Luke, Alan Unger and Tammy Baney; Dave Kanner, County Administrator; Erik Kropp, Deputy County Administrator; and, for a portion of the meeting, Ronda Connor, Personnel; George Kolb, Road Department; Nick Lelack, Community Development; media representative Hillary Borrud of The Bulletin; and twelve other citizens. Chair Luke opened the meeting at 1:30 p.m. 1. Consideration of Board Approval of Appointing OptumHealth Specialty Benefits as Health Benefits Stop Loss Carrier. Ronda Connor said this is the final piece of the latest health benefits plan package. The County goes out for bid for the stop loss carrier each year. The Employee Benefits Advisory Committee recommends this provider. BANEY: Move approval. UNGER: Second. VOTE: BANEY: Yes. UNGER: Yes. LUKE: Chair vote yes. 2. Bicycle & Pedestrian Advisory Committee Proposal of Education Campaign. Cheryl Howard, Kevin Tanski and Eli Ashley of the BPAC came before the Board. Mr. Tanski read a statement detailing the ideas behind the campaign. This has to do with Skyliners Road in the short-term, but the focus is for long- term education and community involvement. A white paper was submitted by BPAC to the Board last April. Minutes of Board of Commissioners' Work Session Wednesday, July 28, 2010 Page 1 of 4 Pages Ms. Howard said they implemented a door hanger which will be available at all bike shops and retailers, as well as quick lube places to give to car owners. Other locations would be public works, law enforcement and ODOT. (A copy of the door hanger is attached for reference) They secured the name of www.bikecentralore og n.org that will help provide information to anyone who is interested in cycling laws, biking trail maps, and so on. Mr. Kropp stated that the County is helping with the media campaign and initial printing, etc. The work is all-volunteer. Commissioner Unger said that there are people on both sides of the issue who seem to cause the most problems. He would like to be able to figure out a way to have these people rethink their behavior. Ms. Howard stated that there are always going to be those who do not follow the rules, both motorists and cyclists. Bend Police Department indicated they plan to do more enforcement in this regard. Mr. Tanski said that the cost of the kiosk planned for Skyliners Road is still an issue that they need to address. The Board and Mr. Kropp thanked the BPAC for their efforts in developing this program. 3. Consideration of Second Reading and Adoption of Destination Resort Remapping Ordinances. Commissioner Baney observed that this has been a long process. It is important to develop policies that are broad and are for the whole County. She feels that this is the wrong thing to do. A lot of community advocacy has occurred. She is opposed to adding some specific language, but the other portions make great sense. The original intent was to make the map smaller. It has not been an easy or painless process. She added that what stands to be lost by not approving this is a lot of good work that needs to continue. There has been a tremendous amount of staff time and effort and community involvement during this process. There is one line item that she opposes, but she does not want to hold up the rest of the very good work that needs to continue. Commissioner Unger said he does not disagree with her comments, but sometimes you have to move forward. She feels, however, that it has not ended with this. Commissioner Luke stated that he does not feel this is a mistake. The Oregon legislature super-sited destination resorts and interfered with the local process. Siting destination resorts was a result of the desires of the legislature and he feels they violated land use laws to do it. Commissioner Luke said that the Cyrus' have a lot of work to do and may never get to where they want to be. They are currently mapped and it is a property right that they already have. They just want to keep that right. UNGER: Move second reading by title only of Ordinances 024 and 025 by title only, declaring an emergency. BANEY: Second. VOTE: BANEY: Yes. UNGER: Yes. This item will be addressed at a future date. 5. Update of Commissioners' Meetings and Schedules. Commissioner Unger will be out of the office the week of August 9, and Commissioner Baney will be out of the office from August 16 through 25. Commissioner Baney presented letters for signature that would be sent to local legislators regarding extending federal forest payments. Erik Kropp said that the Commission on Children & Families wishes to apply for a grant of $17,000 to hire a consultant to train employees at the Department of Human Services in ways to help decrease the number of children in foster care. Commissioner Luke wants to make sure there is no additional liability to the County. He asked the County Administrator to oversee this process. Being no further items addressed, the meeting adjourned at 2:30 p.m., at which time the Board went into executive session under ORS 192.660(2)(i), to conduct an annual review and evaluation of the employment-related performance of Mark Pilliod, County Counsel. BPAC is comprised of citizen members appointed by the Board of County Commissioners to advise them on matters related to bicycle and pedestrian facilities, policies and issues throughout our community. Learn more about BPAC at our brand new web location, www.bikecentraloregon.org. Skyliners Road. The mere mention of this tranportation corridor and mountain gateway on Bend's west side conjurs images of unmatched recreation opportunity, scenic drives and breathtaking (literally!) bicycling adventures. For many, it represents the commute home. However, due to its current configuration and condition that is arguably inadequate for the current diversity and extent of use, Skyliners Road is also a source of challenges and potential conflict between user groups that include motorists, bicyclists and pedestrians. The good news is that a strong partnership between Deschutes County, the City of Bend and the United States Forest Service has evolved and is moving forward with a strategy to improve this important transportation facility for all road users. With funding commitments in place, substantial improvements will occur in the next 2-3 years. In the meantime, BPAC has been tasked by the Board of County Commissioners to help alleviate conflict along Skyliners and help instill a "share the road" ethic among all road users. We hope to engage the support of the broader community, with a goal to enhance bicyclist and motorist safety on Skyliners Road. We expect to achieve this by: • encouraging the use of alternative, suitable and potentially less hazardous routes in the community by recreational bicyclists; • educating motorists and bicyclists about applicable laws governing shared use of roadways; • creating a public education plan to inform the public about the situation on the road; • working to positively influence the design of the Skyliners Road improvements; • setting a precedent for other roads of similar type in the county; • and by creating an atmosphere of cooperation among all interested parties. Some steps have already been taken, and others will be implemented in the weeks and months to come. In the short-term, however, we need your help. As an organizer, coach or rider involved with the USA Cycling National Championships being held June 22 - 27, 2010, we need your assistance to encourage all riders to explore routes in addition to Skyliners Road for team training, and to be familiar with traffic laws that apply to motorists, bicyclists and all roadway users. Finally, we hope to instill and further strengthen the philosophy of Share the Road, and ask your support to foster courteous interactions among all road users, on Skyliners Road and throughout Deschutes County. Again, Skyliners Road will be reconstructed in the near future, with the resulting design expected to accommodate all users safely and efficiently. These steps we take today can help insure safe, shared use by all until these improvements occur, and will help build and sustain an ethic to share the road as part of the incredible culture that is Central Oregon and exemplified in Deschutes County. Bicyclists have the same rights and responsibilities as drivers of cars Drivers must obey these traffic laws: Pass to the left of the cyclist. Remain behind the cyclist until it is safe to pass. Do not drive or park in a bicycle lane. You may cross a bicycle lane when turning or when you need to cross the lane to park near the curb. Yield to oncoming bicyclists when turning - do not underestimate their distance or speed. When nearing an intersection, look right and behind you before making a right turn. Use caution and good judgment to determine whether to pass the cyclist and turn or slow down and yield to the cyclist. Before getting out of your parked car, check behind you for approaching' bicyclists before opening the door. Remember to signal all lane changes and turns, including exits from roundabouts. Bicyclists have the same rights and responsibilities as drivers of cars. Obey traffic laws and ride predictably. Cyclists must obey these traffic laws: Ride in the same direction as traffic. Ride in the bike lane when one is available. You may move into the travel lane in order to avoid a hazard, turn left or pass. Use caution when entering the travel lane and yield to traffic. Ride no more than two side-by-side on the roadway. Be courteous to following traffic. Stop at stop signs. Stop at all red lights and remain stopped until the light changes to green. Stop for pedestrians at crosswalks. Use a white front light and a red rear reflector attached to your bike when riding at night. It is also good to wear brightly colored clothing. In downtown Bend, bicyclists are not permitted to ride on the sidewalk. While in downtown, ride in the travel lane or walk your bike on the sidewalk. When approaching an intersection, be aware of right-turning vehicles. Remember to signal all lane changes and turns, including exits from roundabouts. It is unfair to give special privileges to a select few individuals in this county while the rest of us tax payers are required to follow the rules.
