REVIEWED LEGA COUNSEL COUNTY OFFICIAL NANCYUBLANKENSHIP, COUNTY CLERKS 1►J 2013.A COMMISSIONERS' JOURNAL 05/30/2013 10;05:26 AM 1111111111 IIIIIIIIIIIII III III 2 12-sP BEFORE THE BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON Order Accepting a Petition for Formation of Alfalfa Fire District and Setting a Hearing * ORDER NO. 2013-022 Date WHEREAS, a petition requesting formation of Alfalfa Fire District has been duly filed with the County on May 13, 2013, a copy of which petition is attached hereto as Exhibit A and by this reference incorporated herein; and WHEREAS, the Deschutes County Assessor's Office has verified that the formation petition was signed by a sufficient number of landowners to allow acceptance of the petition, and the petition is otherwise in the form required by law; and WHEREAS, ORS 198.800 requires the county board to set a date for a public hearing on the petition no sooner than 30 days and no later than 50 days from the date of filing with published and posted notice; and WHEREAS, the next available hearing date within that timeframe is June 26, 2013; and, now, therefore, T1-I1• BOARD OF COUNTY COMMISSIONERS OF DESCHUTES COUNTY, OREGON, HEREBY ORDAINS as follows: Section 1. That the formation petition for Alfalfa Fire District, a copy of which is attached hereto as Exhibit A, is hereby accepted for filing. Section 2. That an initial hearing regarding formation of the district shall be held on Wednesday, June 26, 2013 at 10:00 am at 1300 NW Wall Street, Bend, Oregon. Section 3. Notice of Hearing shall be given in substantially the form set forth in Exhibit "B," attached hereto and by this reference incorporated herein. The recording secretary shall cause the notice to be published in The Bulletin on June 10, 2013 and June 20, 2013 and posted June 10, 2013, in three public locations within the county as follows: One notice shall be posted on or near the doors of the meeting room of the Board of County Commissioners; one notice upon any official bulletin board customarily used for the purpose of posting public notices within the county; and one notice shall be posted upon any official public bulletin board customarily used for the purpose of posting public notices within the proposed district. The Director of the Deschutes County Community Development Department shall cause to be filed with this Board prior to June 26, 2013, a land use compatibility statement regarding this proposed special district formation as contemplated in ORS 197.175 and 199.462, and any other applicable statutory authority. The Board of County Commissioners Deschutes County, Oregon 1. The undersigned petitioners hereby propose formation of a fire district and in furtherance thereof do hereby join in this petition; 2. This petition is filed pursuant to ORS 198.705 to 198.955. The principal Act for the district is ORS 198.010 - (#14) A Rural Fire Protection District under ORS chapter 478. 3. The purpose of the proposed district is to organize for rural fire protection for property within the district, enter into mutual aid agreements, apply for grants, train members, educate the public, purchase and maintain necessary equipment, land, and structures as required for operating a fire district and department, and provide emergency medical assistance. 4. Said formation affects Deschutes County (approximately 70% by land mass) and Crook County (approximately 30% by land mass) within the boundaries of the proposed district. 5. The territory subject to this petition is inhabited. 6. The board of commissioners (directors) will comprised of 5 commissioners and the initial commissioners are to be elected. 7. A proposed permanent tax rate sufficient to support the services and functions described in the economic feasibility statement is the amount of $1.75 per $1000 of assessed value. 8. A description of the boundaries of the territory to be included in the district is attached as Exhibit "A" and depicted on the map attached as Exhibit "B", both documents being incorporated by reference herein. 9. Description of the services and functions to be performed or provided by the proposed district: The proposed Alfalfa Fire District, when fully functional, will provide the following services: 1. Fire protection for persons and property within the district boundaries; 2. Adequate training to the firefighters and officers to provide for their safety and welfare; acquire or purchase equipment and property as required to accomplish the district goals and objectives; 3. Clothing, safety equipment, and communications equipment required for the protection of firefighting personnel so they can safely respond to emergencies; and 4. Conduct fire prevention, fire safety education to the public; 5. Medical support assistance for the Bend Rural Fire Department if feasible. Formation of the proposed district will provide for better fire services and protection than now exists within the proposed boundaries. Responses to fires will be with properly trained personnel and appropriate equipment. Residents within the district have expressed support and an interest in establishing fire protection. Property owners may realize some reduction in insurance costs and/or the ability to obtain fire insurance. The district will have tax based revenue and will apply for grant aid to augment tax dollars. The proposed Alfalfa Fire District is a rural area on the eastern edge of Deschutes County and the western edge of Crook County (see Exhibit B--map). Within the boundaries of the proposed area is the Cascade View Estates subdivision which has approximately 275 properties currently without adequate fire protection. -1- Page 56 of 59 - EXHIBIT A TO ORDER 2013-022 Several properties do not have a water source other than cisterns or holding tanks to supply their daily needs. Other properties have wells but not enough flow to adequately fight fires, either structural or wild land. In addition to the Cascade View Estates subdivision and also within the proposed Alfalfa Fire District are approximately 100 farms and ranches scattered throughout the balance of the area. There are approximately 41,000 acres within the boundaries of the proposed Alfalfa Fire District. Ownership consists of over 24,000 acres (about 60%) of federal (BLM) land on the outer perimeter. Approximately 25,600 acres of the district lie within Deschutes County and approximately 15,400 acres are within Crook County to the east. There are over 500 tax lots within the proposed boundary. 2. Analysis of the relationships between proposed services and functions and other existing or needed government services: The area of the proposed fire district lies more than 10 miles east of the existing Bend Rural Fire Protection District #2 station on Hamby Road. Currently there are no plans for that station to extend eastward or annex the proposed area primarily due to response times. Bend Rural does provide ambulance and medical response to the proposed district. Any future medical responses by trained members of the Alfalfa Fire District would be only supportive in nature and would only assist, not replace, the Bend Rural Units. There is a significant amount of Bureau of Land Management property on all sides of the proposed fire district. These areas consist of a flammable sage/Juniper fuel type; a xeric area that receives less than 10 inches of moisture per year. Lightning is a common summertime visitor to the region and can ignite fires that are capable of significant growth under the right conditions. Response to fires in the forested setting are by federal government resources trained only in wild land firefighting; these resources have no structural training and by agency policy are -2- Page 57 of 59 - EXHIBIT A TO ORDER 2013-022 not allowed to engage structural fires. Currently, any sort of structural fire response is by way of well intentioned local residents who put themselves at risk because they do not have the proper equipment or training. The Deschutes County Sheriff's Office will also respond but, as with the local citizens, these officers are put at significant risk because of a lack of proper equipment and training. In neighboring Crook County the nearest fire protection district is over 10 miles to the north (Crook County Rural Fire at Powell Butte.) Once established the proposed Alfalfa Fire District will enter into mutual aid agreements with those agencies and entities adjacent to the district. The proposed district will not compete with any existing fire protection services, but will compliment those in proximity to the area. 3. Board of Directors There will be 5 directors who will be elected at the same time the proposed fire district is voted upon. Directors shall either own property or reside in the district. 5. To view the boundaries of the proposed district, contact the Deschutes County Counsel's Office at 388-6623. The proposed formation shall be referred to as the "Alfalfa Fire District". The purpose of the proposed district, when fully functional, authorized by ORS Chapter 478, is to organize for rural fire protection for property within the district, enter into mutual aid agreements, apply for grants, train members, educate the public, purchase and maintain necessary equipment, land, and structures as required for operating a fire district and department, and provide emergency medical assistance. The proposed Alfalfa Fire District, if formed, will have a permanent rate limit for operating taxes of $1.75 per $1,000 assessed value that will raise an estimated $101,092.00 in operating funds for the District in the 2014-2015 fiscal year.
