Park and Recreation District, Forest Service, Bureau of Land Management, Oregon Department of Transportation, Bend Metro Park and Recreation District, Economic Development for Central Oregon, Mt. Bachelor Ski Area and several organized cycling and skiing groups. ♦ Skyliners Road is a very popular venue with road bicyclists. There are several races held each year on this roadway, including the Cascade Cycling Classic, and it is a popular training site for area cyclists. The condition of the road, (i.e. potholes and cracking of the surface, deterioration of pavement edges and lack of shoulders) make this an unsafe road for both cyclists and drivers. There was an accident between a cyclist and motorist in the spring of 2008 that resulted with the cyclist being taken to the hospital with serious injuries. ♦ The proposed project would accomplish the transportation goals and objectives stated in the Deschutes National Forest Land and Resource Management Plan. Skyliners Road provides sole access to approximately 77,000 acres of national forest land. It is the primary access for fire suppression in and around the subdivision and the City of Bend Watershed. As this road continues to deteriorate, emergency response time will be negatively affected. ♦ Traffic counts conducted by the Road Department show a value of 926 ADT midweek and 1202 ADT on Saturday. Taking into account the traffic generated by the subdivision, this calculates out to 74% forest use midweek and 81% on Saturday. These counts were done in May and we feel that number will be higher during the summer months. Counts done just on bicycles in July showed 102 cyclists on a Wednesday and 153 cyclists on a Sunday. ♦ Central Oregon has been recognized in several magazines as a top area in the US for cycling, both mountain and road bikes. Skyliners Road is a key aspect of the bicycling experience in Central Oregon therefore we feel it is a very high priority for reconstruction funding through the Federal Highway Program. We fully understand the project funding limitations imposed by the Forest Highway Program budget. However, we would ask the Tri-Agency to consider the importance of this route to Central Oregon, both as a recreational asset and economic resource when making the final Forest Highway program decisions. I am always concerned regarding safety of both bicyclists and motorists. We live in a complex time involving climate change, rising healthcare costs and an obesity epidemic. Limiting bicycle access seems to be counter-intuitive to future benefit. It would make more sense to ban automobiles from skyliner road. I would like to propose a speed limit reduction on skyliner road. If motorists didn't feel like they needed to maintain 55mph then safety for both bicyclists and motorists would be enhanced. I realize that one of the issues has been near head-on collisions with cars passing bicycles on blind curves. No cars should ever pass on blind curves or hills. This is illegal and unsafe. Maybe the motorist could slow down and pass when safe instead of jeopardizing the safety of bicyclist and motorists alike with unsafe passing practices. We cannot limit rights of bicyclists just because motorists want to go to fast for conditions. For the health of our community we need to maintain a strong pro-bicycle position. Over and over again, I read in the news about bicycle and automobile conflict. It seems that bicycles always lose this battle. Once bicycle rights are lost, they are almost never regained. Until a bike lane is built on all roads, bicyclists have no choice but to share the road, perhaps the cars could do the same. Fresh Air Sports does a tremendous job of mitigating safety concerns during their events. Cascade cycling does also. Please do not limit access for bicycles. Lower the speed limit! It has been my experience to encounter these folks in their team pack, generally taking the whole travel lane, and reluctantly yielding to vehicles. Becasue of this, I ask that any reference to this letter holds me anonymous. Thank you. As a frequent user of Skyliner for both training and racing, there is no question that changes need to be made. There have been valid points shared about how great Bend is for cycling and how many tourists cycling brings to town. Everything I read names Bend as the destination, not Skyliner Rd. There are major events that make use of that road, but not all events are major. The other events are basically ruining the image for future use. I would like to see stricter policies for use of Skyliner as an event location. Perhaps mininum participation levels. If an event doesn't have atleast 100 participants, access is denied. Regardless of the criteria, a weeding out process seems to be necessary. Too many events use the same location. If Bend is such a great place for cycling, I'm willing to bet there's more than one road that offers the racing opportunities that Skyliner has. Perhaps it is the responsiblility of the County to help spread these events out. Place caps on roads that will not allow too many events on the same road. The only solution I see now is to limit the number of events using Skyliner to ensure the safety of ALL who use the road, riders and residents alike. Thank you. Recreation is a big part of Oregon, and Bend in general and it needs to remain that way. As a professional cyclist who logs many of hours on every road in our city and county, I feel that Skyliners is a special gem that should not be taken away from the large community of cyclists. There aren't a ton of ride options in Bend that allow you to get on your bike and not have to negotiate round-a-bouts, traffic lights, intersections, and driveways for 1-2 hours. This particular road climbs gently out of Bend and is perfect for any rider looking to challenge themselves. I think that the handful of residents that have a problem with cyclists in general on the road are themselves the problem. Simply slow down for the 30 seconds it takes you to pass. Banning cyclists from the road isn't a reasonable solution. As for events, part of living in a community is dealing with other people and their events. Citizens downtown deal with summer festivals, munch n music, art walk, etc, as do those around the Old Mill. 10 - 12 events a year isn't going to kill anyone and it's unreasonable to ban events from Skyliners. Until then we could put "share the road" safety signs up. Skyliners would be safer with a bike lane. I am one of the people you see up there almost every day and I am pretty sure no one rides Skyliners more than me. I feel a normal or better sense of safety on Skyliners compared to other roads. There are many roads in central Oregon that I feel are more dangerous to ride on. Hwy 20, Hwy 97, any road in town, Cline Falls road, Old Bend-Redmond hwy, Alfalfa market road, etc. I am sure you could survey residents of those areas and they would like to ban cycling on their roads as well. This seems to be a classic "not in my back yard" case to me. As cyclists we decide where to ride or not, it is our right to ride on whichever road we choose, except freeways. Bend has been quickly gaining a reputation as a great area for cycling. Pro cyclists have been moving here and amateurs follow their lead. Skyliners road is a premier road for training, racing, and recreational riding. Little traffic, perfect grade, close to town, and an aesthetically pleasing place to ride. Skyliners is also used by mountain bikers like myself that like to ride up the pavement and down the dirt trails. There have been many occasions over the years where I have used Skyliners as a bail out option when I am having a bad day because of bad weather, weak body, malfunctioning bike. At times it has been a real blessing to have an easy way back, potentially a life saver. I have seen many other mountain biker's use Skyliners for this same reason. I feel we should promote people riding up skyliners to access mountain biking areas. Many people drive a very short distance to park their cars at crowded trail heads and ride their bikes. I wish more would just ride from home. Widening Skyliners with a bike lane would be a good investment for the county as we have a chance to continue to be one of the most talked about areas in the west for cycling and healthy outdoor living as a whole. I would like to speak out in support of continuing safe bicycle use of Skyliners Road. Having ridden a bicycle up and down this road for years without any significant incidents, I can say with certainty that this road provides a safe, low-traffic, yet challenging bicycling venue for the Bend community area. On almost any day of the year cyclists can be found along its length, simply enjoying a pleasant morning ride, a strenuous but individual athletic challenge, a group recreational experience, or, on rare occasion, even a permitted competitive event. Now, I understand, some people residing along Skyliners Road find our bicycling use of the road inconvenient, unsafe, or even" offensive" and wish to restrict, or even eliminate, such use. What an amazing, self-centered and selfish request. Bicyclists have been safely using this road for generations - often long before many of these "residents" moved into the area. Bicycles weigh twenty to thirty pounds, have no emissions other than the exhalations and occasional sweat from an ascending rider, and rarely reach speeds anywhere near the posted speed limit. Many of the "residents" along Skyliners Road seem incapable of driving to their homes in anything other than the largest, gas-guzzling SUV or pick-up, vehicles that frequently weigh well in excess of 4000 pounds, and vehicles that appear to often be driven well in excess of the posted speed. On this road, a county road and PUBLIC byway, where all vehicles are entitled to make safe use, perhaps the "residents" and their vehicular use need to be re-evaluated. Perhaps the "residents" of Skyliners Road need to be reminded that under Oregon law a bicycle is defined as a "vehicle" and is entitled to make all safe use of the public roads of Oregon (Oregon Vehicle Code, section 801.590). While Oregon traffic laws do provide some restrictions on "safe" bicycle use of the roadways, they do not provide for a prohibition of use or other unreasonable discriminatory restraint. If the "residents" are concerned for MY safety as a bicyclist on Skyliners Road, then perhaps a concerted effort on their part to practice safe driving habits, at safe speeds, would be helpful. I cannot imagine how my bicycle use of the road can pose a safety hazard to the commuting "residents" in their multi-ton steel cocoons - but stranger arguments are apparently being presented. And, if the "residents" along Skyliners Road find the infrequent permitted competitive event "inconvenient" then I would remind them that the events are "permitted" - often with significant restrictions as to time and number of participants. Public notice of these events is made days, and often weeks, in advance to reduce user conflicts. "Residents" have always had the ability to comment to the City, County, or U.S. Forest Service when these organized event permits are issued to identify problems and mitigate impacts. I would also remind these "residents" that these same competitive events are a significant source of community revenue, revenue available to maintain the very road under discussion. If the "residents" of Skyliners Road wish to treat the road as their private driveway, then I suggest they step up and start paying the real costs for maintaining this road, for policing this road, for improving this road. The rest of us, bicyclist, tourists, and other users alike pay our taxes for the construction and maintenance of this road. All WE ask for is a small share in the use of it. If the speed limit was 45 mph their trip home would take 11 minutes, they would save gas and not be a danger to themselves or others using the public road. 2. Central Oregon attracts many residents based on the activities that are available here. Bend is a small town, with a big reputation due to these types of events. Please sustain the status quo and keep allowing the few events that take place on this road per year. There should be more reasons for citizens to get out and exercise and take part in an event like this. I'm afraid this effort is mostly the work of two homeowners up there, and witnessed them last year handing out donuts in exchange for signing a petition. Dear Commissioners- I am writing to voice my support in keeping Skyliners Rd open to all cycling events. I regularly ride Skyliners Rd, both as a competitor in the weekly summer time trial series and as a casual rider with my kids in the bike trailer. The scenery is beautiful and should be shared with the entire community in the most eco-friendly way possible. I have heard the arguments from residents regarding safety, but to me its sounds like they are coming from a small handful of "keep those kids off my lawn" types, the same people who drive down the road at reckless speeds and are inconsiderate to bikers and other motorists alike. I'm sure they would love to have Skyliners as their own personal driveway, but as taxpayers and citizens we have as much right to the road as they do. The reality is the road is one of the least busy and safest roads one could want to ride, and that 100% of the danger comes from the occasional speeding driver. If you were to lower the speed limit to 35 mph, for example, it would give drivers plenty of time to see bikers and react, making the road instantly safer for bikers and motorists. If money became available for bike lanes, that of course would be great, but in the meantime the road is plenty safe as long as drivers share the road in a reasonable manner. From health to high gas prices to carbon emissions to our dependence on foreign oil, there are a million reasons to do everything we can to encourage people to encourage people to get on their bikes. Please do whatever you can to keep this road and other County roads like it free and open to both cyclists and motorists. I have lived in Central Oregon for 12 years. When I first moved here, cycling was not as big as it is now, but with population growth, popularity of cycling, and positive acceptance by the Bend community, cycling is a wonderful part of our community now. I have occasionally ridden Skyliners road ever since I moved to this area. It is a wonderful road in terms of scenery and lack of traffic (which equates to safety). I find it hard to comprehend there being a real issue here. This is a COUNTY road, not a private road. In terms of neighbor/community impact, this is a viable option as it does not impact very many families as opposed to other possible routes, and in terms of safety for our cycling community, it is much safer than riding for example on Deschutes Market. I understand that the shoulders are narrow the higher you go, but I also remember that when I first moved to Central Oregon, almost no roads had shoulders, including Deschutes Market, which was scary dangerous, but the County/City has stepped up and made that safer for cyclists and drivers alike. If those who live on Skyliners Road wanted the feel of living in their own private community, then perhaps it would have been better to actually move into a gated community, not a COUNTY road. If the mentality of closing it entirely to bikes is what we are looking at, then perhaps we should also close the snow park entirely as well as Tumalo Falls, so that people in general are not allowed access to this "private" road. I have lived in Terrebonne and Redmond since my birth in 1979. I ride many of the roads in Deschutes county, ones close to my home, and also many in bend and tumalo. When I go out for a ride, or even when I travel by car, it is easy to see that there are many people who enjoy riding bikes on our roads. Safety is paramount. Will outright restrictions keep our cyclists safe? Such as closing certain country roads to bikers? If one country road is closed how many more will follow? All in the name of safety. When cyclists go out on the road, they know the risks. When they choose to ride certain roads, roads that may have limitted space, they know the risks. Since we see these cyclists on these roads, we must logically assume that they have accepted the risks. I know the risks of riding, and riding certain roads, yet I continue to ride. Over the years the number of cyclists have grown, and so have the complaints from individuals who do not like cyclists on the road. Along with this growth has come events that draw people together. Because of these small events and a strong cycling community, we see larger events. Events like the National Road Championships and the National Cyclocross Championships. These events bring in revenue for our communitys and for our residence. Bend is a recreation destination, we need events and venues that bring in tourists. If it means picking a road that is "Safer" and where less people will complain, I believe that the cycling community would be open minded. I would also like to commend Gina from Fresh Air Sports on her hard work and willingness to compromise on event location, in fact she stated she would try to find a different route of similar duration and intensity. Please help her to navigate the permit process quickly and expedite her changes for this year's events. Many of us in this community raised safety concerns with the County permit office, the road department and the Sheriff's office last year in June when Fresh Air Sports began running a series of cycling events on Thursday evenings As you may know, Skyliners Road runs East West. These races put drivers going home looking directly into the sun at risk. I have sent several emails detailing the poor road condition, narrow lanes, the lack of a bicycle lane, deep shadows- especially early and late in the day to Erik. We were told last year that the event permits were issued and nothing could be done until new permits were applied for by an event coordinator. I and others asked to be notified if any permits for events on Skyliners road were applied for specifically so we could influence the process and have the events take place on other roads more suited to public events. In spite of assurances to include us permits have been issued for another series of racing events by Fresh Air Sports and other groups using Skyliners Road. In addition, another race took place last weekend with no solicitation of comment prior to the permit. That race blocked the road and as John stated prevented several service technicians from making appointments. To me, it seems that our legitimate concerns about safety and access have not been given due consideration. No attempt to solicit comment from our community was made until this June 3, 2009 meeting. One week prior to the first scheduled F.A.S. race! And, more troubling to me the meeting was not structured to determine viability and public safety on the course as a precursor to issuing permits. As I perceived the meeting it seemed designed to make us "feel included in the process" while Erik jammed his predetermined outcome into our lives. So far as I know, essentially by a notable absence of any reference, no attempt was made to actually determine the fitness of Skyliners Road for racing events in spite of the fact that Erik among others knew there were voiced safety concerns and written commentary from last year. I make this assertion based on an email Erik sent to me " The purpose of the meeting is to have a discussion, identify the issues (such as those you've identified in your e-mail) and explore options and alternatives. My hope is that all parties will work to find some middle ground. I see the range of options as the event organizers implementing more measures to minimize the impact on the neighbors, scaling back the number of events, or not allowing any events. If there is a policy change to scale back or not allow any events, to be fair to the event organizers, I think it should start next year." Clearly, this meeting was not intended to do anything other than to allow these events to occur as they were permitted with no possible changes in event timing, location or duration. When I asked Erik why we were not included at the planning stage he stated that permitting was an administrative process and there was no role for public comment in the process,; no definition of public safety in county literature; and no appeal to an issued permit if the public felt the permits issued were likely to endanger lives. Surely there is a way for us to drive home safely without resorting to litigation. I am distressed by what I perceive as a cavalier attitude towards our need to have safe access to the only paved road in and out of our neighborhood and an utter lack of regard for our voiced concerns from both last year and this year. From an administrative point of view, it seems the county permit process might be changed to include SOME sort of public comment or access especially when the county offices have been notified of public safety concerns. Secondly, it would seem prudent to have at least some baseline definition for public safety to guide individuals like Erik in decision making. Could you please assist us in protecting our families by preventing any further events on Skyliners road until it is repaired and widened. I would like to restate that I think a properly widened road with wider than normal bike lanes would make an excellent course. Properly designed and built, Skyliners could be a link in a series of purpose designed roads made for road races. Races that could continue to drive tourism dollars into Deschutes Counties revenue coffers. I would be more than happy to have a race a day on a road built for dual use. From his description, it sounded like these events are generally permitted with some thought given to number and training of volunteers to meet the undefined goal of "public safety". I challenge all of you to drive out Skyliners just once and imagine if there is any way to hold a bike race "safely" with traffic on a road deteriorating from both sides, already restriped narrower (federal scout measuring it last week stated it was 9-9 % foot lanes where my SUV is 8' 9"), trees so close the branches overhang the road in places, and commuters driving in to the sun both ways, rendering cyclists in the shadows invisible. These conditions make it extremely dangerous both for bike/auto interaction but also for head on auto collisions due to autos trying to get around bikes in unsafe conditions. No doubt, once the planned road expansion is finished with bike lanes, races will be much safer. For the nearly 200 of us that live on Skyliners road or the Skyliners neighborhood, this is our only way in and out so closing it is not an option, especially for emergencies or for those of us that must get in and out for work. Several contractors attempting to get to the neighborhood were turned away at the recent Cycling Classic event, even well after the posted hours of closure. Erik stated that there is a process for permit applicants to appeal if they are declined, but no process for opponents to appeal. How do we stop a very unsafe practice until the road is widened? We've seen the serious bike/auto accidents on this road. Put the races on Century drive with full bike lanes, asphalt in good condition, and trees cut back for great visibility.
