MINUTES OF BUSINESS MEETING
DESCHUTES COUNTY BOARD OF COMMISSIONERS
MONDAY, AUGUST 23, 2010
Commissioners' Hearing Room - Administration Building - 1300 NW Wall St., Bend
Present were Commissioners Dennis R. Luke and Alan Unger; Commissioner
Tammy Baney was out of the office. Also present were Dave Kanner, County
Administrator; Peter Gutowsky and Tom Anderson, Community Development;
Laurie Craghead, County Counsel; and one other citizen. No representatives of
the media were in attendance.
Chair Luke opened the meeting at 10:00 a.m.
1. Before the Board was Citizen Input.
Citizen William Kuhn expressed concern about swastikas that were painted on
the old Tumalo Reservoir dam. There was a fire in the area and he has been
unable to get back to the dam to look at it.
It took him four hours to find out that it is owned by the BLM. He asked if
there is a protocol with dealing with graffiti in the County. If not, why not, and
how does one deal with this kind of problem. It is an increasing problem.
Dave Kanner said that he is not aware of one, but the County does clean up
graffiti, typically at the request of property owners. The onus is on the property
owner to take care of it, and the County cannot force a property owner to take
care of it. Approval is needed to enter private property.
Mr. Kuhn stated that he and his neighbors did enter the property and took care
of the cleanup. They also swept out and hauled off all kinds of trash. He said
that they realize they are the first line of defense for something like this, and
have responded as much as they can as a group. He feels there should be a
protocol or procedure to deal with this type of situation.

Commissioner Luke stated that the Juvenile Department works on some of
these situations in the cities. Mr. Kanner said that the City of Bend may have a
local requirement to clean up graffiti within a certain amount of time. In
answer to `why not', the County does see very little graffiti in the County, as
most is found in the cities. If someone calls, there are crews that can take care
of it, if they have authority to enter the property.
Mr. Kuhn said that he and his neighbors are very sensitive to this because there
are so many different jurisdictions that have property in the area where he lives,
and often they do not know who to deal with. He has problems with the misuse
of Sisemore Road, and the road was never placed where it is actually supposed
to be. He said the road has not been legally surveyed and the Sheriff's Office is
not sure how to handle this issue.
Commissioner Luke stated that there are other roads that are not where they are
supposed to be, and the County corrects this as it can. The County cannot
trespass on property and needs permission to do so.
Mr. Kuhn said that he thinks both of the dams are on the registry as a historical
area, regardless of which entity owns them.
Commissioner Unger stated that perhaps the graffiti issue should be discussed
between the cities and county. There are other joint issues, such as weed
control, that are important to all. As the economy allows, road issues can be
addressed by new technology such as satellite surveys if the need justifies the
expense.
2. Before the Board was Consideration of First and Second Readings by Title
Only, and Adoption, by Emergency, of Ordinance No. 2010-019, Amending
Code regarding Historic Preservation and the Historical Landmarks
Commission.
Peter Gutowsky presented an opening statement at this time (attached for
reference.).
Mr. Gutowsky said that there is a small grant ($3,000), which is a pass-through
from the federal government. The current wording of the text is one of the most
antiquated in the Code and is long overdue for updating. No one has expressed
concerns about making the change, and the Planning Commission supports it.
The deadline for the grant is the end of the month.
