WHEREAS, the Deschutes County Sheriff's Office has two existing checking accounts (1) Criminal Justice Facility Inmate Trust Account and (2) Criminal Justice Facility Bail Account; and, WHEREAS, the Deschutes County Sheriffs Office wishes to create a new bank account, the Criminal Justice Facility Inmate Advanced. Funds Account, in order to ensure an adequate level of funds for the number of transactions in which funds are returned to inmates; and, WHEREAS, the Deschutes County Treasurer confirms the authorization of this account set up to provide protection against overdrafts as a result of the operational delay associated with the depositing of funds from "Telmate" the vendor utilized with contract #2011-054 for receipt of inmate funds and the authorized return of these funds to inmates; and, WHEREAS, the money in the Criminal Justice Facility Inmate Advanced Funds Account will be provided by "Telmate" and will only be utilized if the amount of money in the Criminal Justice Facility Inmate Trust Account is insufficient to cover transactions; and, WHEREAS, the money withdrawn from the Criminal Justice Facility Advanced Funds Account will be returned to the Criminal Justice Facility Advanced Funds Account once adequate funds have been deposited into the Criminal Justice Inmate Trust Account. WHEREAS, the Deschutes County Treasurer and the County Internal Auditor are requesting that all regular checking accounts be reconciled timely to promote an effective control and minimize the potential for errors or irregularities; therefore, BE IT RESOLVED BY THE BOARD OF COUNT"Y COMMISSIONERS OF DESCHUTES COUNTY, OREGON, as follows: Section 1. The Criminal Justice Facility Advanced Funds Account will be reconciled monthly with a copy of the reconciled statement sent to the Finance Department. The funds will be provided to the Deschutes County, Oregon Inmate Advanced Funds Account with the following agreement and understanding: This Amendment in no way alters or amends the obligations due under Contract 2011-054. 2. The Advanced Funds are not an advance of funds for any particular inmate, and do not compromise inmate funds. The Advanced Funds will be placed into a separate account, the Inmate Advanced Funds Account, in order to ensure an adequate level of funds for the number of transactions in which funds are returned to inmates. The purpose of the funds is to provide protection against overdrafts as a result of the operational delay associated with transferring funds by Telmate on a weekly basis. The money in the Inmate Advanced Funds Account will only be used if the amount of money in the Imnate Trust Account is insufficient to cover transactions. The money withdrawn from the Inmate Advanced Funds Account will be transferred back to the Inmate Advanced Funds Account once Telmate deposits adequate funds into the Inmate Trust account. 4. No interest shall be due to Telmate under this Amendment on the Advanced Funds. Telmate shall make deposits on a weekly basis, no matter the balance of the funds in any given week. 6. The Advanced Funds remain the property of Telmate, and must be returned to Telmate within five (5) business days of written demand by Telmate or termination of the Agreement between the parties, whichever occurs first. 7. Deschutes County warrants that it will use the Advanced Funds only for the purpose(s) described in this Amendment and for no other purpose. Deschutes County will monitor the activity in the Inmate Advanced Funds Account. No other warranty, express or implied, is made or intended by either party under this Amendment.
