Also present were Erik Kropp, Interim County Administrator; and, for a portion of the meeting, Tom Anderson, Nick Lelack and Peter Gutowsky, CDD; Timm Schimke, Solid Waste, David Givans, Internal Auditor; and six other citizens. Hillary Borrud of The Bulletin was also present. 1. Review of Recycling Education Audit. Erik Kropp explained the reasons for discussing this item, and the results of the audit process. Commissioner Baney said that like other kinds of prevention education, it is often hard to quantify the results. Chair DeBone asked whether there might be a decline or lack of future progress regarding this issue. David Givans said that he reviewed the 2009 and 2010 numbers, showing a slight decline. He tried to work with others to be able to give a broad picture, including legal requirements and the financial history. Chair DeBone stated that the recycling meets goals and the financials fit within the expected range. Mr. Givans said that education could be funded in different ways. He cannot recommend whether they should spend more or less. Timm Schimke stated that it would be nice to definitely say that spending a certain amount will result in something specific. Those places where more money is spent on education do have a higher diversion rate. In his experience, this has always been the case. The current lower funding level means the County's funding for this is significantly lower now than others listed the study. In the long term, without adequate funding the County will not do as well as it should. They are not just preaching recycling, but there is an emphasis on not producing so much waste in the first place. They also talk about toxicity and what can be done differently to reduce environmental impacts of various materials. Minutes of Board of Commissioners' Work Session Wednesday, February 1, 2012 Page 1 of 7 Pages Mike Riley of the Environmental Center said that the best practice is a full mix of services, and that includes education. The goal is moderate to high recovery rates. They cannot prove tomorrow what the result would be, but changes occur over the long-term like most prevention programs. Commissioner DeBone feels that they are working within standard ranges. Mr. Kropp asked if the Audit Committee would be reviewing the information. Mr. Givans replied that this was more of a support piece for the Board for budget reasons. Commissioner Baney said a letter from Brad Bailey indicates the haulers are funding educational programs as well. She asked if the schools are doing the same. Mr. Riley stated that the contractors and County, not the schools, provide funding for this. There are `green' projects at the schools with which they are involved, but they do not include classroom education. Commissioner Unger stated that there is a big buzz when there is a new program, and the kids take this knowledge home. He asked how you put a monetary figure on that. The question is how to keep the awareness going. You will not get to all of them every year. It needs to energize children. He feels these programs are effective. Mr. Kropp indicated that there was recently an RFQ done for recycling education. One proposal was from the Environmental Center; another was from someone in California with a marketing plan. The Board funded $50,000 this year, when in the past it was $150,000. Solid Waste has asked for an additional $25,000 to $30,000 this fiscal year. The request is not from the Environmental Center, but from Solid Waste. Staff recommends providing the additional services this year. Mr. Schimke said that $100,000 would be funded, but it started out with $50,000. There is about $13,500 overhead associated with the work they have done. When started, they looked at what extra dollars might do. They thought this discussion would happen last year. They developed the `re-think waste' campaign also. Mr. Riley stated that they had hoped to design the campaign and develop other ways to reach out. Implementation would begin next year. They are asking for $15,000 this year and another $15,000 to $25,000 next year. It appears they may be able to justify that now. Mr. Schimke stated that the biggest unknown is the construction industry. When things were very busy, it was almost impossible to sort out the recycling portion of construction material. Someday they will be at this level again, and he wants to be prepared for that or whatever else is going to happen. It turned out that the minimum qualifications are being met, but there is much that is over and above that; and he was pleasantly surprised to learn about some of it. Commissioner Baney stated that public involvement is the important piece. The public wants to know where money is going and she wants to be able to show them where, why and how. She does not see the audit as a negative, or that something was not being done; rather, it gives clarity and is in keeping with goals. Commissioner Unger says that it has come a long way, but wonders if there is a different way to handle oil pickup since it is not that common. He feels that it may be a waste to pick up and take glass to Hillsboro, when that is expensive. Mr. Riley said that some things need to be scrutinized, and it is helpful to know what needs to be tightened up. It is true that things are being done right, and the haulers are responsible for much of this. It is a partnership resulting in higher recovery rates, and the trajectory is generally an upward one. There has been a big change in the Solid Waste budget, so scrutinizing this was merited. Commissioner Unger added that new landfills cost millions, and this helps to keep that issue further out. Mr. Schimke said that it all might end up saving the rainforest, but it is hard to think that globally. Commissioner Baney asked about the role of local government assisting with education in local schools. She feels there are some things that might be shifted from what is a known education piece to other things. She asked when this might be shifted to other identified needs. She said that kids have been educated as to using seat belts to the point it is second nature, and asked why this would not work in the same manner. Minutes of Board of Commissioners' Work Session Wednesday, February 1, 2012 Page 3 of 7 Pages Mr. Riley replied that the difference is it not as clear as putting on a seatbelt. It is not true that everyone knows how to do each thing, since there are many variables, and programs change. They have gone from separate recycling to comingling, and yard debris pickup, and removing recyclables from waste before it goes into the landfill. There is also construction waste and how to keep that out of the waste stream as well. His group has a role in this, but not necessarily the whole role. Commissioner Baney stated that if they spend a certain amount towards diversion, there would be a time when they will want to back off from involvement with the schools and focus on other programs. Mr. Schimke said they need to go through this exercise. The schools are geared towards a different message. The conversation is now how to make less waste, composting and the use of toxics in households. Change will occur, but it is not known when it will be logical to go that way. If they were to pull out from the schools now, the schools would not backfill the program. They are now bringing kids out to the landfill, to help them begin to understand the impacts of what they do every day. Mr. Riley said that providing education services is considered a key component to get credits. There is some responsibility to work towards those credits. Mr. Kropp stated that the policy question is whether to go ahead and fund what was not funded at the beginning of the fiscal year. The Board indicated support of providing the funds, after having done due diligence as requested by the Budget Committee. Mr. Schimke said they have shown they are making progress in these areas. Some communities place an inordinate amount of concern on those numbers. They did drop to 41% from 45%. It is a bit arbitrary, requiring a certain diversion rate by a certain time. It means additional programs and additional costs. They made a choice to stretch. Some communities are happy staying at 25% every year. Commissioner Unger noted that it is not so much the tonnage, but the quality: How are they keeping toxics and other materials out of the landfill means more than some other things. Mr. Schimke said that, for instance, glass is benign and poses no hazard in a landfill, but other things that weigh less may present more of an environmental hazard. Minutes of Board of Commissioners' Work Session Wednesday, February 1, 2012 Page 4 of 7 Pages The Commissioners agreed that the additional funding is appropriate, and can be handled administratively by Mr. Kropp. 2. Other Items. Peter Gutowsky explained that last week there was a BLM outreach meeting. They are committed to updating their resource management plans so that implementation and regulatory measures can be prepared. They need to be successful in keeping Sage Grouse off the endangered species list. The scoping process is the beginning of the federal process. The divided the Sage Grouse region into western and eastern and essentially are interested in public comment, which would be vetted through the environmental impact statement. They hope to develop a series of alternatives and a preferred alternative. They sent a letter to the Board asking if the County wants to become a cooperating agency. This allows the County to take a formal role in the scoping process and during the development of alternatives. This means a seat at the table during this time. The types of activities on these lands would be affected by this work. The NEPA Coordinator for the BLM for Sage Grouse felt Deschutes County might want to become involved. Commissioner DeBone had asked Nick Lelack to find out more. Commissioner Unger feels this is important, as this could be a game changer for eastern dry counties. They could be a voice for other counties and maybe for the AOC. They might be able to come with workable solutions with a variety of users. This could help the County and others. Commissioner DeBone wants to be sure the County is not over-committed and is not sure what is expected. Mr. Gutowsky said there is information on what a cooperative agency does, and an MOU would provide a framework. He asked if Community Development or Long Range Planning should be involved with this, and be a conduit to the Board. Commissioner Baney expressed concern whether the County has to sign on to a specific issue, such as protecting the Sage Grouse outright. It should be what BLM subscribes to. There can be implications that cause economic problems. She would want to be sure the agreement is clear. Minutes of Board of Commissioners' Work Session Wednesday, February 1, 2012 Page 5 of 7 Pages Mr. Gutowsky indicated that if there is interest in becoming a cooperative agency, it is not so much to get buy-in, but to get to an insider's perspective of the issue on behalf of the public. The public comes in at the front end, but the next opportunity to provide feedback is when the draft preferred alternative is developed. This gives the County a chance to weigh in during the process. Commissioner DeBone stated that this experience can be beneficial in building relationships. Commissioner Unger said they need to be at the table to come up with a plan that works for everyone. Commissioner DeBone is interested in being involved but does not want to commit to a lot of resources. Mr. Lelack said CDD is developing its work plan for next year. Tom Anderson asked if the preferred alternative would only apply to federal land. Mr. Gutowsky stated that there are two different processes, and this one has to do only with federal land. CDD has been assisting Harney County with a technical assistance grant in an effort to provide a unified approach towards a scope of work, addressing private land. The selling point for the DOC land was to unify those governments, which may allow for outside grant funding to address private land uses, with innovative incentives. Commissioner Unger stated that they could point out how these two programs could work together. Mr. Gutowsky said he will get as much information as possible and perhaps ask BLM to attend a work session with the Board. The Board then went into Executive Session under ORS 192.660(2)(h), pending or threatened litigation, and ORS 192.600(2)(e), real property negotiations After executive session, the following action was taken in regard to the Latham mine appeal.
