Also present were Tom Anderson, Interim County Administrator; Erik Kropp, Deputy County Administrator; and, for a portion of the meeting, Ken Hales, Community Justice; Scott Johnson, Health Services; Judith Ure, Administration; Scot Langton, Assessor; Laurie Craghead, County Counsel; Rob Poirier, 911 County Service District; Nick Lelack, Community Development; Judge Charles Fadeley; Tom Fay, Fire District; and Judy Spackman of the Children & Families' Commission. No representatives of the media or other citizens were present. 1. PLEDGE OF ALLEGIANCE 2. CITIZEN INPUT None were offered. 3. Before the Board was Consideration of a Public Hearing and Consideration of Signature of Order No. 2013-006, Approving the Reynolds and Boyd Annexation into Deschutes County Rural Fire Protection District #2. Laurie Craghead gave a brief overview of the item. The only issue was that the Department of Revenue wanted a clearer map, and that is now acceptable. All statutory requirements have been met. Chair Unger opened the public hearing. Being no testimony offered, the hearing was closed. ADDITIONS TO THE AGENDA Before the Board was Consideration of Approval of Grant Applications for the Children & Families' Commission. Julie Spackman explained the grants (a copy of a memo is attached for reference). Commissioner Baney stated that the State is going to discontinue funding the Commission on Children & Families' system. She is comfortable moving forward with these grants, given that the work will need to be continued if the grants are approved. BANEY: Move that the applications be supported. DEBONE: Second. The group discussed the process, meeting times, and other details of the upcoming legislative session. Judith Ure spoke about PERS reform. There are no PERS bills in print, and she heard that these issues are not being well screened at this time. AOC is part of the employer alliance which is starting to build on these discussions. They will be looking at any bills carefully, seeking examples of how PERS changes are impacting or may affect local entities. It is too soon to know what this all will look like. She referred to a spreadsheet with the existing bills' priorities, feedback from the departments, and recommendations as to priority. The 4's can go off the list as being of no interest or impact; the 3's may need to be watched; and what is important is the l's and 2's. Priority 1 is something that the County will lobby for and commit resources. Priority 2 will be supported in other ways. Priority 3 items are being monitored. Priority 4 is of no interest or has no impact on Deschutes County. The bill list is a lot longer and some items are not on the spreadsheet. Commissioner Baney stated that Public Affairs Counsel has had personnel changes and the newer people might not know how this has been handled in the past. Ms. Ure said that she has some of this format developed and it will be refined as they go through the process. Commissioner Baney indicated that she values the department comments and would like those to be included. Mr. Anderson asked if there is a way to incorporate these in the report drafted by PAC. Ms. Ure said that may not be possible because PAC represents other entities and may be using the same documents for all, but she will ask. Mr. Poirier said that a number of bills of interest to him are not included. He asked how these can be included. Mr. Ure said he could send those to her with comments. The list will change over time. Minutes of Board of Commissioners' Business Meeting Monday, February 4, 2013 Page 3 of 9 Commissioner Baney stated that a lot have land use impacts. Ms. Ure said that there may not be affected departments on some bills. All department heads get the list and can comment. Commissioner Unger noted that things come and go, and change, quickly. They have to watch for issues that need more focus. Ms. Ure said that some are more important to departments than others. Many might start out being priority 3. It is hard to know the true impacts of some of the bills at this time. Regarding HB 2103, Mr. Hales recommended support, but this has no direct impact on Deschutes County. This would be a priority 3. In regard to HB 2043, detention facilities, this is mainly clean-up language. A priority 3. Ms. Ure stated that it may result in a cost to the County, through specific reporting requirements. The Sheriff has not responded to the list yet. HB 2062 should be added to the list, per Mr. Lelack. Mr. Anderson said that some of the bills are created by various organizations or associations that take an active position on the issue. If the Board has the same opinion of an issue, the organization can carry it forward. Mr. Poirier stated that there is a sunset on the 911 tax, and HB 2235 would extend it to 2026. This is supported by the association, but there are a few more that extend the tax as well, but for a shorter time. This tax is associated with the phone lines, which equates to 10% of the operational funding for 911. Regarding HB 2036, Mr. Poirier is trying to meet with Representative Conger. It involves a prepaid tax on cell phones, but there is no mechanism in place to pay the tax. There are three pre-paid bills total. The point of sale tax is opposed. Ms. Ure stated that she believes HB 2035 is a priority 2, along with SB 134, HB 2036 and HB 2035. Commissioner DeBone said the PAC should show up to support those. Mr. Johnson added that if someone is in Salem on specific dates, they should sit in on or testify at these hearings. Minutes of Board of Commissioners' Business Meeting Monday, February 4, 2013 Page 4 of 9 Mr. Johnson said that the coordinated care bills might all be a 2, in particular the early learning council. This should include early screening on behavioral health issues. They are already building a way to move this forward. Scot Langton stated there are some that deal with a constitutional amendment relating to savings to taxpayers. Some of the bills may have significant implications on the budget or would be hard to implement. Commissioner Baney said that it might take a couple of weeks for the bills to be screened, and some will be eliminated. Some are contrary to others. She said that there needs to be consensus of the Board on these, but they are relying on the department heads to monitor those as appropriate, and provide an opinion of the potential impacts. Judge Fadeley said regarding HB 2487 that a similar bill was introduced at the last session. He thinks this is a throw-away. The County won't get any of this money if it is on a highway. The County should oppose it if it is written the same. He will keep an eye on it to see if stays active. Someone else will take the lead. The Sheriff should be interested in this one as well. In regard to SB 180 Judge Fadeley stated that at the last session, the State's cut from all convictions is $60 off the top. This used to be lower based on the infraction. AOC has found a sponsor for a bill where the State gets $45 instead.. If the State gets more, there will be $50,000 less to the County for Justice Court. For the $60, the courts would get nothing from the State. Mr. Poirier stated in the past that this funding was to go to training for public safety, but has been diverted to the general fund. In regard to HB 2580, Ms. Ure asked if this has an impact. Judge Fadeley said he does not know what this one is about. Commissioner Baney stated that new Court Administrator Jeff Hall should be a part of this process as well. Mr. Hales said that HB 2392, the Commission on Children & Families' bill, addresses funds that used to come through CCF from the State, and would be redirecting this to other things. This takes away prevention funding for about $130,000, including functional family therapy for non-detention youth and other programs. If modifications do not go through, they won't get this funding. They may not get it anyway. Some is for gang-related activities that are more of a problem in the big cities. The Council formed this year as part of the Governor's redesign with the youth development council and the early learning council. Commissioner Baney noted that there is not a clear nexus on this yet. There is nothing stated for Central Oregon. Mr. Hales said that it requires broad representation of counties and county departments. They are taking the commission system and breaking it into two. The statewide youth development council would function as the state advisory group for justice and prevention funding. Commissioner Baney stated that there is still a lot to be determined. Mr. Hales said that HB 2574 should be a priority 3. It won't impact them directly, but is a Department of Corrections policy. HB 2594 was initially supported, but it needs more study. It should be a priority 3. SB 40 and 46 are related to marijuana penalties. The State Public Safety Commission recommendations are in it and it is supported by the District Attorneys Association. It involves lesser penalties. Commissioner Baney said that she is sensitive to legislation that greases the skids for legalizing marijuana use, from a B to a C felony. Mr. Anderson explained it is designed to reduce the prison population. Mr. Hales added that it won't have a big impact, since they already see these people, so it would just be for a shorter period of time. Many are matrixed out already. SB 70 is supported by the association. The sunset bill requires 180 days in jail, which impacts jail population. This bill would continue the current practice of 60 days. This is a priority 3 at this time. SB 93 is a good bill, and allows the Department of Corrections to give reentry support for older kids, in particular those that were housed at the OYC. It stays the same. Mr. Lelack said that most impacting Community Development are a 3. The population forecasting bill is a priority 2. AOC will take the lead. Others affect the urban growth boundary and are placeholder bills. They are trying to find common ground. Most of these affect the cities. Minutes of Board of Commissioners' Business Meeting Monday, February 4, 2013 Page 6 of 9 SB 03931 0449 and 0455 have significant changes to the statewide planning program. He would like to see the delegation involved in these. SB 0393 comes into play if an agency is able to show green collar job development outside of the UGB, with exceptions. This is a huge hurdle. The Heritage Farm bill from Cyrus will be reintroduced. Another has to do with destination resort reporting requirements, but the County already has this in place. Mr. Anderson said that HB 2238 is not on the list. It would take.DEQ funds that are loaned to local governments for groundwater-related activities. They are not getting enough business through their loan program, so this would become grants. The County might be able to tap into it for septic systems or for further feasibility studies. This needs support at some level. It is being proposed by the lead agency, the DEQ. HB 2238 reads correctly. HB 2258 is specifically for water issues. Mr. Johnson stated that the Coordinated Care Organization status is uncertain, so they are monitoring any that might undermine what the County is trying to build. They are watching what is going on in Klamath County as they are having difficulties with the CCO there. A couple concern dental care. HB 2248 could be a 2. Commissioner Baney said that they need to get ahead of this one. The next piece will involve regionalizing. Mr. Johnson said he is willing to have a regional conversation, but some others aren't. Mr. Johnson supports HB 5030, the mental health budget, as it might bring in new resources. It links up with service integration and the CCO, and they are already doing this. SB 100, health info technology, is to include mental health. Mr. Poirier said that SB 134, the regional authority, is part of budget note to the Military Department, but was hijacked by the Veterans Affair Committee. This would develop nine 911 centers instead of having local ones. He is not opposed to regionalization, but the State should not force them into regions that don't fit what is already being done. Funding would be different and it affects maximum funding Minutes of Board of Commissioners' Business Meeting Monday, February 4, 2013 Page 7 of 9 It is hard to be proactive, as some of the coalition in other areas is crumbling. They are having to reconfigure the pricing model. Mr. Poirier presented a position paper for 911, regarding prepaid taxes, the 911 tax and forced consolidation. If this happens, Deschutes County would end up subsidizing other counties. Mr. Langton said he is watching some bills at the House and Senate. Some have unintended consequences regarding who modifies what. The senior deferral was already lost by some citizens. The Governor's HB 2219 is only a placeholder, and deals with Facebook issues and communications. Because of economic competitiveness, some states do not tax this. The Governor had vetoed it twice, but now is proposing it. HJR 008 is the local option taxes, and needs to be watched. JHR 0013 could possibly be expensive to administer. Real estate and builders don't support this. SB 15, declares an emergency for counties. Curry, Josephine and Lane are on the edge of fiscal disaster. The general fund supports 80% of what Assessors do. This has a mechanism where the State would take over that function and charge for it. AOC is a proponent of an administrative fee. 1.8% of the taxes funds his office. Counties have to declare an emergency and the Governor has to approve it. He is not sure it will fit here. There are mixed feelings in Salem on this issue. Commissioner Baney said that some think they should allow the counties to go under. This should lie with their voters. Mr. Langton noted that some cities are affected as well. Mr. Ure said there are more than 75 bills out there, and many may never see the light of day. She will send the Board's recommendations to PAC. There are still some on the list that have not yet been prioritized. She will try to keep the department comments included. Commissioner Baney said that in 2011, she ran into issues when opposing a legislator's bill. They should reach out to the local legislators to find out what they think of some of these. She would like no surprises later. Chair Unger noted that they don't necessarily need to be on the same page, but just need to be aware. The Commissioners can't always be on board with some things. November 15, 2012 We represent the managers, operators, and users of the 9-1-1 system that helps insure the safety of Oregon's citizens on a daily basis. We do not support the strategies for consolidation of the 9-1-1 system put forward in the Kimball report dated February 2012. Consolidation of PSAPs (Public Safety Answering Point) is occurring throughout the state as a result of local partners working together. We do support consolidation in instances where it is locally driven, meets the needs of the residents, local governmental entities and the emergency response system. These naturally occurring consolidation efforts should be supported by policymakers without unnecessary regulation that can impede this work in progress. We see the need for increased funding for 9-1-1 services; funding has not kept up with needs and has placed a stress on the system that is detrimental to individuals in need. Oregon is one of 7 states that decided to divert 9-1-1 funds in order to pay for budget shortfalls. We believe that 9-1-1 collected funds should be dedicated solely to the 9-1-1 system for the protection of the citizens of this state. Diminishing these Emergency Communications Tax Funds away from their stated purpose will create an increasingly unstable 9-1-1 system at the local level and may ultimately jeopardize the integrity of the entire emergency response system. We support the extension of the current Emergency Communications Tax (the "9-1-1 Tax") at the $.75 per month level, which is assessed currently. Filed legislative concepts call for the extension of this tax through January 2026 and clarify the inclusion of pre-paid cellular devices under this statute. The Oregon Department of Justice, Legislative Counsel and the Oregon Department of Revenue concur that pre-paid cellular devices are included in the Emergency Communications Tax and collection of those funds should begin immediately in order to support the 9-1-1 system that is being utilized on behalf of those consumers on a daily basis.
