Luke, Alan Unger and Tammy Baney. Also present were Dave Kanner, County Administrator; Erik Kropp, Deputy County Administrator; Mike Dugan, District Attorney; Tom Anderson, Community Development; Chris Edelston, Finance; Jim Ross, Sheriff's Office; Nancy Blankenship, Clerk; Mark Pilliod and Chris Bell, County Counsel; Tom Anderson and Lori Furlong, Community Development; Sherri Pinner and Vicki Shaw, Health Services; and Carol Garibay, Justice Court. No representatives of the media were in attendance. Chair Luke opened the meeting at 1: 30 p. m. L Finance Update. This item will be addressed at the Monday, May 3 work session. 2. Review of Fee Schedule (Deschutes County and Service Districts). Chris Edleston said that if there are questions about a specific department's numbers, the department director should be contacted. (She referred to a draft copy of the fee schedules, attached for reference.) The first issue discussed was how the service districts and other entities are charged for materials or services. Jim Ross gave an overview of the District 1 and District 2 fees, which have to be followed per statute. The cost for mobile data stations in the patrol vehicles went up because the price increased. The group then discussed each service district's relevant charges. Ms. Edelston explained the cost associated with the use of debit and credit cards. Minutes of Board of Commissioners' Work Session Monday, April 26, 2010 Page 1 of 6 Pages Tom Anderson said he has run this by various building industry groups, and they understand that increases are balanced against modifications and other items. He explained how budgetary changes have had forced him to make some difficult a. Fees on a per unit basis three years ago were quite low, so these will allow for some adjustment. These do not include SDC or any Sate surcharges. Commissioner Baney wants to be sure that the needs of the community are addressed conservatively. Mr. Anderson sad they are equivalent to what is commonplace for other, similar agencies. He wants the fee to be the right amount to cover costs. Commissioner Unger noted that the County does look at other agencies' costs and charges, do a comparison, etc. They try to do cost recovery and stay in line at the same time. Mr. Anderson said that if there are additional costs factors, things can change. It will not go back the way it was anytime soon. Andy High of Central Oregon Builders' Association was asked to provide input. He said he has taken part in the fee conversation, along with others, and they also compare the fees with that of other agencies. Had it been known that the building activity would have dropped as bad as it has, they would have supported a higher fee during the good times to add more to reserves. There is a bit more activity in the destination resort sector. The cost of appeals went up; the question as raised whether there that much increase in staff time? Mr. Anderson stated that it has to do with the 15%. Some are higher, some are lower, but they average 15%. They can track the time and other expenses, and can adjust the fee accordingly. Commissioner Baney noted that they are dropping the environmental health fees. AT&T system fees have stayed the same, and the more response there is, the more efficiently the services can be provided. Nancy Blankenship said that some fees went up due to changes at the State level. Recording fees did not go up last year, based on the CPI, but will go up this coming year. Mike Dugan said that $225 has been received for restitution. Commissioner Unger stated that predictable small increases are better for customers. Minutes of Board of Commissioners' Work Session Monday, April 26, 2010 Page 2 of 6 Pages Sheri Pinner and Vicki Shaw of Health Services said that some fees were deleted and others have increased. Most are direct fees and services through the State. Carol Garibay stated that Justice Court fees are charged by the State, but have never on the County fee schedule before. Dave Kanner said there is no harm in doing this, and it helps to make things more transparent. Erik Kropp briefly discussed the new Skyliners Road event fee. Ms. Edelston stated that the next meeting will be the public hearing as part of the budget process, held a couple of weeks prior to the adoption of the budget. Commissioner Luke stated that he does not feel there will be many changes. 3. Consideration of Economic Development Grant Requests: • Deschutes County Weed Board - Let's Pull Together - Commissioner Luke stated that this is a very successful event. They are getting more participation from younger citizens. The Commissioners granted $500 each. Tribute to Heroes - Traveling Vietnam Veterans Wall - Commissioner Luke said that the Central Oregon Veterans Council has already indicated support. The Commissioners granted $500 each. 4. Update of Commissioners' Meetings and Schedules. Commissioner Baney will be gone this coming Friday and Monday. 5. As the Governing Body of the 911 County Service District. Review of the Procedure for Hearing an Appeal of the Executive Board Decision regarding Becky McDonald. Commissioner Luke said this would be handled as the Governing Body of the 911 County Service District. Mark Pilliod said there is a hearing scheduled at 8 a.m. on May 4, 2010. There is an e-board decision to terminate the director. Under the IGA between the County and user agencies, a provision allows the director to appeal that decision to the governing body. This has been consistent throughout the history of the Minutes of Board of Commissioners' Work Session Monday, April 26, 2010 Page 3 of 6 Pages operating agreements. The Governing Body is directed to uphold the decision unless the Governing Body fees that it is not substantial evidence in the record. This has to do with appellate body's language. It is not looking at a vast quantity; it means sufficient evidence. The operating agreement also speaks to the application of 911 Service District policies and personnel rules. If absent, the default is to the County's personnel rules. The County does have language that deals with this kind of issue. Commissioner Baney asked about options if a different track is decided. Mr. Pilliod said there are two other driving principles. There has to be a violation of policy or an applicable law. There are issues with integrity, professional conduct, ethical behavior and the like. There are distinct and policy behaviors addressed. The form and severity of discipline depends on frequency, background, and severity of the problem. The Governing Body must take all of this into account in finding if there is cause. The Governing Body could reverse the decision. This could mean that the employee is reinstated as Director; or a different disciplinary decision could apply. There could be a lesser form of discipline. The decision-making could include whether supervisory is included. The decision could also be remanded back to the e-board for further discussion and a decision. Commissioner Luke said they could uphold the dismissal but remand it for other considerations. He thought they thought they had two choices. Mr. Kanner said that they did try to negotiate other outcomes. Commissioner Luke asked what right the Director has, as a non-represented employee, does not have the same rights. Mr. Pilliod said she is entitled to the protection of County personnel rules, even though she is at will and can be dismissed for any reason, taking into account Constitutional rights. She is entitled to the same benefits of other employees. Progressive discipline should apply. Mr. Kanner stated that the employer has the right to skip over the early steps of progressive discipline, and the e-board did not violate any law by going to their decision. The question is whether the appeal body can consider whether it is a consideration. Mr. Pilliod said that if the Board wants to arrive at something less than termination, it can negotiate a way to handle this in advance of the hearing. The parties at that time can make certain stipulations, such as a demotion. Letters have been received from others suggesting that this might be appropriate. Mr. Pilliod stated at the time whether it would be a problem to bring her back as a dispatcher. Some of the e-board feel it might work. There need to be stipulations that there was cause; and that the record does not contain evidence that the principle of progressive discipline was not thoroughly discussed or understood. There can probably be no rank and file supervision. She would need to return the pay level she had previously. One concern is that because the position as a dispatcher is under the collective bargaining agreement, she can bid for vacation and schedule times; this could cause a grievance from the union. In lieu of that kind of authority, is to have her waive a right to seniority in that system. Commissioner Luke asked about probation. Mr. Kanner suggested perhaps a shorter probation period might be appropriate. Commissioner Unger said that perhaps it could be specific. Mr. Pilliod stated that there is not an overwhelming amount of trust in the decision-makers. Commissioner Baney asked if she would want to have a full hearing. Mr. Pilliod said if there is a structure settlement, the hearing would be basically scripted. Commissioner Luke said he would welcome a negotiated settlement of some kind. Commissioner Baney stated that there was a lack of judgment, but there appeared to be no consistent pattern of behavior. Commissioner Unger feels that there was a lack of judgment by of more than one party. Commissioner Luke said that she is knowledgeable and an asset to the department, but she lost confidence and cannot be supervisory. The consensus of the Governing Body that the attorneys speak about a negotiated settlement and report back. Mr. Pilliod said that the hearing could be held in executive session if the Board so desired. The employee can ask that it be held in open session. The employee does not have the right to executive session if the Board does not go that way. At this time, discussion took place regarding who should be present. The Commissioners indicated that they did not feel that an executive session would be necessary unless there needs to be a discussion regarding potential litigation.
